We, the undersigned, Committee of Conference on the part of the House of Representatives and Senate for the purpose of considering House Bill No. 2281, entitled: "An act to provide from the General Fund for the expenses of the Executive, Legislative and Judicial Departments of the Commonwealth, the public debt and for the public schools for the fiscal year July 1, 1998, to June 30, 1999, * * *; to provide appropriations from the Motor License Fund for the fiscal year July 1, 1998, to June 30, 1999, * * *; to provide for the appropriation of Federal funds to the Executive and Judicial Departments of the Commonwealth and for the establishment of restricted receipt accounts for the fiscal year July 1, 1998, to June 30, 1999, and for the payment of bills remaining unpaid at the close of the fiscal year ending June 30, 1998," respectfully submit the following bill as our report: JOHN M. AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1998, to June 30, 1999, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1998; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Ownership Fund to the 14 Executive Department; to provide appropriations from the 15 Judicial Computer System Augmentation Account to the Judicial 16 Department; to provide appropriations from the Motor License 17 Fund for the fiscal year July 1, 1998, to June 30, 1999, for 18 the proper operation of the several departments of the 19 Commonwealth and the Pennsylvania State Police authorized to 20 spend Motor License Fund moneys; to provide for the 21 appropriation of Federal funds to the Executive and Judicial 22 Departments of the Commonwealth and for the establishment of 23 restricted receipt accounts for the fiscal year July 1, 1998, 24 to June 30, 1999, and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 1998; 26 and to provide for the additional appropriation of Federal 27 and State funds for the Executive Department of the 28 Commonwealth for the fiscal year July 1, 1997, to June 30, 29 1998, and for the payment of bills incurred and remaining 30 unpaid at the close of the fiscal year ending June 30, 1997. 31 TABLE OF CONTENTS 32 PART I. 1 hereby enacts as follows: 2 PART I 3 GENERAL PROVISIONS 4 Section 101. Short title.--This act shall be known and may 5 be cited as the General Appropriation Act of 1998. 6 Section 102. Definitions.--The following words and phrases 7 when used in this act shall have the meanings given to them in 8 this section unless the context clearly indicates otherwise: 9 "Employees." Includes all directors, superintendents, bureau 10 or division chiefs, assistant directors, assistant 11 superintendents, assistant chiefs, experts, scientists, 12 engineers, surveyors, draftsmen, accountants, secretaries, 13 auditors, inspectors, examiners, analysts, statisticians, 14 marshals, clerks, stenographers, bookkeepers, messengers and 15 other assistants in any department, board or commission. 16 "Expenses" and "maintenance." Includes all printing, binding 17 and stationery, food and forage, materials and supplies, 18 traveling expenses, training, motor vehicle supplies and 19 repairs, freight, express and cartage, postage, telephones and 20 telegraph rentals and toll charges, newspaper advertising and 21 notices, public advertising by or through any medium, fuel, 22 light, heat, power and water, minor construction and renovation, 23 repairs or reconstruction of equipment, buildings and 24 facilities, rent of real estate and equipment, premiums on 25 workers' compensation, insurance premiums on policies of 26 liability insurance, insurance premiums on medical payment 27 insurance and surety bonds for volunteer workers, premiums on 28 employee group life insurance and employee and retired employee 29 group hospital and medical insurance, payment of Commonwealth 30 share of Social Security taxes and unemployment compensation 19980H2281B3395 - 10 -
1 costs for State employees, the purchase of replacement or 2 additional equipment and machinery and all other incidental 3 costs and expenses, including payment to the Department of 4 General Services of mileage and other charges for the use of 5 automobiles and rental payments for permanently assigned 6 automobiles and of expenses or costs of services incurred 7 through the Purchasing Fund. The term "expenses" also shall 8 include the medical costs for the treatment of inmates of State 9 institutions when the inmate must be transferred to an outside 10 hospital: Provided, That in no case shall the State institution 11 pay more for patient care than that provided under the State 12 medical assistance program. 13 Section 103. Abbreviations.--The following abbreviations 14 when used in this act shall have the meanings given to them in 15 this section unless the context clearly indicates otherwise: 16 "ADA." 1 Executive, Legislative and Judicial Departments of the 2 Commonwealth for the payment of salaries, wages or other 3 compensation and travel expenses of the duly elected or 4 appointed officers and employees of the Commonwealth, for the 5 payment of fees for contractual services rendered, for the 6 purchase or rental of goods and services, printing, public 7 advertising by or through any medium, equipment, land and 8 buildings and for payment of any other expenses, as provided by 9 law or by this act, necessary for the proper conduct of the 10 duties, functions and activities and for the purposes 11 hereinafter set forth for the fiscal year beginning July 1, 12 1998, and for the payment of bills incurred and remaining unpaid 13 at the close of the fiscal year ending June 30, 1998. 14 (b) State Lottery Fund.--The following sums set forth in 15 this act, or as much thereof as may be necessary, are hereby 16 specifically appropriated from the State Lottery Fund to the 17 several hereinafter named agencies of the Executive Department 18 of the Commonwealth for the payment of salaries, wages or other 19 compensation and travel expenses of the duly appointed officers 20 and employees of the Commonwealth, for the payment of fees for 21 contractual services rendered, for the purchase or rental of 22 goods and services and for payment of any other expenses, as 23 provided by law or by this act, necessary for the proper conduct 24 of the duties, functions and activities and for the purposes 25 hereinafter set forth for the fiscal year beginning July 1, 26 1998, and for the payment of bills incurred and remaining unpaid 27 at the close of the fiscal year ending June 30, 1998. 28 (c) Energy Conservation and Assistance Fund.--The following 29 sums set forth in this act, or as much thereof as may be 30 necessary, are hereby specifically appropriated from the Energy 19980H2281B3395 - 13 -
1 Conservation and Assistance Fund to the several hereinafter 2 named agencies of the Executive Department of the Commonwealth 3 for the payment of fees for contractual services rendered, for 4 the purchase or rental of goods and services and for the payment 5 of any other expenses, as provided by law or by this act, 6 necessary for the proper conduct of the duties, functions and 7 activities and for the purposes hereinafter set forth for the 8 fiscal year beginning July 1, 1998, and for the payment of bills 9 incurred and remaining unpaid at the close of the fiscal year 10 ending June 30, 1998. 11 (d) Judicial Computer System Augmentation Account.--The 12 following sums set forth in this act, or as much thereof as may 13 be necessary, are hereby specifically appropriated from the 14 restricted receipt account established within the General Fund, 15 known as the Judicial Computer System Augmentation Account, to 16 the Judicial Department of the Commonwealth for the payment of 17 salaries, wages or other compensation and travel expenses, for 18 the payment of fees for contractual services rendered, for the 19 purchase or rental of goods and services and for the payment of 20 any other expenses, as provided by law or by this act, necessary 21 for the proper conduct of the duties, functions and activities 22 and for the purposes hereinafter set forth for the fiscal year 23 beginning July 1, 1998, and for the payment of bills incurred 24 and remaining unpaid at the close of the fiscal year ending June 25 30, 1998. 26 (e) Emergency Medical Services Operating Fund.--The 27 following sums set forth in this act, or as much thereof as may 28 be necessary, are hereby specifically appropriated from the 29 Emergency Medical Services Operating Fund to the several 30 hereinafter named agencies of the Executive Department of the 19980H2281B3395 - 14 -
1 Commonwealth for the payment of fees for contractual services 2 rendered, for the purchase or rental of goods and services and 3 for the payment of any other expenses, as provided by law or by 4 this act, necessary for the proper conduct of the duties, 5 functions and activities and for the purposes hereinafter set 6 forth for the fiscal year beginning July 1, 1998, and for the 7 payment of bills incurred and remaining unpaid at the close of 8 the fiscal year ending June 30, 1998. 9 (f) The State Stores Fund.--The following sums set forth in 10 this act, or as much thereof as may be necessary, are hereby 11 specifically appropriated from The State Stores Fund to the 12 hereinafter named agency of the Executive Department of the 13 Commonwealth for the payment of salaries, wages or other 14 compensation and travel expenses of the duly appointed officers 15 and employees of the Commonwealth, for the payment of fees for 16 contractual services rendered, for the purchase or rental of 17 goods and services and for the payment of any other expenses, as 18 provided by law or by this act, necessary for the proper conduct 19 of the duties, functions and activities and for the purposes 20 hereinafter set forth for the fiscal year beginning July 1, 21 1998, and for the payment of bills incurred and remaining unpaid 22 at the close of the fiscal year ending June 30, 1998. 23 (g) Motor License Fund.--The following sums, or as much 24 thereof as may be necessary, are hereby appropriated from the 25 Motor License Fund to the hereinafter named agencies of the 26 Executive Department for the payment of salaries, wages and 27 other compensation and travel expenses of the duly elected or 28 appointed officers and employees of the Commonwealth, for 29 contractual services and other expenses necessary for the proper 30 conduct of the duties, functions and activities for the purposes 19980H2281B3395 - 15 -
1 hereinafter set forth for the fiscal year beginning July 1, 2 1998, and for the payment of bills incurred and remaining unpaid 3 at the close of the fiscal year ending June 30, 1998. 4 (h) Aviation Restricted Revenue Account.--The following 5 sums, or as much thereof as may be necessary, are hereby 6 appropriated from the Aviation Restricted Revenue Account in the 7 Motor License Fund to the hereinafter named agencies of the 8 Executive Department for the purposes set forth herein for the 9 fiscal year beginning July 1, 1998, and for the payment of bills 10 incurred and remaining unpaid at the close of the fiscal year 11 ending June 30, 1998. 12 (i) Hazardous Material Response Fund.--The following sums 13 set forth in this act, or as much thereof as may be necessary, 14 are hereby specifically appropriated from the Hazardous Material 15 Response Fund to the several hereinafter named agencies of the 16 Executive Department of the Commonwealth for the payment of fees 17 for contractual services rendered, for the purchase or rental of 18 goods and services and for the payment of any other expenses, as 19 provided by law or by this act, necessary for the proper conduct 20 of the duties, functions and activities and for the purposes 21 hereinafter set forth for the fiscal year beginning July 1, 22 1998, and for the payment of bills incurred and remaining unpaid 23 at the close of the fiscal year ending June 30, 1998. 24 (j) Milk Marketing Fund.--The following sums set forth in 25 this act, or as much thereof as may be necessary, are hereby 26 specifically appropriated from the Milk Marketing Fund to the 27 several hereinafter named agencies of the Executive Department 28 of the Commonwealth for the payment of salaries, wages or other 29 compensation and travel expenses of the duly appointed officers 30 and employees of the Commonwealth, for the payment of fees for 19980H2281B3395 - 16 -

1 addition, new focus may be placed on the unemployed, both old 2 and new. Local agencies may lower their eligibility requirements 3 for recipients to three months to allow greater flexibility to 4 assure proper consideration of each recipient. 5 (d) Preventive Health and Health Services Block Grant.--The 6 Preventive Health and Health Services Block Grant (PHHSBG) is 7 for the provision of preventive health and other health services 8 related to emergency medical systems, health initiative grants, 9 comprehensive public health, hypertension, fluoridation, health 10 education, risk reduction, home health, rape crisis, domestic 11 violence services and rodent control. 12 (e) Maternal and Child Health Services Block Grant.--The 13 Maternal and Child Health Services Block Grant (MCHSBG) is to 14 enable states to maintain and strengthen their leadership in 15 planning, promoting, coordinating and evaluating health care for 16 pregnant women, mothers, infants and children, and children with 17 special health care needs, and in providing health services for 18 mothers and children who do not have access to adequate health 19 care. 20 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 21 Income Home Energy Assistance Block Grant (LIHEABG) is to help 22 lessen the impact of the high cost of energy on low-income 23 families and individuals, including energy efficiency grants for 24 low-income dwellings. No less than 15% of the LIHEABG funds 25 received shall be used for weatherization. LIHEABG funds 26 received pursuant to a Presidential release of weather-related 27 contingency funds shall be exempt from the 15% requirement if 28 the weather emergency has an impact in Pennsylvania. Prior laws unaffected.--This act is not 9 intended to be inconsistent with or to repeal any provision of 10 any act enacted at this or any prior session of the General 11 Assembly regulating the purchase of supplies, the ordering of 12 printing and binding, the purchase, maintenance and use of 13 automobiles, the method of making payments from the State 14 Treasury for any purpose or the functioning of any 15 administrative department, board or commission. 16 Section 1792. Compliance with other law before funds 17 available.--No appropriation made by this part to any 18 department, board, commission or agency of the Executive 19 Department shall be available unless and until the department, 20 board, commission or agency has complied with sections 615 and 21 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 22 Administrative Code of 1929. 23 Section 1793. Contracts prerequisite to encumbering or 24 committing funds.--Funds for the purchase of supplies, materials 25 and equipment shall not be deemed to be committed or encumbered 26 until contracts covering the purchase have been entered into 27 with the vendors. 28 Section 1794. Minority business set-asides.--(a) Each 29 department or other instrumentality of the Commonwealth listed 30 in Subparts B and C authorized to contract for buildings, 19980H2281B3395 - 209 -
1 highways, commodities, equipment, supplies or services shall 2 report to the General Assembly all information pertinent to 3 anticipated procurement needs at the beginning of each fiscal 4 year and each fiscal quarter thereafter. 5 (b) As used in this section, the term "minority business" 6 means a minority business enterprise as defined in the act of 7 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 8 Minority Business Development Authority Act. 9 Section 1795. Appropriation of funds from miscellaneous 10 sources.--(a) In addition to the amounts appropriated by this 11 part, moneys received in payment for food and household supplies 12 furnished to employees and other persons, except inmates, by an 13 institution, and moneys received from the proceeds from the sale 14 of any products of the soil, meats, livestock, timber or other 15 materials sold by the department shall be paid into the General 16 Fund and are hereby appropriated out of the General Fund to the 17 several respective institutions for the operation and 18 maintenance of the institutions. 19 (b) In addition to the amounts appropriated by this part, 20 all moneys received from any other source, except the Federal 21 Government, as contributions for the programs provided herein or 22 as payment for services or materials furnished by one 23 institution to another, except those collections designated as 24 revenues, shall be paid into the General Fund and are hereby 25 appropriated out of the General Fund for the purposes of the 26 respective appropriations. 27 (c) In addition to any funds specifically appropriated by 28 this part, all moneys received by a department or agency of the 29 Commonwealth from any other sources, except the Federal 30 Government, as contributions or supplements to the department or 19980H2281B3395 - 210 -
1 agency for a program or administration of an act included in 2 this part shall be paid into the General Fund and credited to 3 the appropriation for that program or administration of the act. 4 Section 1796. Lapsing of unused funds.--(a) Except as 5 otherwise provided by law or subsection (b), that part of all 6 appropriations in Part XVII unexpended, uncommitted or 7 unencumbered as of June 30, 1998, shall automatically lapse as 8 of that date. 9 (b) The appropriations in Subpart B to: 10 (1) The Department of Agriculture for avian influenza 11 shall be a two-year continuing appropriation. 12 (2) The Department of Transportation for supplemental 13 grants shall be a two-year continuing appropriation. 14 Section 1797. Construction with prior appropriation acts.-- 15 Any appropriation in Subparts B and C of this part which is the 16 same or similar to any appropriation in the act of May 6, 1997 17 (P.L. , No.4A), known as the General Appropriation Act of 18 1997, shall replace that appropriation. 19 Section 1798. Deduction of expended appropriations under 20 prior law.--Any money that has been appropriated and expended 21 under the act of May 6, 1997 (P.L. , No.4A), known as the 22 General Appropriation Act of 1997, shall be deducted from the 23 corresponding appropriation in this part. 24 PART XVIII 25 SPECIAL PROVISIONS FOR FEDERAL FUNDS 26 FOR 1998-1999 27 Section 1801. General Fund repository for Federal funds.-- 28 All moneys received from the Federal Government as contributions 29 or supplements to the departments or agencies of the 30 Commonwealth or the programs herein provided shall be paid into 19980H2281B3395 - 211 -
1 the General Fund. 2 Section 1802. Limitation on encumbering or spending Federal 3 funds.--Federal funds shall be encumbered or spent only to the 4 extent that such funds are estimated as being available during 5 the fiscal year of the Commonwealth. 6 Section 1803. Appropriation of prior unspent Federal 7 funds.--Any Federal money which has been previously appropriated 8 by the General Assembly and authorized or allocated by the 9 Federal Government but remains unspent from prior fiscal years 10 and will not be renewed for fiscal year 1998-1999 is hereby 11 appropriated. 12 Section 1804. Subgrants between Federal fund 13 appropriations.--With the exception of Federal money received 14 under JTPA and SSBG, subgrants may be made between 15 appropriations without further approval of the General Assembly. 16 The Secretary of the Budget shall submit a list of subgrants to 17 the Chairmen and minority chairmen of the House and Senate 18 Appropriations Committees quarterly. No subgrant to a State 19 agency, however, may be made from a restricted receipt account 20 without a specific appropriation by the General Assembly. 21 Section 1805. Utilization of emergency Federal funds.--(a) 22 Federal funds available for costs and damages resulting from 23 natural disasters or civil disobedience may be added to an 24 appropriation contained in this act or to funds appropriated or 25 may be used for the purposes prescribed by the Federal 26 Government. 27 (b) In addition to the moneys appropriated by this act, all 28 moneys received from the Federal Government for the purpose of 29 disaster assistance or relief shall be paid into the General 30 Fund and are hereby appropriated out of the General Fund to the 19980H2281B3395 - 212 -
1 departments, boards, commissions or agencies designated by the 2 Governor. 3 (c) In the event of any emergency situation in which the 4 General Assembly cannot act in sufficient time, the Governor is 5 authorized through executive authorization to provide up to 6 $10,000,000 in Federal funds to alleviate the emergency 7 situation. For the purposes of this section, "emergency" is 8 defined as any situation in which there is a chance of or which 9 may result in substantial human suffering. 10 Section 1806. Transfer of funds from TANFBG to CCDFBG and 11 SSBG.--In accordance with Federal law which permits the transfer 12 of funds from the TANFBG to the CCDFBG and SSBG in amounts that 13 do not exceed 30% in total and limits the transfer to SSBG to 14 not more than 10% of the 30%, the Department of Public Welfare, 15 upon approval of the Secretary of the Budget, may make such 16 transfers of funds provided that any such transfer will not 17 result in a deficit in any appropriation from which funds are 18 transferred. The Secretary of the Budget shall provide 19 notification of any such transfers to the majority chairman and 20 the minority chairman of the Appropriations Committee of the 21 Senate and the majority chairman and minority chairman of the 22 Appropriations Committee of the House of Representatives ten 23 days prior to any transfer which shall also include 24 certification that such transfer will not result in a deficit in 25 any appropriation. 26 PART XIX 27 MISCELLANEOUS PROVISIONS FOR 1998-1999 28 Section 1901. Lapsing of unused funds.--(a) Except as 26 otherwise provided by law or by this section, that part of all 27 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 28 XI, XII, XIII, XIV and XV unexpended, uncommitted or 29 unencumbered as of June 30, 1999, shall automatically lapse as 30 of that date. 19980H2281B3395 - 215 -
1 (b) The appropriations in Part II to the Legislative 2 Department shall be continuing appropriations. 3 Section 1907. Appellate courts appropriation contingency.-- 4 The funds appropriated in Part II to the Supreme, Superior and 5 Commonwealth Courts for justice and judge expenses are 6 contingent upon a vouchered expense account plan being continued 7 by the Supreme Court. 8 Section 1908. Transfer of excess funds.--The Governor may 9 transfer any excess money in those funds receiving proceeds of 10 Commonwealth of Pennsylvania general obligation bonds in excess 11 of the amount necessary for the purposes for which the bonds 12 were issued to the appropriate sinking fund for payment of debt 13 service due on outstanding bonds. If such excess funds, together 14 with any available balance, exceed the amount of debt service 15 remaining to be paid, the funds shall be transferred to the 16 General Fund or to the appropriate special fund responsible for 17 such debt service. 18 Section 1909. Transfer of funds by the Supreme Court.--(a) 19 The Supreme Court may transfer any excess funds appropriated in 20 sections 281, 285, 286, 287, 288, 289, 290, 291 and 292 to the 21 Judicial Department in Part II to the Judicial Computer 22 Augmentation Account during the month of June 1999. No transfer 23 may create or increase a deficiency in the appropriation from 24 which the transfer is made. Whenever the Supreme Court makes a 25 transfer under this subsection, the Supreme Court shall give 26 written notification to the chairman and minority chairman of 27 the Senate Committee on Appropriations and the chairman and the 28 minority chairman of the House of Representatives Committee on 29 Appropriations ten days prior to any transfer which shall also 30 include certification that such transfer will not result in a 19980H2281B3395 - 216 -
1 deficit in any appropriation. 2 (b) The Supreme Court may transfer funds appropriated in 3 section 281 between the line items in that section provided that 4 no transfer may create or increase a deficiency in the 5 appropriation from which the transfer is made. Whenever the 6 Supreme Court makes a transfer under this subsection, the 7 Supreme Court shall give written notification to the chairman 8 and minority chairman of the Senate Committee on Appropriations 9 and the chairman and the minority chairman of the House of 10 Representatives Committee on Appropriations ten days prior to 11 any transfer which shall also include certification that such 12 transfer will not result in a deficit in any appropriation. 13 Section 1910. Transfer from Hazardous Sites Cleanup Fund.-- 14 The sum of $12,000,000 is transferred from the Hazardous Sites 15 Cleanup Fund to the Industrial Sites Cleanup Fund. 16 Section 1911. Transfer to Tax Stabilization Reserve Fund.-- 17 If sufficient funds are available, the sum of $150,000,000 shall 18 be transferred to the Tax Stabilization Reserve Fund from the 19 ending balance at the close of the fiscal year ending June 30, 20 1998. 21 PART XX 22 EFFECTIVE DATE 23 Section 2001. Effective date.--This act shall take effect as 24 follows: 25 (1) Part XVII shall take effect immediately. 26 (2) This section shall take effect immediately. 27 (3) The remainder of this act shall take effect July 1, 28 1998, or immediately, whichever is later.
