AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for
3 sentences for offenses committed with firearms.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 9712 of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 9712. Sentences for offenses committed with firearms.

10 (b.1) Authority of Commonwealth.--The Commonwealth shall not
11 have any authority to waive, plea bargain or otherwise agree
12 with any defendant that the provisions of this section shall not
13 be applicable at the time of sentencing. No court shall accept
14 or approve of any waiver, plea bargain or other agreement to not
15 apply this section.

17 Section 2. This act shall apply to all convictions for
1 conduct occurring on or after the effective date of this act.
2 Section 3. This act shall take effect in 60 days.
