                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled
     2     "An act relating to counties of the third, fourth, fifth,
     3     sixth, seventh and eighth classes; amending, revising,
     4     consolidating and changing the laws relating thereto; and
     5     providing for regional renaissance initiatives," providing
     6     for the abolition of jury commissioners in counties of the
     7     third class having a population under the Federal Decennial
     8     Census in excess of 337,000 residents, but less than 341,000
     9     residents.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 401 of the act of August 9, 1955
    13  (P.L.323, No.130), known as The County Code, is amended by
    14  adding a subsection to read:
    15     Section 401.  Enumeration of Elected Officers.--* * *
    16     (d)  The office of jury commissioner may be abolished at the
    17  option of each county by referendum, whenever electors equal to
    18  at least five per centum of the highest vote cast for any office
    19  in the county at the last preceding general election shall file
    20  a petition with the county board of elections of the county, or
    21  the governing body of the county adopts, by a majority vote, a

     1  resolution to place such a question on the ballot and a copy of
     2  the resolution is filed with the board of elections of the
     3  county for a referendum on the question of abolishing the office
     4  of jury commissioner. Proceedings under this subsection shall be
     5  in accordance with the provisions of the act of June 3, 1937
     6  (P.L.1333, No.320), known as the "Pennsylvania Election Code."
     7  As used in this subsection, the following words and phrases
     8  shall have the meanings given to them in this subsection:
     9     "County."  Any county which on the effective date of this act
    10  is a county of the third class having a population under the
    11  1990 Federal decennial census in excess of 337,000 residents,
    12  but less than 341,000 residents.
    13     Section 2.  (a)  Expiration of term.--Upon approval of the
    14  referendum the office of jury commissioner in effected counties
    15  shall expire at the completion of the current jury
    16  commissioners' terms of office.
    17     (b)  Referendum year.--The referendum provided for in section
    18  401(d) of the act shall take place in any year in which the
    19  office of jury commissioner is not on the ballot.
    20     Section 3.  This act shall take effect in 60 days.
