                                     AN ACT

     1  Creating a special restricted receipts account to be known as
     2     the Fort Indiantown Gap National Cemetery Memorial Fund;
     3     authorizing a voluntary contribution from the personal income
     4     tax refund of individuals for the purpose of the fund; making
     5     an appropriation; and making a repeal.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Fort Indiantown Gap National Cemetery Memorial Fund.
     9     (a)  Creation.--There is hereby created, for the purpose of
    10  this act, a special restricted receipts account within the
    11  General Fund to be known as the Fort Indiantown Gap National
    12  Cemetery Memorial Fund.
    13     (b)  Fort Indiantown Gap National Cemetery Memorial Fund
    14  contributions.--The Department of Revenue shall provide a space
    15  on the face of the individual income tax return form whereby an
    16  individual may voluntarily designate a contribution of any
    17  amount desired to the Fort Indiantown Gap National Cemetery


     1  Memorial Fund. The amount so designated by a taxpayer on the
     2  income tax return shall be deducted from the tax refund to which
     3  the individual is entitled and shall not constitute a charge
     4  against the income tax revenues due the Commonwealth.
     5     (c)  Transfer.--The Department of Revenue shall determine
     6  annually the total amount designated pursuant to subsection (b),
     7  less reasonable administrative costs, and shall report the
     8  amount to the State Treasurer, who shall transfer the amount
     9  from the General Fund to the restricted receipts account created
    10  for the Fort Indiantown Gap National Cemetery Memorial Fund.
    11     (d)  Continuing appropriation.--Moneys in the Fort Indiantown
    12  Gap National Cemetery Memorial Fund are hereby appropriated to
    13  the Pennsylvania Veterans' Memorial Commission on a continuing
    14  basis, to be used solely for the purposes of this act.
    15  Section 2.  Repeals.
    16     Section 12 of the act of June 23, 1982 (P.L.597, No.170),
    17  known as the Wild Resource Conservation Act, is repealed insofar
    18  as it is inconsistent with this act.
    19  Section 3.  Applicability.
    20     This act shall apply to taxable years beginning on or after
    21  January 1, 1999.
    22  Section 4.  Effective date.
    23     This act shall take effect immediately.
