                                     AN ACT

     1  Making an appropriation APPROPRIATIONS to the Pennsylvania        <--
     2     College of Optometry, Philadelphia.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The sum of $1,548,000 is hereby appropriated to    <--
     6  the Pennsylvania College of Optometry, Philadelphia, for the
     7  fiscal year July 1, 1999, to June 30, 2000, for instruction.
     8     SECTION 1.  THE FOLLOWING SUMS ARE HEREBY APPROPRIATED TO THE  <--
     9  PENNSYLVANIA COLLEGE OF OPTOMETRY, PHILADELPHIA, FOR THE FISCAL
    10  YEAR JULY 1, 1999, TO JUNE 30, 2000, FOR THE PURPOSES AND IN THE
    11  AMOUNTS AS SHOWN:
    12     (1)  FOR INSTRUCTION EXPENSES                      $1,548,000
    13     (2)  FOR A COMPUTER LABORATORY                        200,000
    14     (3)  FOR DISTANCE LEARNING                            538,000
    15     Section 2.  Payments to the Pennsylvania College of Optometry  <--
    16  on account of the appropriation provided in section 1 shall be


     1  made quarterly by the Secretary of Education on the basis of
     2  costs during the fiscal year. The secretary shall not release
     3  more than the first quarterly payment until such time as the
     4  Trustees of the Pennsylvania College of Optometry agree in
     5  writing to include a minimum of five members appointed by the
     6  Governor and the General Assembly. The Governor, the President
     7  pro tempore of the Senate, the Minority Leader of the Senate,
     8  the Speaker of the House of Representatives and the Minority
     9  Leader of the House of Representatives may each, upon receipt of
    10  the written agreement from the trustees, appoint a nonelected
    11  official to serve as a member of the board and the terms of
    12  office shall be coterminous with that of their appointing
    13  authority.
    14     SECTION 2.  PAYMENTS TO THE PENNSYLVANIA COLLEGE OF OPTOMETRY  <--
    15  ON ACCOUNT OF THE APPROPRIATIONS PROVIDED IN SECTION 1 SHALL BE
    16  MADE QUARTERLY BY THE SECRETARY OF EDUCATION ON THE BASIS OF
    17  COSTS DURING THE FISCAL YEAR AND SHALL BE CONDITIONED ON
    18  CONTINUING AUTHORITY FOR INCLUSION ON THE BOARD OF TRUSTEES OF
    19  THE PENNSYLVANIA COLLEGE OF OPTOMETRY OF A MINIMUM OF FIVE
    20  PERSONS WHO ARE NOT ELECTED OFFICIALS AND WHO ARE APPOINTED BY
    21  THE GOVERNOR, THE PRESIDENT PRO TEMPORE OF THE SENATE, THE
    22  MINORITY LEADER OF THE SENATE, THE SPEAKER OF THE HOUSE OF
    23  REPRESENTATIVES AND THE MINORITY LEADER OF THE HOUSE OF
    24  REPRESENTATIVES FOR TERMS OF OFFICE COTERMINOUS WITH THAT OF THE
    25  RESPECTIVE APPOINTING AUTHORITY.
    26     Section 3.  The Pennsylvania College of Optometry shall
    27  provide full, complete and accurate information as may be
    28  required by the Department of Education or the chairman or the
    29  minority chairman of the Appropriations Committee of the Senate
    30  or the chairman or the minority chairman of the Appropriations

     1  Committee of the House of Representatives.
     2     Section 4.  The Pennsylvania College of Optometry shall
     3  report its revenues and expenditures and present its financial
     4  statements in accordance with generally accepted accounting
     5  principles and procedures for educational institutions as set
     6  forth in the "Higher Education Finance Manual (1975)" and the
     7  "Commonwealth of Pennsylvania Budget Instructions for the State
     8  System of Higher Education, State-Related Universities and Non-
     9  State-Related Colleges and Universities."
    10     Section 5.  The trustees of the Pennsylvania College of
    11  Optometry shall report on forms provided by the Department of
    12  Education to both the chairman and minority chairman of the
    13  Appropriations Committee of the Senate and the chairman and
    14  minority chairman of the Appropriations Committee of the House
    15  of Representatives by September 30, 2000, on how State-
    16  appropriated funds were expended for fiscal year 1999-2000 to
    17  reduce the costs to Pennsylvania resident students or to provide
    18  services to Pennsylvania residents.
    19     Section 6.  This act shall take effect July 1, 1999, or
    20  immediately, whichever is later.
