AN ACT 1 Providing for the compensation of election officers and 2 constables; and making repeals. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the District 7 Election Officers Compensation Act. 8 Section 2. Definitions. 9 The following words and phrases when used in this act shall 10 have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "District Election Board." The election officers required 13 for the conduct of elections in any election district in 14 accordance with the act of June 3, 1937 (P.L.1333, No.320), 15 known as the Pennsylvania Election Code. 16 "Election." Any general, municipal, special or primary
1 election. 2 "Election district." A district, division or precinct 3 established in accordance with the act of June 3, 1937 4 (P.L.1333, No.320), known as the Pennsylvania Election Code, in 5 which all qualified electors vote in one polling place. 6 Section 3. Compensation. 7 (a) Schedule.--Compensation of judges of election, 8 inspectors of election, clerks and machine operators as provided 9 in Article IV of the act of June 3, 1937 (P.L.1333, No.320), 10 known as the Pennsylvania Election Code, shall be fixed by the 11 county board of elections for each election in accordance with 12 the following: 13 Election Officers Minimum Maximum 14 Compensation Compensation 15 Judges of elections $45 $100 16 Inspectors of election, 17 clerks and machine 18 operators $40 $ 95 19 (b) Per diem by category.--The county board of elections 20 may, in its discretion, establish different per diem rates 21 within the above-mentioned minima and maxima based on the number 22 of votes cast for the following groups: 23 (1) 150 votes or less. 24 (2) 151 to 300 votes. 25 (3) 301 to 500 votes. 26 (4) 501 to 750 votes. 27 (5) 751 votes and over. 28 Section 4. Additional compensation. 29 (a) Transmitting returns and ballot boxes.--For transmitting 30 returns of elections and the ballot box or boxes, all judges of 19970H1788B2240 - 2 -
1 elections shall be entitled to receive the additional sum of 2 $10. 3 (b) Minority inspector.--The county board of elections may, 4 in its discretion, require the minority inspector of elections 5 to accompany the judge of elections in transmitting the returns 6 of elections in which case the minority inspector of elections 7 shall be entitled to receive the additional sum of $10. 8 (c) Mileage.--The person furnishing transportation to the 9 judge of elections and the minority inspector in transmitting 10 returns and ballot boxes shall be entitled to a minimum of 30¢ 11 per circular mile from the polling place to the county court 12 house. The name of such person shall appear on the voucher of 13 the judge of elections and only one person shall receive mileage 14 compensation. 15 (d) Constable or deputy constable.--A constable or deputy 16 constable performing duties under section 1207 of the act of 17 June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania 18 Election Code, shall receive compensation at the same rate 19 payable to an inspector or a clerk under section 3. 20 Section 5. Multiple elections. 21 When a primary and special election or a special election and 22 a general or municipal election take place on the same date, 23 they shall be construed as one election for the purpose of 24 receiving compensation. 25 Section 6. Repeals. 26 (a) Absolute.--Section 412.1 of the act of June 3, 1937 27 (P.L.1333, No.320), known as the Pennsylvania Election Code, is 28 repealed. 29 (b) General.--All other acts and parts of acts are repealed 30 insofar as they are inconsistent with this act. 19970H1788B2240 - 3 -
