AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1998, to June 30, 1999, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1998; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Ownership Fund to the 14 Executive Department; to provide appropriations from the 15 Judicial Computer System Augmentation Account to the Judicial 16 Department; to provide appropriations from the Motor License 17 Fund for the fiscal year July 1, 1998, to June 30, 1999, for 18 the proper operation of the several departments of the 19 Commonwealth and the Pennsylvania State Police authorized to 20 spend Motor License Fund moneys; to provide for the 21 appropriation of Federal funds to the Executive and Judicial 22 Departments of the Commonwealth and for the establishment of 23 restricted receipt accounts for the fiscal year July 1, 1998, 24 to June 30, 1999, and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 1998. 26 TABLE OF CONTENTS 27 PART I. 1 PART XIX. EFFECTIVE DATE. 2 Section 1901. Effective date. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 PART I 6 GENERAL PROVISIONS 7 Section 101. Short title.--This act shall be known and may 8 be cited as the General Appropriation Act of 1998. 9 Section 102. Definitions.--The following words and phrases 10 when used in this act shall have the meanings given to them in 11 this section unless the context clearly indicates otherwise: 12 "Employees." Includes all directors, superintendents, bureau 13 or division chiefs, assistant directors, assistant 14 superintendents, assistant chiefs, experts, scientists, 15 engineers, surveyors, draftsmen, accountants, secretaries, 16 auditors, inspectors, examiners, analysts, statisticians, 17 marshals, clerks, stenographers, bookkeepers, messengers and 18 other assistants in any department, board or commission. 19 "Expenses" and "maintenance." Includes all printing, binding 20 and stationery, food and forage, materials and supplies, 21 traveling expenses, training, motor vehicle supplies and 22 repairs, freight, express and cartage, postage, telephones and 23 telegraph rentals and toll charges, newspaper advertising and 24 notices, public advertising by or through any medium, fuel, 25 light, heat, power and water, minor construction and renovation, 26 repairs or reconstruction of equipment, buildings and 27 facilities, rent of real estate and equipment, premiums on 28 workers' compensation, insurance premiums on policies of 29 liability insurance, insurance premiums on medical payment 30 insurance and surety bonds for volunteer workers, premiums on 19980H2281B3013 - 7 -
1 employee group life insurance and employee and retired employee 2 group hospital and medical insurance, payment of Commonwealth 3 share of Social Security taxes and unemployment compensation 4 costs for State employees, the purchase of replacement or 5 additional equipment and machinery and all other incidental 6 costs and expenses, including payment to the Department of 7 General Services of mileage and other charges for the use of 8 automobiles and rental payments for permanently assigned 9 automobiles and of expenses or costs of services incurred 10 through the Purchasing Fund. The term "expenses" also shall 11 include the medical costs for the treatment of inmates of State 12 institutions when the inmate must be transferred to an outside 13 hospital: Provided, That in no case shall the State institution 14 pay more for patient care than that provided under the State 15 medical assistance program. 16 Section 103. Abbreviations.--The following abbreviations 17 when used in this act shall have the meanings given to them in 18 this section unless the context clearly indicates otherwise: 19 "ADA." State appropriations.--(a) General Fund.--The 19980H2281B3013 - 9 -
1 following sums set forth in this act, or as much thereof as may 2 be necessary, are hereby specifically appropriated from the 3 General Fund to the several hereinafter named agencies of the 4 Executive, Legislative and Judicial Departments of the 5 Commonwealth for the payment of salaries, wages or other 6 compensation and travel expenses of the duly elected or 7 appointed officers and employees of the Commonwealth, for the 8 payment of fees for contractual services rendered, for the 9 purchase or rental of goods and services, printing, public 10 advertising by or through any medium, equipment, land and 11 buildings and for payment of any other expenses, as provided by 12 law or by this act, necessary for the proper conduct of the 13 duties, functions and activities and for the purposes 14 hereinafter set forth for the fiscal year beginning July 1, 15 1998, and for the payment of bills incurred and remaining unpaid 16 at the close of the fiscal year ending June 30, 1998. 17 (b) State Lottery Fund.--The following sums set forth in 18 this act, or as much thereof as may be necessary, are hereby 19 specifically appropriated from the State Lottery Fund to the 20 several hereinafter named agencies of the Executive Department 21 of the Commonwealth for the payment of salaries, wages or other 22 compensation and travel expenses of the duly appointed officers 23 and employees of the Commonwealth, for the payment of fees for 24 contractual services rendered, for the purchase or rental of 25 goods and services and for payment of any other expenses, as 26 provided by law or by this act, necessary for the proper conduct 27 of the duties, functions and activities and for the purposes 28 hereinafter set forth for the fiscal year beginning July 1, 29 1998, and for the payment of bills incurred and remaining unpaid 30 at the close of the fiscal year ending June 30, 1998. 19980H2281B3013 - 10 -
1 (c) Energy Conservation and Assistance Fund.--The following 2 sums set forth in this act, or as much thereof as may be 3 necessary, are hereby specifically appropriated from the Energy 4 Conservation and Assistance Fund to the several hereinafter 5 named agencies of the Executive Department of the Commonwealth 6 for the payment of fees for contractual services rendered, for 7 the purchase or rental of goods and services and for the payment 8 of any other expenses, as provided by law or by this act, 9 necessary for the proper conduct of the duties, functions and 10 activities and for the purposes hereinafter set forth for the 11 fiscal year beginning July 1, 1998, and for the payment of bills 12 incurred and remaining unpaid at the close of the fiscal year 13 ending June 30, 1998. 14 (d) Judicial Computer System Augmentation Account.--The 15 following sums set forth in this act, or as much thereof as may 16 be necessary, are hereby specifically appropriated from the 17 restricted receipt account established within the General Fund, 18 known as the Judicial Computer System Augmentation Account, to 19 the Judicial Department of the Commonwealth for the payment of 20 salaries, wages or other compensation and travel expenses, for 21 the payment of fees for contractual services rendered, for the 22 purchase or rental of goods and services and for the payment of 23 any other expenses, as provided by law or by this act, necessary 24 for the proper conduct of the duties, functions and activities 25 and for the purposes hereinafter set forth for the fiscal year 26 beginning July 1, 1998, and for the payment of bills incurred 27 and remaining unpaid at the close of the fiscal year ending June 28 30, 1998. 29 (e) Emergency Medical Services Operating Fund.--The 30 following sums set forth in this act, or as much thereof as may 19980H2281B3013 - 11 -
1 be necessary, are hereby specifically appropriated from the 2 Emergency Medical Services Operating Fund to the several 3 hereinafter named agencies of the Executive Department of the 4 Commonwealth for the payment of fees for contractual services 5 rendered, for the purchase or rental of goods and services and 6 for the payment of any other expenses, as provided by law or by 7 this act, necessary for the proper conduct of the duties, 8 functions and activities and for the purposes hereinafter set 9 forth for the fiscal year beginning July 1, 1998, and for the 10 payment of bills incurred and remaining unpaid at the close of 11 the fiscal year ending June 30, 1998. 12 (f) The State Stores Fund.--The following sums set forth in 13 this act, or as much thereof as may be necessary, are hereby 14 specifically appropriated from The State Stores Fund to the 15 hereinafter named agency of the Executive Department of the 16 Commonwealth for the payment of salaries, wages or other 17 compensation and travel expenses of the duly appointed officers 18 and employees of the Commonwealth, for the payment of fees for 19 contractual services rendered, for the purchase or rental of 20 goods and services and for the payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 1998, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 1998. 26 (g) Motor License Fund.--The following sums, or as much 27 thereof as may be necessary, are hereby appropriated from the 28 Motor License Fund to the hereinafter named agencies of the 29 Executive Department for the payment of salaries, wages and 30 other compensation and travel expenses of the duly elected or 19980H2281B3013 - 12 -
1 appointed officers and employees of the Commonwealth, for 2 contractual services and other expenses necessary for the proper 3 conduct of the duties, functions and activities for the purposes 4 hereinafter set forth for the fiscal year beginning July 1, 5 1998, and for the payment of bills incurred and remaining unpaid 6 at the close of the fiscal year ending June 30, 1998. 7 (h) Aviation Restricted Revenue Account.--The following 8 sums, or as much thereof as may be necessary, are hereby 9 appropriated from the Aviation Restricted Revenue Account in the 10 Motor License Fund to the hereinafter named agencies of the 11 Executive Department for the purposes set forth herein for the 12 fiscal year beginning July 1, 1998, and for the payment of bills 13 incurred and remaining unpaid at the close of the fiscal year 14 ending June 30, 1998. 15 (i) Hazardous Material Response Fund.--The following sums 16 set forth in this act, or as much thereof as may be necessary, 17 are hereby specifically appropriated from the Hazardous Material 18 Response Fund to the several hereinafter named agencies of the 19 Executive Department of the Commonwealth for the payment of fees 20 for contractual services rendered, for the purchase or rental of 21 goods and services and for the payment of any other expenses, as 22 provided by law or by this act, necessary for the proper conduct 23 of the duties, functions and activities and for the purposes 24 hereinafter set forth for the fiscal year beginning July 1, 25 1998, and for the payment of bills incurred and remaining unpaid 26 at the close of the fiscal year ending June 30, 1998. 27 (j) Milk Marketing Fund.--The following sums set forth in 28 this act, or as much thereof as may be necessary, are hereby 29 specifically appropriated from the Milk Marketing Fund to the 30 several hereinafter named agencies of the Executive Department 19980H2281B3013 - 13 -
1 of the Commonwealth for the payment of salaries, wages or other 2 compensation and travel expenses of the duly appointed officers 3 and employees of the Commonwealth, for the payment of fees for 4 contractual services rendered, for the purchase or rental of 5 goods and services and for the payment of any other expenses, as 6 provided by law or by this act, necessary for the proper conduct 7 of the duties, functions and activities and for the purposes 8 hereinafter set forth for the fiscal year beginning July 1, 9 1998, and for the payment of bills incurred and remaining unpaid 10 at the close of the fiscal year ending June 30, 1998. 11 (k) Home Investment Trust Fund.--The following sums set 12 forth in this act, or as much thereof as may be necessary, are 13 hereby specifically appropriated from the Home Investment Trust 14 Fund to the hereinafter named agencies of the Executive 15 Department of the Commonwealth for the payment of salaries, 16 wages or other compensation and travel expenses of the duly 17 appointed officers and employees of the Commonwealth, for the 18 payment of fees for contractual services rendered, for the 19 purchase or rental of goods and services and for the payment of 20 any other expenses, as provided by law or by this act, necessary 21 for the proper conduct of the duties, functions and activities 22 and for the purposes hereinafter set forth for the fiscal year 23 beginning July 1, 1998, and for the payment of bills incurred 24 and remaining unpaid at the close of the fiscal year ending June 25 30, 1998. 26 (l) Ben Franklin/IRC Partnership Fund.--The following sums 27 set forth in this act, or as much thereof as may be necessary, 28 are hereby specifically appropriated from the Ben Franklin/IRC 29 Partnership Fund to the hereinafter named agencies of the 30 Executive Department of the Commonwealth for the payment of 19980H2281B3013 - 14 -
1 salaries, wages or other compensation and travel expenses of the 2 duly appointed officers and employees of the Commonwealth, for 3 the payment of fees for contractual services rendered, for the 4 purchase or rental of goods and services and for the payment of 5 any other expenses, as provided by law or by this act, necessary 6 for the proper conduct of the duties, functions and activities 7 and for the purposes hereinafter set forth for the fiscal year 8 beginning July 1, 1998, and for the payment of bills incurred 9 and remaining unpaid at the close of the fiscal year ending June 10 30, 1998. 11 (m) Tuition Payment Fund.--The following sums set forth in 12 this act, or as much thereof as may be necessary, are hereby 13 specifically appropriated from the Tuition Payment Fund to the 14 hereinafter named agencies of the Executive Department of the 15 Commonwealth for the payment of salaries, wages or other 16 compensation and travel expenses of the duly appointed officers 17 and employees of the Commonwealth, for the payment of fees for 18 contractual services rendered, for the purchase or rental of 19 goods and services and for the payment of any other expenses, as 20 provided by law or by this act, necessary for the proper conduct 21 of the duties, functions and activities and for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 1998, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 1998. 25 (n) Banking Department Fund.--The following sums set forth 26 in this act, or as much thereof as may be necessary, are hereby 27 specifically appropriated from the Banking Department Fund to 28 the hereinafter named agencies of the Executive Department of 29 the Commonwealth for the payment of salaries, wages or other 30 compensation and travel expenses of the duly appointed officers 19980H2281B3013 - 15 -

Block grants.--(a) Appropriation.--The 17 following sums set forth in this act, or as much thereof as may 18 be necessary, are hereby specifically appropriated from the 19 block grant (BG) funds to the several hereinafter named agencies 20 of the Executive Department of the Commonwealth for the 21 purposes, and under the restrictions, for which the funds are 22 provided for the fiscal year beginning July 1, 1998. 23 (b) Small Communities Development Block Grant.--The Small 24 Communities Development Block Grant (SCDBG) is to assist small 25 cities and communities that have a high concentration of 26 impoverished citizens and substandard housing to expand their 27 low-income and moderate-income housing opportunities and to meet 28 community development needs. 29 (c) Community Services Block Grant.--The Community Services 30 Block Grant (CSBG) is to provide a range of services and 19980H2281B3013 - 17 -
1 activities having a measurable and potentially major impact on 2 the causes of poverty in the community or those areas of the 3 community where poverty is a particularly acute problem. In 4 addition, new focus may be placed on the unemployed, both old 5 and new. Local agencies may lower their eligibility requirements 6 for recipients to three months to allow greater flexibility to 7 assure proper consideration of each recipient. 8 (d) Preventive Health and Health Services Block Grant.--The 9 Preventive Health and Health Services Block Grant (PHHSBG) is 10 for the provision of preventive health and other health services 11 related to emergency medical systems, health initiative grants, 12 comprehensive public health, hypertension, fluoridation, health 13 education, risk reduction, home health, rape crisis, domestic 14 violence services and rodent control. 15 (e) Maternal and Child Health Services Block Grant.--The 16 Maternal and Child Health Services Block Grant (MCHSBG) is to 17 enable states to maintain and strengthen their leadership in 18 planning, promoting, coordinating and evaluating health care for 19 pregnant women, mothers, infants and children, and children with 20 special health care needs, and in providing health services for 21 mothers and children who do not have access to adequate health 22 care. 23 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 24 Income Home Energy Assistance Block Grant (LIHEABG) is to help 25 lessen the impact of the high cost of energy on low-income 26 families and individuals, including energy efficiency grants for 27 low-income dwellings. No less than 15% of the LIHEABG funds 28 received shall be used for weatherization. LIHEABG funds 29 received pursuant to a Presidential release of weather-related 30 contingency funds shall be exempt from the 15% requirement if 19980H2281B3013 - 18 -
1 the weather emergency has an impact in Pennsylvania. Unexpended 2 weatherization funds which would result in LIHEABG funds being 3 returned to the Federal Department of Health and Human Services 4 may be spent for assistance grants at the discretion of the 5 Secretary of the Budget. The Secretary of the Budget shall 6 notify the majority chairman and the minority chairman of the 7 Appropriations Committee of the Senate and the majority chairman 8 and the minority chairman of the Appropriations Committee of the 9 House of Representatives of the intent to reallocate any such 10 funds ten days prior to any reallocation. 11 (g) Social Services Block Grant.--The Social Services Block 12 Grant (SSBG) is for the provision of social services to eligible 13 persons. 14 (h) Mental Health Services Block Grant.--The Mental Health 15 Services Block Grant (MHSBG) provides funds for the provision of 16 services to adults with serious mental illness or children with 17 serious emotional disturbance. 18 (i) Substance Abuse Block Grant.--The Substance Abuse Block 19 Grant (SABG) provides funds to establish and maintain programs 20 to combat alcohol and drug abuse. 21 (j) Child Care and Development Fund Block Grant.--The Child 22 Care and Development Fund Block Grant (CCDFBG) is for the 23 provision of direct child care or to increase the availability 24 of child care for low-income families. 25 (k) Temporary Assistance for Needy Families Block Grant.-- 26 The Temporary Assistance for Needy Families Block Grant (TANFBG) 27 provides funds for the provision of cash grants, child care, 28 training and support services, child welfare and administration 29 for eligible families and individuals. 30 PART II 19980H2281B3013 - 19 -

1 Commission.--The following restricted receipt account may be 2 established for the Pennsylvania Historical and Museum 3 Commission: 4 (1) "Federal Grant - Historical Preservation Act of 1966." 5 PART XVII 6 SPECIAL PROVISIONS FOR FEDERAL FUNDS 7 FOR 1998-1999 8 Section 1701. General Fund repository for Federal funds.-- 9 All moneys received from the Federal Government as contributions 10 or supplements to the departments or agencies of the 11 Commonwealth or the programs herein provided shall be paid into 12 the General Fund. 13 Section 1702. Limitation on encumbering or spending Federal 14 funds.--Federal funds shall be encumbered or spent only to the 15 extent that such funds are estimated as being available during 16 the fiscal year of the Commonwealth. 17 Section 1703. Appropriation of prior unspent Federal 18 funds.--Any Federal money which has been previously appropriated 19 by the General Assembly and authorized or allocated by the 20 Federal Government but remains unspent from prior fiscal years 21 and will not be renewed for fiscal year 1998-1999 is hereby 22 appropriated. 23 Section 1704. Subgrants between Federal fund 24 appropriations.--With the exception of Federal money received 25 under JTPA and SSBG, subgrants may be made between 26 appropriations without further approval of the General Assembly. 27 The Secretary of the Budget shall submit a list of subgrants to 28 the Chairmen and minority chairmen of the House and Senate 29 Appropriations Committees quarterly. No subgrant to a State 30 agency, however, may be made from a restricted receipt account 19980H2281B3013 - 187 -
1 without a specific appropriation by the General Assembly. 2 Section 1705. Utilization of emergency Federal funds.--(a) 3 Federal funds available for costs and damages resulting from 4 natural disasters or civil disobedience may be added to an 5 appropriation contained in this act or to funds appropriated or 6 may be used for the purposes prescribed by the Federal 7 Government. 8 (b) In addition to the moneys appropriated by this act, all 9 moneys received from the Federal Government for the purpose of 10 disaster assistance or relief shall be paid into the General 11 Fund and are hereby appropriated out of the General Fund to the 12 departments, boards, commissions or agencies designated by the 13 Governor. 14 (c) In the event of any emergency situation in which the 15 General Assembly cannot act in sufficient time, the Governor is 16 authorized through executive authorization to provide up to 17 $10,000,000 in Federal funds to alleviate the emergency 18 situation. For the purposes of this section, "emergency" is 19 defined as any situation in which there is a chance of or which 20 may result in substantial human suffering. 21 Section 1706. Transfer of funds from TANFBG to CCDFBG and 22 SSBG.--In accordance with Federal law which permits the transfer 23 of funds from the TANFBG to the CCDFBG and SSBG in amounts that 24 do not exceed 30% in total and limits the transfer to SSBG to 25 not more than 10% of the 30%, the Department of Public Welfare, 26 upon approval of the Secretary of the Budget, may make such 27 transfers of funds provided that any such transfer will not 28 result in a deficit in any appropriation from which funds are 29 transferred. The Secretary of the Budget shall provide 30 notification of any such transfers to the majority chairman and 19980H2281B3013 - 188 -
1 the minority chairman of the Appropriations Committee of the 2 Senate and the majority chairman and minority chairman of the 3 Appropriations Committee of the House of Representatives ten 4 days prior to any transfer which shall also include 5 certification that such transfer will not result in a deficit in 6 any appropriation. 7 PART XVIII 8 MISCELLANEOUS PROVISIONS FOR 1998-1999 9 Section 1801. Prior laws unaffected.--Except as provided in 10 section 253, this act is not intended to be inconsistent with or 11 to repeal any provision of any act enacted at this or any prior 12 session of the General Assembly regulating the purchase of 13 supplies, the ordering of printing and binding, the purchase, 14 maintenance and use of automobiles, the method of making 15 payments from the State Treasury for any purpose or the 16 functioning of any administrative department, board or 17 commission. 18 Section 1802. Compliance with other law before funds 19 available.--No appropriation made by this act to any department, 20 board, commission or agency of the Executive Department shall be 21 available unless and until the department, board, commission or 22 agency has complied with sections 615 and 616 of the act of 23 April 9, 1929 (P.L.177, No.175), known as The Administrative 24 Code of 1929. 25 Section 1803. Contracts prerequisite to encumbering or 26 committing funds.--Funds for the purchase of supplies, materials 27 and equipment shall not be deemed to be committed or encumbered 28 until contracts covering the purchase have been entered into 29 with the vendors. 30 Section 1804. Minority business set-asides.--(a) Each 19980H2281B3013 - 189 -
1 department or other instrumentality of the Commonwealth listed 2 in Subpart A of Part II authorized to contract for buildings, 3 highways, commodities, equipment, supplies or services shall 4 report to the General Assembly all information pertinent to 5 anticipated procurement needs at the beginning of each fiscal 6 year and each fiscal quarter thereafter. 7 (b) As used in this section, the term "minority business" 8 means a minority business enterprise as defined in the act of 9 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 10 Minority Business Development Authority Act. 11 Section 1805. Appropriation of funds from miscellaneous 12 sources.--(a) In addition to the amounts appropriated by this 13 act, moneys received in payment for food and household supplies 14 furnished to employees and other persons, except inmates, by an 15 institution, and moneys received from the proceeds from the sale 16 of any products of the soil, meats, livestock, timber or other 17 materials sold by the department shall be paid into the General 18 Fund and are hereby appropriated out of the General Fund to the 19 several respective institutions for the operation and 20 maintenance of the institutions. 21 (b) In addition to the amounts appropriated by this act, all 22 moneys received from any other source, except the Federal 23 Government, as contributions for the programs provided herein or 24 as payment for services or materials furnished by one 25 institution to another, except those collections designated as 26 revenues, shall be paid into the General Fund and are hereby 27 appropriated out of the General Fund for the purposes of the 28 respective appropriations. 29 (c) In addition to any funds specifically appropriated by 30 this act, all moneys received by a department or agency of the 19980H2281B3013 - 190 -
1 Commonwealth from any other sources, except the Federal 2 Government, as contributions or supplements to the department or 3 agency for a program or administration of an act included in 4 this act shall be paid into the General Fund and credited to the 5 appropriation for that program or administration of the act. 6 Section 1806. Lapsing of unused funds.--(a) Except as 7 otherwise provided by law or by this section, that part of all 8 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 9 XI, XII, XIII, XIV and XV unexpended, uncommitted or 10 unencumbered as of June 30, 1999, shall automatically lapse as 11 of that date. 12 (b) The appropriations in Part II to the Legislative 13 Department shall be continuing appropriations. 14 Section 1807. Appellate courts appropriation contingency.-- 15 The funds appropriated in Part II to the Supreme, Superior and 16 Commonwealth Courts for justice and judge expenses are 17 contingent upon a vouchered expense account plan being continued 18 by the Supreme Court. 19 Section 1808. Transfer of excess funds.--The Governor may 20 transfer any excess money in those funds receiving proceeds of 21 Commonwealth of Pennsylvania general obligation bonds in excess 22 of the amount necessary for the purposes for which the bonds 23 were issued to the appropriate sinking fund for payment of debt 24 service due on outstanding bonds. If such excess funds, together 25 with any available balance, exceed the amount of debt service 26 remaining to be paid, the funds shall be transferred to the 27 General Fund or to the appropriate special fund responsible for 28 such debt service. 29 Section 1809. Transfer of funds by the Supreme Court.--(a) 30 The Supreme Court may transfer any excess funds appropriated in 19980H2281B3013 - 191 -
1 sections 281, 285, 286, 287, 288, 289, 290, 291 and 292 to the 2 Judicial Department in Part II to the Judicial Computer 3 Augmentation Account during the month of June 1999. No transfer 4 may create or increase a deficiency in the appropriation from 5 which the transfer is made. Whenever the Supreme Court makes a 6 transfer under this subsection, the Supreme Court shall give 7 written notification to the chairman and minority chairman of 8 the Senate Committee on Appropriations and the chairman and the 9 minority chairman of the House of Representatives Committee on 10 Appropriations ten days prior to any transfer which shall also 11 include certification that such transfer will not result in a 12 deficit in any appropriation. 13 (b) The Supreme Court may transfer funds appropriated in 14 section 281 between the line items in that section provided that 15 no transfer may create or increase a deficiency in the 16 appropriation from which the transfer is made. Whenever the 17 Supreme Court makes a transfer under this subsection, the 18 Supreme Court shall give written notification to the chairman 19 and minority chairman of the Senate Committee on Appropriations 20 and the chairman and the minority chairman of the House of 21 Representatives Committee on Appropriations ten days prior to 22 any transfer which shall also include certification that such 23 transfer will not result in a deficit in any appropriation. 24 Section 1810. Transfer from Hazardous Sites Cleanup Fund.-- 25 The sum of $12,000,000 is transferred from the Hazardous Sites 26 Cleanup Fund to the Industrial Sites Cleanup Fund. 27 PART XIX 28 EFFECTIVE DATE 29 Section 1901.
