           AMENDED, NOVEMBER 9, 1998

                                     AN ACT

     1  Making an appropriation to the Pennsylvania College TEMPLE        <--
     2     UNIVERSITY FOR THE TEMPLE UNIVERSITY SCHOOL of Podiatric
     3     Medicine, Philadelphia.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The sum of $1,275,000 is hereby appropriated to
     7  the Pennsylvania College TEMPLE UNIVERSITY FOR THE TEMPLE         <--
     8  UNIVERSITY SCHOOL of Podiatric Medicine, Philadelphia, for the
     9  fiscal year July 1, 1998, to June 30, 1999, for instruction in
    10  the Doctor of Podiatric Medicine program.
    11     Section 2.  Payments to the Pennsylvania College of Podiatric  <--
    12  Medicine on account of the appropriation provided in section 1
    13  shall be made quarterly by the Secretary of Education on the
    14  basis of costs during the fiscal year. The secretary shall not
    15  release more than the first quarterly payment until such time as
    16  the Trustees of the Pennsylvania College of Podiatric Medicine
    17  agree in writing to include a minimum of five members appointed

     1  by the Governor and the General Assembly. The Governor, the
     2  President pro tempore of the Senate, the Minority Leader of the
     3  Senate, the Speaker of the House of Representatives and the
     4  Minority Leader of the House of Representatives may each, upon
     5  receipt of the written agreement from the trustees, appoint a
     6  nonelected official to serve as a member of the board and the
     7  terms of office shall be coterminous with that of their
     8  appointing authority.
     9     Section 3.  The Pennsylvania College of Podiatric Medicine
    10  shall provide full, complete and accurate information as may be
    11  required by the Department of Education or the chairman or the
    12  minority chairman of the Appropriations Committee of the Senate
    13  or the chairman or the minority chairman of the Appropriations
    14  Committee of the House of Representatives.
    15     Section 4.  The Pennsylvania College of Podiatric Medicine
    16  shall report its revenues and expenditures and present its
    17  financial statements in accordance with generally accepted
    18  accounting principles and procedures for educational
    19  institutions as set forth in the "Higher Education Finance
    20  Manual (1975)" and the "Commonwealth of Pennsylvania Budget
    21  Instructions for the State System of Higher Education, State-
    22  Related Universities and Non-State-Related Colleges and
    23  Universities."
    24     Section 5.  The Trustees of the Pennsylvania College of
    25  Podiatric Medicine shall report on forms provided by the
    26  Department of Education to both the chairman and minority
    27  chairman of the Appropriations Committee of the Senate and the
    28  chairman and minority chairman of the Appropriations Committee
    29  of the House of Representatives by September 30, 1999, on how
    30  State-appropriated funds were expended for fiscal year 1998-1999

     1  to reduce the costs to Pennsylvania resident students or to
     2  provide services to Pennsylvania residents.
     3     Section 6.  This act shall take effect July 1, 1998, or
     4  immediately, whichever is later.
     5     SECTION 2.  PAYMENTS MADE TO TEMPLE UNIVERSITY FOR THE TEMPLE  <--
     6  UNIVERSITY SCHOOL OF PODIATRIC MEDICINE ON ACCOUNT OF THE
     7  APPROPRIATION MADE IN SECTION 1 SHALL BE MADE PURSUANT TO AND
     8  SUBJECT TO THE PROVISIONS OF SECTIONS 2, 4, 5, 6, 7, 8, 9 AND 10
     9  OF THE ACT OF APRIL 29, 1998 (P.L.    , NO.8A), ENTITLED "A
    10  SUPPLEMENT TO THE ACT OF NOVEMBER 30, 1965 (P.L.843, NO.355),
    11  ENTITLED 'AN ACT PROVIDING FOR THE ESTABLISHMENT AND OPERATION
    12  OF TEMPLE UNIVERSITY AS AN INSTRUMENTALITY OF THE COMMONWEALTH
    13  TO SERVE AS A STATE-RELATED UNIVERSITY IN THE HIGHER EDUCATION
    14  SYSTEM OF THE COMMONWEALTH; PROVIDING FOR CHANGE OF NAME;
    15  PROVIDING FOR THE COMPOSITION OF THE BOARD OF TRUSTEES; TERMS OF
    16  TRUSTEES, AND THE POWER AND DUTIES OF SUCH TRUSTEES; PROVIDING
    17  FOR PREFERENCE TO PENNSYLVANIA RESIDENTS IN TUITION; PROVIDING
    18  FOR PUBLIC SUPPORT AND CAPITAL IMPROVEMENTS; AUTHORIZING
    19  APPROPRIATIONS IN AMOUNTS TO BE FIXED ANNUALLY BY THE GENERAL
    20  ASSEMBLY; PROVIDING FOR THE AUDITING OF ACCOUNTS OF EXPENDITURES
    21  FROM SAID APPROPRIATIONS; AUTHORIZING THE ISSUANCE OF BONDS
    22  EXEMPT FROM TAXATION WITHIN THE COMMONWEALTH; REQUIRING THE
    23  PRESIDENT TO MAKE AN ANNUAL REPORT OF THE OPERATIONS OF TEMPLE
    24  UNIVERSITY,' MAKING APPROPRIATIONS FOR CARRYING THE SAME INTO
    25  EFFECT; PROVIDING FOR A BASIS FOR PAYMENTS OF SUCH
    26  APPROPRIATIONS; AND PROVIDING A METHOD OF ACCOUNTING FOR THE
    27  FUNDS APPROPRIATED AND FOR CERTAIN FISCAL INFORMATION
    28  DISCLOSURE."
    29     SECTION 3.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
