SENATE BILL

No. 1011 Session of 1997

        REFERRED TO STATE GOVERNMENT, JUNE 11, 1997

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to sell and convey to Upper
     3     Skippack Mennonite Church, certain improved land situate in
     4     the Township of Skippack, County of Montgomery, Commonwealth
     5     of Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Conveyance authorization.
     9     The Department of General Services, with the approval of the
    10  Governor, is hereby authorized and directed on behalf of the
    11  Commonwealth of Pennsylvania to grant, sell and convey to Upper
    12  Skippack Mennonite Church, for consideration of $1, the tract of
    13  land described in section 2.
    14  Section 2.  Property description.
    15     The property to be conveyed pursuant to section 1 is the
    16  following tract of land, bounded and described as follows:
    17     All that certain tract of land situate in the Township of
    18  Skippack, County of Montgomery, Commonwealth of Pennsylvania as
    19  shown on a Plan of Survey prepared for Upper Skippack Mennonite

     1  Church by Urwiler & Walter, Inc., dated November 30, 1994,
     2  bounded and described as follows to wit:
     3     Beginning at a point on the center line of Cressman Road,
     4  said point being a common property corner of lands now or late
     5  of Upper Skippack Mennonite Church and lands of the Commonwealth
     6  of Pennsylvania; thence from said point of beginning extending
     7  along the common property line of lands of Upper Skippack
     8  Mennonite Church and lands of the Commonwealth of Pennsylvania
     9  the following three courses and distances: (1) north 44 degrees
    10  42 minutes 30 seconds west 201.99 feet to a point, a corner; (2)
    11  south 52 degrees 32 minutes 50 seconds west 619.09 feet to a
    12  point, a corner; (3) south 37 degrees 27 minutes 10 seconds east
    13  227.75 feet to a point on the center line of Cressman Road, a
    14  corner; thence from said point extending along the center line
    15  of Cressman Road the following two courses and distances: (1)
    16  south 49 degrees 13 minutes 33 seconds west 234.16 feet to a
    17  point, a corner; (2) south 45 degrees 53 minutes 33 seconds west
    18  222.85 feet to a point, a corner; thence from said point
    19  extending through lands of the Commonwealth of Pennsylvania the
    20  following three courses and distances: (1) north 4 degrees 8
    21  minutes 4 seconds west 772.59 feet to a point, a corner; (2)
    22  north 46 degrees 11 minutes 42 seconds east 806.10 feet to a
    23  point, a corner; (3) south 43 degrees 48 minutes 18 seconds east
    24  650 feet to a point on the center line of Cressman Road, a
    25  corner; thence from said point extending along the center line
    26  of Cressman Road south 46 degrees 11 minutes 42 seconds west
    27  198.94 feet to the point and place of beginning.
    28     Containing 12.03 acres of land more or less.
    29  Section 3.  Easements, etc.
    30     The conveyance shall be made under and subject to all

     1  easements, servitudes and rights of others, including, but not
     2  confined to, streets, roadways and rights of any telephone,
     3  telegraph, water, electric, sewer, gas or pipeline companies, as
     4  well as under and subject to any interest, estates or tenancies
     5  vested in third persons, whether or not appearing of record, for
     6  any portion of the land or improvements erected thereon.
     7  Section 4.  Deposit of proceeds.
     8     The proceeds of this sale shall be paid into the State
     9  Treasury and deposited in the General Fund.
    10  Section 5.  Approval and execution of deed.
    11     The deed of conveyance shall be approved as provided by law
    12  and shall be executed by the Secretary of General Services in
    13  the name of the Commonwealth of Pennsylvania.
    14  Section 6.  Costs and fees.
    15     Costs and fees incidental to the conveyance shall be borne by
    16  the grantee.
    17  Section 7.  Effective date.
    18     This act shall take effect immediately.
