SENATE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for the
     3     disposition of a delinquent child for an offense involving a
     4     motor vehicle.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6352 of Title 42 of the Pennsylvania
     8  Consolidated Statutes is amended by adding a subsection to read:
     9  § 6352.  Disposition of delinquent child.

    11     (c)  Delinquent act involving motor vehicle.--Instead of or
    12  in addition to a disposition made under this section, the court
    13  may suspend the driving privileges of a delinquent child for a
    14  period not to exceed two years, when, while committing an act
    15  for which the child was adjudicated delinquent or during flight
    16  therefrom, a motor vehicle was used. In making this disposition
    17  and in deciding the duration of the suspension, the court shall
    18  consider the severity of the delinquent act and the potential


     1  effect of the loss of driving privileges on the child's ability
     2  to be rehabilitated. Any suspension may be imposed consecutively
     3  with any custodial commitment, but the postponement or
     4  suspension shall not extend beyond two years from the date the
     5  commitment is imposed. Notice of the suspension shall be
     6  transmitted immediately to the Department of Transportation.
     7     Section 2.  This act shall take effect immediately.
