        AS REPORTED FROM COMMITTEE ON AGING AND YOUTH, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 7, 1999

                                     AN ACT

     1  Requiring all child day-care facilities in this Commonwealth to
     2     have one or more persons competent in first aid techniques
     3     and UNDER CERTAIN CIRCUMSTANCES cardiopulmonary resuscitation  <--
     4     (CPR) at the facility when one or more children are in care.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Child-Care
     9  First Aid-CPR Act.
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Child day-care center."  The premises in which care is
    15  provided at any one time for seven or more children unrelated to
    16  the operator.

     1     "Department."  The Department of Public Welfare of the
     2  Commonwealth and its authorized agents.
     3     "Facility."  A child day-care center, family child day-care
     4  home or group child day-care home.
     5     "Family child day-care home."  A home other than the child's
     6  own home, operated for profit or not for profit, in which child
     7  day care is provided at any one time to four, five or six
     8  children unrelated to the operator.
     9     "Group child day-care home."  The premises in which care is
    10  provided at one time for more than six but fewer than 16 older
    11  school-age-level children or more than six but fewer than 13
    12  children of another age level who are unrelated to the operator.
    13  The term includes a facility located in a residence or another
    14  premises.
    15  Section 3.  Staffing.
    16     (a)  Requirement.--Each child day-care center, group child
    17  day-care home and family child day-care home, as regulated under
    18  55 Pa. Code Chs. 3270 (relating to child day care centers), 3280
    19  (relating to group child day care homes) and 3290 (relating to
    20  family child day care homes), shall have:
    21         (1)  One or more persons who hold a current certificate
    22     of completion of pediatric first aid training at the facility
    23     when day-care children are in care. Such pediatric first aid
    24     training shall include choke-saving and rescue breathing
    25     techniques.
    26         (2)  At least one person at the facility who holds a
    27     current certificate of completion of training in infant and
    28     child cardiopulmonary resuscitation (CPR) when a child who     <--
    29     WHOSE CHILD HEALTH PHYSICIAN IDENTIFIES THAT THE CHILD has an  <--
    30     increased risk for needing heart resuscitation is in care at

     1     the facility. The requirement under this paragraph shall be
     2     in addition to the current requirement for infant and child
     3     CPR at it relates to lifeguard training.
     4     (b)  Training.--
     5         (1)  Completion of training, including testing of skills
     6     and knowledge, shall be documented by the signature and title
     7     of a representative of the training entity and shall include
     8     the date training was completed. SUCH TRAINING ENTITY SHALL    <--
     9     BE A STATE-LICENSED OR NATIONALLY CERTIFIED HEALTH
    10     PROFESSIONAL WITH PEDIATRIC TRAINING. Documentation shall be
    11     retained in the facility in that person's file.
    12         (2)  THE CONTENT OF THE TRAINING SHALL INCLUDE THE         <--
    13     INFORMATION SPECIFIED FOR THE FIRST AID AND CPR IN THE
    14     CURRENT EDITION OF CARING FOR OUR CHILDREN, THE NATIONAL
    15     HEALTH AND SAFETY PERFORMANCE STANDARDS FOR OUT-OF-HOME CHILD
    16     CARE, PUBLISHED BY THE AMERICAN ACADEMY OF PEDIATRICS, THE
    17     AMERICAN PUBLIC HEALTH ASSOCIATION AND THE MATERNAL AND CHILD
    18     HEALTH BUREAU OF THE UNITED STATES DEPARTMENT OF HEALTH AND
    19     HUMAN SERVICES.
    20         (2) (3)  Pediatric first aid and CPR training shall be     <--
    21     renewed on or before expiration of certification and at least
    22     every three years.
    23  Section 4.  Applicability.
    24     This act shall apply to each facility on the date of the next
    25  licensing or certification renewal of that facility or one year,
    26  whichever is longer.
    27  Section 5.  Effective date.
    28     This act shall take effect in six months.
