                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for rape.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 3121(b) of Title 18 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 3121.  Rape.
     8     * * *
     9     (b)  Additional penalties.--In addition to the penalty
    10  provided for by subsection (a), a person may be sentenced to an
    11  additional term not to exceed ten years' confinement and an
    12  additional amount not to exceed $100,000 [where] if any of the
    13  following apply:
    14     (1)  The person engages in sexual intercourse with a
    15  complainant and has substantially impaired the complainant's
    16  power to appraise or control his or her conduct by administering

     1  or employing, without the knowledge of the complainant, any
     2  substance for the purpose of preventing resistance through the
     3  inducement of euphoria, memory loss and any other effect of this
     4  substance.
     5         (2)  The complainant:
     6             (i)  is under 16 years of age; and
     7             (ii)  becomes pregnant as a result of the sexual
     8         intercourse.
     9     Section 2.  The provisions of 18 Pa.C.S. § 3121(b)(2) shall
    10  apply to prosecutions commenced on or after the effective date
    11  of this act.
    12     Section 3.  This act shall take effect in 60 days.
