AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for definitions pertaining to 3 snowmobiles. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 7702 of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 7702. Definitions. 9 The following words and phrases when used in this chapter 10 shall have, unless the context clearly indicates otherwise, the 11 meanings given to them in this section: 12 "All-terrain vehicle" or "ATV." 13 (1) A motorized off-highway vehicle, 50 inches or less 14 in width, having a dry weight of 600 pounds or less, 15 traveling on three or more low-pressure tires and having a 16 seat designed to be straddled by the operator is designated 17 as a Class I all-terrain vehicle. 18 (2) A motorized off-highway vehicle, 58 inches or less
1 in width, having a dry weight of [700] 1,200 pounds or less, 2 traveling on four or more [low-profile, low-pressure] 3 inflatable tires and having a bench seat is designated as a 4 Class II all-terrain vehicle. 5 (3) This term does not include snowmobiles, trail bikes, 6 motorboats, golf carts, aircraft, dune buggies, automobiles, 7 construction machines, trucks or home utility machines; 8 military, fire, emergency and law enforcement vehicles; 9 implements of husbandry; multipurpose agricultural vehicles; 10 vehicles used by the department; or off-road vehicles not 11 generally used for outdoor recreation. 12 "Cowling." The forward portion of the snowmobile, usually of 13 fiberglass or similar material, surrounding the motor and clutch 14 assembly. 15 "Dealer." A person engaged in the business of selling 16 snowmobiles or all-terrain vehicles at wholesale or retail. 17 "Department." The Department of [Environmental] Conservation 18 and Natural Resources of the Commonwealth. 19 "Head lamp." A major lighting device used to provide general 20 illumination ahead of a vehicle. 21 "Highway." The entire width between the boundary lines of 22 every way publicly maintained when any part thereof is open to 23 the use of the public for purposes of vehicular travel. 24 "Low-pressure tire." A pneumatic tire, six inches or more in 25 width, designed for use on wheels with a rim diameter of 12 26 inches or less and utilizing an operating pressure of ten pounds 27 per square inch or less, as recommended by the vehicle 28 manufacturer. 29 "Snowmobile." An engine-driven vehicle [of a type which 30 utilizes sled type runners, or skis, or an endless belt tread or 19990H0363B0376 - 2 -
1 any combination of these or other similar means of contact with 2 the surface upon which it is operated] designed to travel over 3 snow or ice that has an endless belt track or tracks, steered by 4 a ski or skis and has an overall width of 48 inches or less. The 5 term does not include any farm tractor, [highway or other] 6 construction equipment, [or any] military [or law enforcement] 7 vehicle, vehicle with inflatable tires or machinery used 8 strictly for the grooming of snowmobile trails. 9 "Street." A highway, other than an alley, within the 10 corporate limits of a political subdivision. 11 "Tail lamp." A device to designate the rear of a vehicle by 12 a warning light. 13 Section 2.
