HOUSE BILL

        SENATOR TILGHMAN, APPROPRIATIONS, IN SENATE, RE-REPORTED AS
           AMENDED, MAY 10, 1999

                                     AN ACT

     1  Making an appropriation to the Trustees of Drexel University,
     2     Philadelphia.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The sum of $6,789,000 is hereby appropriated to
     6  the Trustees of Drexel University, Philadelphia, for the fiscal
     7  year July 1, 1999, to June 30, 2000, for instruction and student
     8  aid.
     9     Section 2.  Payments to Drexel University on account of the    <--
    10  appropriation provided in section 1 shall be made by the
    11  Secretary of Education in equal quarterly payments. The
    12  Secretary of Education shall not release more than the first
    13  quarterly payment until such time as the Trustees of Drexel
    14  University agree in writing to include a minimum of five members
    15  appointed by the Governor and the General Assembly. The
    16  Governor, the President pro tempore of the Senate, the Minority


     1  Leader of the Senate, the Speaker of the House of
     2  Representatives and the Minority Leader of the House of
     3  Representatives may each, upon receipt of the written agreement
     4  from the trustees, appoint a nonelected official to serve as a
     5  member of the board and the terms of office shall be coterminous
     6  with that of their appointing authority.
     7     SECTION 2.  PAYMENTS TO DREXEL UNIVERSITY ON ACCOUNT OF THE    <--
     8  APPROPRIATION PROVIDED IN SECTION 1 SHALL BE MADE QUARTERLY BY
     9  THE SECRETARY OF EDUCATION ON THE BASIS OF COSTS DURING THE
    10  FISCAL YEAR AND SHALL BE CONDITIONED ON CONTINUING AUTHORITY FOR
    11  INCLUSION ON THE BOARD OF TRUSTEES OF DREXEL UNIVERSITY OF A
    12  MINIMUM OF FIVE PERSONS WHO ARE NOT ELECTED OFFICIALS AND WHO
    13  ARE APPOINTED BY THE GOVERNOR, THE PRESIDENT PRO TEMPORE OF THE
    14  SENATE, THE MINORITY LEADER OF THE SENATE, THE SPEAKER OF THE
    15  HOUSE OF REPRESENTATIVES AND THE MINORITY LEADER OF THE HOUSE OF
    16  REPRESENTATIVES FOR TERMS OF OFFICE COTERMINOUS WITH THAT OF THE
    17  RESPECTIVE APPOINTING AUTHORITY.
    18     Section 3.  The Drexel University shall provide full,
    19  complete and accurate information as may be required by the
    20  Department of Education or the chairman or the minority chairman
    21  of the Appropriations Committee of the Senate or the chairman or
    22  the minority chairman of the Appropriations Committee of the
    23  House of Representatives.
    24     Section 4.  Drexel University shall report its revenues and
    25  expenditures and present its financial statements in accordance
    26  with generally accepted accounting principles and procedures for
    27  educational institutions as set forth in the "Higher Education
    28  Finance Manual (1975)" and the "Commonwealth of Pennsylvania
    29  Budget Instructions for the State System of Higher Education,
    30  State-Related Universities and Non-State-Related Colleges and

     1  Universities."
     2     Section 5.  The Trustees of Drexel University shall report on
     3  forms provided by the Department of Education to the chairman
     4  and the minority chairman of the Appropriations Committee of the
     5  Senate and the chairman and minority chairman of the
     6  Appropriations Committee of the House of Representatives by
     7  September 30, 2000, on how State-appropriated funds were
     8  expended for fiscal year 1999-2000 to reduce the costs to
     9  Pennsylvania resident students or to provide services to
    10  Pennsylvania residents.
    11     Section 6.  This act shall take effect July 1, 1999, or
    12  immediately, whichever is later.
