                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for transportation.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1726-A of the act of March 10, 1949
     9  (P.L.30, No.14), known as the Public School Code of 1949, added
    10  June 19, 1997 (P.L.225, No.22), is amended to read:
    11     Section 1726-A.  Transportation.--(a)  Students who reside in
    12  the school district in which the charter school is located or
    13  who are residents of a school district which is part of a
    14  regional charter school shall be provided transportation to the
    15  charter school on the same terms and conditions as
    16  transportation is provided to students attending the schools of
    17  the district. School districts of the first class shall also
    18  provide transportation to such students if they are of the same
    19  age or are enrolled in the same grade, grades or their grade


     1  equivalents, as any students of the district for whom
     2  transportation is provided under any program or policy to the
     3  schools of the district. Nonresident students shall be provided
     4  transportation under section 1361. Districts providing
     5  transportation to a charter school outside the district shall be
     6  eligible for payments under section 2509.3 for each public
     7  school student transported.
     8     (b)  In the event that the Secretary of Education determines
     9  that a school district of the first class is not providing the
    10  required transportation to students to the charter school, the
    11  secretary shall pay directly to the charter school funds for
    12  costs incurred in the transportation of its students. Payments
    13  to a charter school shall be determined in the following manner:
    14  for each eligible student transported, the charter school shall
    15  receive a payment equal to the total budgeted expenditure for
    16  transportation of the school district divided by the total
    17  number of school students transported by the school district
    18  under any program or policy.
    19     (c)  The Secretary of Education shall deduct the amount paid
    20  to the charter school under subsection (b) from any and all
    21  payments made to the district.
    22     Section 2.  This act shall take effect immediately.
