                                     AN ACT

     1  Requiring containers for collecting glass and aluminum in public
     2     areas and places; and imposing a penalty.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Recycling
     7  Container Availability Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Public area."  A place open to the public, including, but
    13  not limited to, a park, zoo, recreation area and shopping mall
    14  or complex.
    15     "Public building."  A structure open to the public,
    16  including, but not limited to, State and municipal buildings,
    17  hotels, restaurants, grocery stores, department stores, banks,


     1  hospitals and public stadia.
     2  Section 3.  Containers for glass and aluminum.
     3     In all public areas and public buildings where a receptacle
     4  for trash is maintained for users of the public area or public
     5  building, the owner or operator of the public area or public
     6  building shall maintain in close proximity to the trash
     7  receptacle a container for collecting glass and a container for
     8  collecting aluminum.
     9  Section 4.  Penalty.
    10     An owner or operator of a public area or public building who
    11  fails to comply with section 3 commits a summary offense and
    12  shall, upon conviction, be sentenced to pay a fine of $25.
    13  Section 5.  Implementation.
    14     The provisions of this act shall be implemented within one
    15  year of the effective date of this act.
    16  Section 6.  Effective date.
    17     This act shall take effect in 60 days.
