                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for oxygen tank transportation systems.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Chapter 45 of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended by adding a subchapter to read:
     7                            SUBCHAPTER F
     8                 OXYGEN TANK TRANSPORTATION SYSTEMS
     9  Sec.
    10  4591.  Systems.
    11  § 4591.  Systems.
    12     (a)  Requirement.--An individual may not operate a motor
    13  vehicle in which there is an oxygen tank unless the tank is
    14  secured in an oxygen tank transportation system approved by the
    15  department.
    16     (b)  Grading.--An individual who violates subsection (a)
    17  commits a summary offense and shall, upon conviction, be

     1  sentenced to pay a fine of $25.
     2     (c)  Department approval.--
     3         (1)  The department shall inspect oxygen tank
     4     transportation systems.
     5         (2)  The department shall approve an oxygen tank
     6     transportation system which the department determines will
     7     allow for transportation without the risk of leaking liquid
     8     oxygen.
     9         (3)  The department shall deposit with the Legislative
    10     Reference Bureau a notice listing oxygen tank transportation
    11     systems approved under paragraph (2). The notice shall be:
    12             (i)  published in the Pennsylvania Bulletin; and
    13             (ii)  codified in the Pennsylvania Code under 45
    14         Pa.C.S. § 702(7) (relating to contents of Pennsylvania
    15         Code).
    16     Section 2.  This act shall take effect as follows:
    17         (1)  This section shall take effect immediately.
    18         (2)  The addition of 75 Pa.C.S. § 4591(a) shall take
    19     effect upon the first publication under 75 Pa.C.S. §
    20     4591(c)(3)(i).
    21         (3)  The remainder of this act shall take effect in 60
    22     days.
