AN ACT
1 Amending the act of August 6, 1963 (P.L.521, No.277), entitled
2 "An act providing that probation officers shall have the
3 power of peace officers in the performance of their duties,"
4 further regulating planned arrests.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1 of the act of August 6, 1963 (P.L.521,
8 No.277), entitled "An act providing that probation officers
9 shall have the power of peace officers in the performance of
10 their duties," amended December 4, 1992, (P.L.766, No.117), is
11 amended to read:
12 Section 1. (a) General rule.--Probation officers heretofore
13 or hereafter appointed by any court of record of this
14 Commonwealth are hereby declared to be peace officers, and shall
15 have police powers and authority throughout the Commonwealth to
16 arrest with or without warrant, writ, rule or process, any
17 person on probation, intermediate punishment or parole under the
18 supervision of said court for failing to report as required by
1 the terms of his probation, intermediate punishment or parole or 2 for any other violation of his probation, intermediate 3 punishment or parole. 4 (b) Notification.--Prior to, or simultaneously with, making 5 an arrest authorized by this section, probation officers shall 6 give reasonable notice to the local law enforcement agency 7 within the jurisdiction where the arrest is planned to be 8 executed. 9 Section 2.
