AN ACT
1 Amending the act of December 19, 1990 (P.L.1200, No.202),
2 entitled "An act providing for the registration and
3 regulation of solicitations by charitable organizations,
4 professional fundraisers and other solicitors; imposing
5 additional powers on the Department of State and the Office
6 of Attorney General; prescribing civil and criminal
7 penalties; and making a repeal," further providing for
8 prohibited acts.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. Section 15(a) of the act of December 19, 1990
12 (P.L.1200, No.202), known as the Solicitation of Funds for
13 Charitable Purposes Act, is amended by adding paragraphs to
14 read:
15 Section 15. Prohibited acts.
16 (a) General rule.--Regardless of a person's intent or the
17 lack of injury, the following acts and practices are prohibited
18 in the planning, conduct or execution of any solicitation or
19 charitable sales promotion:

1 (14) Giving, selling, trading, providing or otherwise
2 transferring to another charitable organization, to a
3 commercial coventurer or to any other person or entity,
4 whether in exchange for valuable consideration or otherwise,
5 the names, addresses or telephone numbers of contributors.
6 (15) Accepting from a charitable organization, from a
7 commercial coventurer or from any other person or entity,
8 whether in exchange for valuable consideration or otherwise,
9 the names, addresses or telephone numbers of contributors.

11 Section 2. This act shall take effect in 60 days.
