           LEMMOND, KUKOVICH, BRIGHTBILL, DELP, HELFRICK, WENGER,
           RHOADES, MADIGAN, ARMSTRONG, STOUT AND BELL, OCTOBER 16, 1997

        SENATOR LEMMOND, STATE GOVERNMENT, AS AMENDED, OCTOBER 21, 1997

                                     AN ACT

     1  Providing for the divestiture of airport property; imposing
     2     obligations on the Department of Transportation; and making
     3     an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Airport
     8  Divestiture Act.
     9  Section 2.  Declaration of purpose.
    10     It is the purpose of this act to authorize the Pennsylvania
    11  Department of Transportation to transfer to the Susquehanna Area
    12  Regional Airport Authority the real estate, buildings, assets
    13  and obligations attendant to and necessary for the operation of
    14  the Capital City Airport and Harrisburg International Airport.
    15  Section 3.  Definitions.
    16     The following words and phrases when used in this act shall
    17  have the meanings given to them in this section unless the
    18  context clearly indicates otherwise:

     1     "Account."  The Aviation Restricted Revenue Account.
     2     "Airports."  The Capital City Airport and the Harrisburg
     3  International Airport.
     4     "Authority."  The Susquehanna Area Regional Airport
     5  Authority.
     6     "Department."  The Department of Transportation of the
     7  Commonwealth.
     8     "Property."  All assets used in the operation of the
     9  airports, including, but not limited to, all equipment,
    10  machinery, fixtures, files, records, contracts, agreements,
    11  receivables, licenses, certificates, permits and supplies. The
    12  term shall include all legal or equitable interests in real and
    13  personal property as well as all rights and obligations arising
    14  out of the operation of the airports.
    15  Section 4.  Conveyance.
    16     The department, with the approval of the Governor, is
    17  authorized on behalf of the Commonwealth to convey to the
    18  authority, prior to January 3, 1998, for the sum of $1.00, all
    19  property used in the operation of the airports and the following
    20  land:
    21     (1)  All that parcel of land, situate in Lower Swatara
    22  Township, County of Dauphin, and Commonwealth of Pennsylvania,
    23  described as follows:
    24  9.646 Acres, more or less, being a portion of the same property
    25  conveyed or devised to the Highspire Boating Association, A/K/A
    26  Highspire Boat Club by indenture of the Penn Central Corporation
    27  dated April 30, 1980, and recorded in Record Book 129, Page 99,
    28  in the office of the Recorder of Deeds of Dauphin County on May
    29  30, 1980, which contains 18.391 Acres, more less.
    30     (2)  All that parcel of land situate in the Borough of

     1  Middletown, County of Dauphin, Commonwealth of Pennsylvania,
     2  being a 1.808 acre, more or less, portion of the same property
     3  conveyed or devised to The Pennsylvania Railroad Company by
     4  indenture of The Pennsylvania Canal Company dated October 31,
     5  1901, and recorded in Deed Book Z, Volume 10, Page 429 in the
     6  Office of Recorder of Deeds of Dauphin County, Pennsylvania, the
     7  1.808 acre parcel being bounded on the southeast by property
     8  conveyed or devised to Middletown Borough Authority by indenture
     9  of Robert W. Blanchette et al., Trustees of the Property of Penn
    10  Central Transportation Company, dated September 30, 1976, and
    11  being bounded on the northwest by property conveyed or devised
    12  to the United States of America by indenture of The Pennsylvania
    13  Railroad Company, dated September 15, 1965.
    14     (3)  All that tract, piece or parcel of land with the
    15  improvements erected thereon, situate, lying and being in the
    16  Township of Lower Swatara, County of Dauphin, Commonwealth of
    17  Pennsylvania, bounded and described as follows:
    18     Beginning at a point, said point being a corner common to the
    19  land of the Olmsted Air Force Base and land, now or formerly, of
    20  the Jednota Orphanage, on the northerly right-of-way line of the
    21  Pennsylvania Railroad, said point being further located north 43
    22  degrees 51 minutes east 242.64 feet or at the northeasterly
    23  extremity of reference line A-C, said point being at the
    24  southwesterly corner of the tract about to be described; thence,
    25  with the land of the said orphanage the following bearings and
    26  distances: north 19 degrees 10 minutes east 630.30 feet; north
    27  11 degrees 6 minutes east 146.85 feet; north 11 degrees 9
    28  minutes west 206.25 feet, and north 11 degrees 51 minutes east
    29  297 feet, more or less, to the center line of Township Road 382;
    30  thence continuing along the center line of Township Road 382,

     1  south 76 degrees 21 minutes east 224.68 feet, more or less, to a
     2  point, which point is also south of certain lands conveyed to
     3  the Pennsylvania State University by deed dated May 12, 1966;
     4  thence continuing along the center line of Township Road 382,
     5  south 41 degrees 46 minutes east 198.60 feet, more or less, to a
     6  point; thence continuing along the center line of Township Road
     7  382 south 39 degrees 54 minutes east 797.19 feet; thence
     8  continuing along the center line of said road south 65 degrees
     9  33 minutes east 583.34 feet to a point; thence south 26 degrees
    10  30 minutes west 453.85 feet to a point; thence with the Rosedale
    11  Plan of Lots north 38 degrees 24 minutes west 84.25 feet; thence
    12  by a curve to the right having a radius of 400 feet subtended by
    13  the cord north 38 degrees 24 minutes west 103 feet to a point;
    14  thence with the same north 53 degrees 9 minutes west 104.45 feet
    15  to a point; thence south 18 degrees 40 minutes west 70.45 feet
    16  to a point on the northeasterly line of the Old Pennsylvania
    17  Canal; thence with the line of said canal the two following
    18  courses: south 39 degrees 35 minutes east 12 feet and south 42
    19  degrees 25 minutes east 138 feet to a point on the northeasterly
    20  right-of-way line of State Route 230; thence with the said
    21  highway the following bearings and distances; north 83 degrees
    22  25 minutes west 108.85 feet; north 80 degrees 25 minutes west
    23  372.90 feet; north 79 degrees 10 minutes west 676.50 feet; north
    24  78 degrees 20 minutes west 209.55 feet to the place of
    25  beginning.
    26     Containing 29 acres, more or less, and being Tracts 22, 23,
    27  24, 25, 26 and 27 acquired by the Government for the Olmsted Air
    28  Force Base.
    29     (4)  All that tract, piece or parcel of land with the
    30  improvements erected thereon, situate, lying and being in the

     3     Beginning at an iron pin, said iron pin being on the south
     4  right-of-way line of the Pennsylvania Railroad Company, said
     5  point also being the most westerly of this parcel; thence along
     6  the said R.R.R./W.L. the following 23 courses: south 64 degrees
     7  46 minutes 15 seconds east 405 feet to an iron pin; thence south
     8  26 degrees 43 minutes 15 seconds west 36 feet to an iron pin;
     9  thence south 64 degrees 46 minutes 15 seconds east 553.40 feet
    10  to an iron pin; thence along a curve to the left south 71

    13     Containing 643.16 acres.
    14     (5)  All those tracts, pieces or parcels of land, situate in
    15  Fairview Township, York County, Pennsylvania, bounded and
    16  described as follows:
    17     Beginning at an iron pin in the center line of the concrete
    18  roadway of Lewisberry Road, at the intersection of said line
    19  with the easterly line of York Road; thence along the center
    20  line of said concrete roadway of the Lewisberry Road north 55
    21  degrees 13 minutes east 200 feet to an iron pin; thence along
    22  lands now or formerly of John E. Myers south 34 degrees 47
    23  minutes east 331.1 feet to a point; thence along said lands now
    24  or formerly of John E. Myers south 55 degrees 13 minutes west
    25  119.91 feet to a point; thence by lands of same south 59 degrees
    26  8 minutes west 80.25 feet to a point on the easterly line of
    27  York Road; thence along the easterly line of York Road north 34
    28  degrees 47 minutes west 325.6 feet to a point, the place of
    29  beginning.
    30     Being the same premises which Fred A. Gettys & Associate,

     1  Inc., successor by merger to Johansen & Dugan, Inc., by its deed
     2  dated April 4, 1991, and recorded in the York County Recorder's
     3  Office in Deed Book 146, at page 1073, conveyed to Stephen R. &
     4  Krista Y. Johansen, his wife.
     5     (6)  All those certain three tracts, pieces or parcels of
     6  land, situate in Fairview Township, York County, Pennsylvania,
     7  bounded and described as follows:
     8                            Tract No. 1
     9     Beginning at a point in the center of the concrete highway at
    10  the corner of the land herein conveyed and that of E. E. Flurrie
    11  and other land of the grantors; thence along the line of land of
    12  said E. E. Flurrie south 87 degrees 30 minutes east 195.6 feet
    13  to a stone; thence continuing along the land of said E. E.
    14  Flurrie north 2 degrees 30 minutes east 245 feet to a stone at
    15  the corner of land herein conveyed and that of E. E. Flurrie and
    16  Baron Von Bestecki; thence along the land of said Bestecki south
    17  87 degrees 30 minutes east 1155.5 feet to a post at the corner
    18  of the land herein conveyed and that of C. Garver; thence along

    19  thence south 75 degrees east 30 perches to a post; thence north
    20  15.25 degrees east along lands of Jacob Haldeman heirs 253.3
    21  perches to a point in the center of turnpike; thence south 88.25
    22  degrees west 14 perches to a point in the center of turnpike;
    23  thence north 73.75 degrees west 16.8 perches to a point in the
    24  center of the pike; thence south 17 degrees west 1.2 perches to
    25  a post; thence north 77.25 degrees west 13.8 perches to a post;

     7  perches, more or less, which exception was conveyed to the Mt.
     8  Olivet Cemetery Association by Annie Baughman by deed dated June
     9  11, 1908, and recorded June 19, 1908 in York County Deed Book
    10  Vol. 16-B, page 690.
    11     ALSO EXCEPTING that parcel of land containing five (5) acres
    12  and forty (40) perches, which exception was conveyed by the
    13  Capital Landing Field Company, by Deed dated March 20, 1930, to
    14  the Mt. Olivet Cemetery Association, recorded December 19, 1935,
    15  in Deed Book Vol. 26-I, Page 133.
    16     BEING the major portion of that tract of land which, by Deed
    17  dated May 29, 1929, and recorded in Deed Book Vol. 24-K, Page
    18  689, was conveyed by Florence E. Huber to the Capital Landing
    19  Field Company.
    20                            Tract No. 3.
    21     BEGINNING at a post on the line of the town of New Market;
    22  thence by land formerly of Christian Garver south fourteen and
    23  one-half (14 1/2) degrees west ninety (90) feet to a post;
    24  thence by the same north seventy-four and a half (74 1/2)
    25  degrees west sixty-five (65) feet to land of the late Robert J.
    26  Ross, deceased; thence by the same north fourteen and one-half
    27  (14 1/2) degrees east ninety (90) feet to a post on the line of
    28  the town of New Market; and thence by the town south seventy-
    29  four and one-half (74 1/2) degrees east sixty-five (65) feet to
    30  the place of BEGINNING. CONTAINING twenty-two (22) perches.

     1     BEING the same tract of land which, by Deed dated October 31,
     2  1929, and recorded in Deed Book Vol. 24-N, Page 664, was
     3  conveyed by Jacob F. Kreiger and wife to the CAPITAL LANDING
     4  FIELD COMPANY.
     5  SECTION 5.  EASEMENTS, ETC.                                       <--
     6     THE CONVEYANCE SHALL BE MADE UNDER AND SUBJECT TO ALL
     7  EASEMENTS AND RIGHTS OF OTHERS, INCLUDING, BUT NOT CONFINED TO,
     8  STREETS, ROADWAYS AND RIGHTS OF ANY TELEPHONE, TELEGRAPH, WATER,
     9  ELECTRIC, SEWER, GAS OR PIPELINE COMPANIES, AND UNDER AND
    10  SUBJECT TO ANY INTERESTS, ESTATES OR TENANCIES VESTED IN THIRD
    11  PERSONS, WHETHER OR NOT APPEARING OF RECORD, WITH RESPECT TO ANY
    12  PORTION OF THE LAND OR IMPROVEMENTS ERECTED THEREON.
    13  Section 5 6.  Indemnification.                                    <--
    14     (a)  By department.--The department is authorized to
    15  indemnify, defend, save and hold harmless the authority, its
    16  members, officers, agents, tenants, consultants,
    17  representatives, licensees, invitees and successors and assigns
    18  for damages, claims, liabilities, losses, costs and expenses by
    19  reason or arising out of:
    20         (1)  Any act or negligence or violation by the department
    21     of any Federal, State or local law, statute, ordinance, rule
    22     or regulation with respect to hazardous substances used,
    23     located, spilled or disposed of on or at the airports or
    24     other real property subject to the conveyance during the
    25     department's ownership.
    26         (2)  Actions taken by the department prior to the date of
    27     the conveyance pursuant to or in breach of any contract,
    28     provided that the department does not waive the jurisdiction
    29     of the Board of Claims as to certain matters or its rights to
    30     sovereign immunity with regard to claims by third parties

     1     against the department or the authority.
     2     (b)  By authority.--The authority shall indemnify, defend,
     3  save and hold harmless the department and its officials and
     4  employees for any damages, claims, liabilities, losses, costs
     5  and expenses by reason or arising out of:
     6         (1)  Any act or negligence or violation by the authority
     7     of any Federal, state or local law, statute, ordinance, rule
     8     or regulation or agreement with any environmental agency or
     9     authority with respect to hazardous substances used, located,
    10     spilled or disposed of on or at the airports or other real
    11     property subject to the conveyance.
    12         (2)  Actions allegedly taken by the authority subsequent
    13     to the conveyance pursuant to or in breach of any contract
    14     provided that the authority does not waive its rights to
    15     sovereign immunity with regard to claims by third parties
    16     against the authority or the department.
    17  Section 6 7.  Payment to authority; appropriation.                <--
    18     The department is authorized to pay to the authority, in
    19  accordance with the terms of a divestiture agreement entered
    20  into under this act, up to $8,994,000 from the Aviation
    21  Restricted Revenue Account in the Motor License Fund for the
    22  continuing operation of the airports. Such funds as are
    23  necessary, up to this amount, are hereby appropriated to the
    24  department for fiscal year July 1, 1997, to June 30, 1998, for
    25  the purpose of making the payment.
    26  SECTION 8.  COSTS AND FEES.                                       <--
    27     COSTS AND FEES INCIDENTAL TO THIS CONVEYANCE SHALL BE BORNE
    28  BY THE AUTHORITY.
    29  Section 7 9.  Effective date.                                     <--
    30     This act shall take effect immediately.
