AN ACT 1 Amending the act of June 14, 1961 (P.L.324, No.188), entitled 2 "An act relating to the establishment, operation and 3 maintenance of the State Library and public libraries in the 4 Commonwealth; amending, revising, consolidating and changing 5 the laws relating thereto; imposing duties upon public 6 officers; providing for State and local cooperation and 7 assistance in the establishment and maintenance of libraries; 8 prescribing penalties; and repealing existing laws," 9 requiring the Auditor General to perform certain audits of 10 library funds. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Sections 413 and 414 of the act of June 14, 1961 14 (P.L.324, No.188), known as The Library Code, are amended to 15 read: 16 Section 413. Library Directors to Control All Funds.--All 17 moneys appropriated for the establishment and/or maintenance of 18 a local library and all moneys, if any, received from other 19 sources for its use, shall be under the exclusive control and 20 shall be disbursed under the direction of the board of library 21 directors. Such board of library directors shall have the power
1 to contract with the board of directors of another library to 2 establish a cooperative plan for improving library services. 3 [The board of control of any library, established as 4 specified in section 411 of this act, and of any library 5 receiving municipal appropriations shall make a report, 6 annually, to the proper municipal authorities, of the moneys 7 received by such library from the municipality and the 8 dispositions made thereof, and the accounts of the treasurer of 9 said board shall be audited as in the case of other municipal 10 expenditures.] The Auditor General shall cause to be performed a 11 full audit of any and all accounts of: 12 (1) all libraries receiving more than fifty thousand dollars 13 ($50,000) in State appropriations on an annual basis; and 14 (2) all libraries receiving less than fifty thousand dollars 15 ($50,000) in State appropriations every third year beginning 16 three years from the last audit reported to the State Library. 17 The results of the audits shall be made available to the proper 18 municipal authorities and the State Library. Nothing in this 19 section shall preclude a municipality from performing its own 20 audit of any and all accounts of any library for which it 21 provides financial support at any time the municipality deems 22 necessary. 23 Section 414. Annual Reports.--[The annual report required by 24 the last preceding section shall contain an itemized statement 25 of all receipts from whatever source, and expenditures, and 26 shall show] All libraries provided financial support by a 27 municipality shall provide an annual report to the municipality 28 providing support showing the condition of the library and any 29 branches thereof, the number of volumes, maps, pamphlets and 30 other materials, the number added by purchase, gift or 19970H1162B1318 - 2 -
1 otherwise, the number lost or withdrawn, the number of 2 registered borrowers and readers and a statement of the 3 circulation of material, with such other information and 4 suggestions as may seem desirable. A copy of each report made to 5 the municipal officers shall be sent to the State Library in 6 Harrisburg. 7 Section 2. This act shall take effect in 60 days. A28L24WMB/19970H1162B1318 - 3 -
