                                     AN ACT

     1  Amending the act of July 9, 1990 (P.L.340, No.78), entitled "An
     2     act providing for a Statewide emergency telephone number 911
     3     system; providing for contributions from telephone
     4     subscribers; providing a penalty; and making a repeal,"
     5     providing for expenditures for mobile communications
     6     equipment.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 8 of the act of July 9, 1990 (P.L.340,
    10  No.78), known as the Public Safety Emergency Telephone Act, is
    11  amended to read:
    12  Section 8.  Expenditures for nonrecurring costs, mobile
    13                 communications equipment, maintenance and
    14                 operation of 911 systems.
    15     (a)  Expenditures authorized.--During each county's fiscal
    16  year, the county may expend the amounts distributed to it from
    17  the contribution rate for the nonrecurring costs, and costs for
    18  mobile communications equipment, maintenance and operation of a

     1  county 911 system.
     2     (b)  Items included in nonrecurring costs, mobile
     3  communications equipment, maintenance and operation costs.--
     4  Maintenance and operation costs may include telephone company
     5  charges, equipment costs or equipment lease charges, repairs,
     6  utilities, data base maintenance costs, personnel salary and
     7  benefit costs which are directly related to the provision of 911
     8  services and costs for mobile communications equipment, audit
     9  costs and appropriate carryover costs from previous years.
    10  Maintenance and operation costs shall not include any cost
    11  necessary to house the 911 system. No more than 60% of the
    12  contribution rate collected during each county's fiscal year may
    13  be utilized to fund personnel salary and benefit costs.
    14     (c)  Limitations on expenditures.--The department shall adopt
    15  procedures to assure that the total amount collected from the
    16  911 contribution rate shall be expended only for the
    17  nonrecurring costs, and costs for mobile communications
    18  equipment, maintenance and operation of a county 911 system.
    19  Nonrecurring costs shall be amortized over a minimum of three
    20  years.
    21     (d)  Triennial audit.--The department shall require a
    22  triennial audit of each county's expenditures for the
    23  nonrecurring costs, and costs for mobile communications
    24  equipment, maintenance and operation of 911 systems. The
    25  triennial audit cost shall be paid by the respective county from
    26  contribution rate revenues.
    27     Section 2.  This act shall take effect in 60 days.
