                                     AN ACT

     1  Amending the act of March 11, 1971 (P.L.104, No.3), entitled, as
     2     amended, "An act providing property tax or rent rebate and
     3     inflation dividends to certain senior citizens, widows,
     4     widowers and permanently disabled persons with limited
     5     incomes; establishing uniform standards and qualifications
     6     for eligibility to receive rebates and dividends; providing
     7     for transportation assistance grants and grants to area
     8     agencies on aging for services to older persons; and imposing
     9     duties upon the Department of Revenue," providing for
    10     payments to personal care homes.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 3 of the act of March 11, 1971 (P.L.104,
    14  No.3), known as the Senior Citizens Rebate and Assistance Act,
    15  reenacted and amended December 21, 1979 (P.L.570, No.131), is
    16  amended by adding clauses to read:
    17     Section 3.  Definitions.--As used in this act:

    19     (10)  "Personal care home" means an institution or facility
    20  which offers room and board, and may also offer personal


     1  services and nursing and medical care and other health services,
     2  for a period exceeding twenty-four hours for two or more
     3  individuals who are not relatives of the administrator and who
     4  are not acutely ill and not in need of hospitalization, but who,
     5  because of age, illness, disease, injury, convalescence or
     6  physical or medical infirmity, require such care.
     7     (11)  "Private pay resident" means a resident of a personal
     8  care home whose fees are paid to the personal care home by
     9  private sources, including social security benefits.
    10     (12)  "Nonprivate pay resident" means a resident of a
    11  personal care home whose fees are paid to the personal care home
    12  by or as a result of Federal or State public assistance.
    13     Section 2.  The act is amended by adding a section to read:
    14     Section 11.5.  Payments to Personal Care Homes.--(a)  A
    15  personal care home may not seek or accept more than the maximum
    16  amount allowable under Federal law of a payment made to a
    17  nonprivate pay resident under this act.
    18     (b)  A personal care home may not seek or accept any amount
    19  of a payment made to a private pay resident under this act.
    20     Section 3.  This act shall take effect in 60 days.
