        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 27, 1997

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, authorizing the department to arrange
     3     for burial details in the Indiantown Gap National Cemetery.
     4     and making an appropriation.                                   <--

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 51 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 705.  Burial details for veterans.
    10     (a)  Authority.--The department shall have the power to
    11  arrange for burial details for veteran soldiers who are to be
    12  interred in the Indiantown Gap National Cemetery.
    13     (b)  Contracts.--The department may enter into contracts with
    14  a Statewide, nonprofit fraternal society that represents various
    15  veterans' groups for the purpose of providing the burial details
    16  authorized by this section. In any such contract, the department

     1  shall pay $150 for each day that the burial detail is provided
     2  and no other expenses shall be paid by the department under the
     3  contract.
     4     (c)  Terms.--Any burial detail contract entered into under
     5  this section shall include the following terms:
     6         (1)  A minimum of three veterans shall participate in the
     7     burial detail.
     8         (2)  The veterans shall be similarly uniformed and
     9     equipped.
    10         (3)  A bugler shall perform taps or a recording of taps
    11     may be played over the tape recording system of the cemetery.
    12         (4)  The party under the contract shall indemnify and
    13     hold harmless the department and the Commonwealth from any
    14     claims arising out of the performance of the burial details.
    15     (d)  Insurance.--The party under the contract pursuant to
    16  this section shall provide liability insurance for all burial
    17  details, in such amount as prescribed by the department.
    18     (e)  Regulations.--The department shall promulgate the rules
    19  and regulations necessary to carry out this section.
    20     Section 2.  The sum of $50,000, or as much thereof as may be   <--
    21  necessary, is hereby appropriated from the General Fund to the
    22  Department of Military and Veterans Affairs for the fiscal year
    23  July 1, 1997, to June 30, 1998, to pay for the services
    24  performed under this act.
    25     Section 3 2.  This act shall take effect July 1, 1997, JULY    <--
    26  1, 1998, or immediately, whichever is later.
