AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for speed timing devices.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 3368(b) and (d) of Title 75 of the
6 Pennsylvania Consolidated Statutes are amended to read:
7 § 3368. Speed timing devices.

9 (b) Testing of speedometers.--The department may appoint
10 stations for testing speedometers and may prescribe regulations
11 as to the manner in which the test shall be made. Speedometers
12 shall have been tested for accuracy within a period of [60 days]
13 six months prior to the alleged violation. A certificate from
14 the station showing that the test was made, the date of the test
15 and the degree of accuracy of the speedometer shall be competent
16 and prima facie evidence of those facts in every proceeding in
17 which a violation of this title is charged.
1 * * * 2 (d) Classification, approval and testing of mechanical, 3 electrical and electronic devices.--The department may, by 4 regulation, classify specific devices as being mechanical, 5 electrical or electronic. All mechanical, electrical or 6 electronic devices shall be of a type approved by the 7 department, which shall appoint stations for calibrating and 8 testing the devices and may prescribe regulations as to the 9 manner in which calibrations and tests shall be made. The 10 certification and calibration of electronic devices under 11 subsection (c)(3) shall also include the certification and 12 calibration of all equipment, timing strips and other devices 13 which are actually used with the particular electronic device 14 being certified and calibrated. The devices shall have been 15 tested for accuracy within a period of [60 days] six months 16 prior to the alleged violation except radar which shall be 17 tested for accuracy within a period of one year prior to the 18 alleged violation. A certificate from the station showing that 19 the calibration and test were made within the required period, 20 and that the device was accurate, shall be competent and prima 21 facie evidence of those facts in every proceeding in which a 22 violation of this title is charged. 23 * * * 24 Section 2.
