AN ACT
1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled, "An
2 act concerning townships of the second class; and amending,
3 revising, consolidating and changing the law relating
4 thereto," further providing for real property.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1503(c) of the act of May 1, 1933
8 (P.L.103, No.69), known as The Second Class Township Code,
9 reenacted and amended November 9, 1995 (P.L.350, No.60), is
10 amended to read:
11 Section 1503. Real Property.--* * *
12 (c) The requirements of this section do not apply to
13 conveyances or leases of real property by a township to any
14 municipal corporation, the Federal Government, the Commonwealth,
15 or any institution district, school district, municipality
16 authority, county, public utility, volunteer fire company,
17 nonprofit corporation engaged in community industrial,
1 commercial or affordable housing development or reuse, volunteer 2 ambulance service or volunteer rescue squad located within the 3 township, nonprofit corporation organized as a public library, 4 nonprofit medical service corporation, nonprofit housing 5 corporation, nonprofit organizations providing community service 6 or development activities or nonprofit corporation established 7 for the preservation of historical, architectural or aesthetic 8 sites or artifacts. The exemption granted by this subsection to 9 nonprofit corporations OR LIMITED PARTNERSHIPS IN WHICH A <-- 10 NONPROFIT CORPORATION IS A GENERAL PARTNER AND MANAGING AGENT 11 engaged in community, industrial, commercial or affordable 12 housing development or reuse shall not apply to property owned 13 and operated by the township or subcontracted or operated on the 14 behalf of the township in order to conduct existing governmental 15 functions. 16 * * * 17 Section 2.
