We, the undersigned, Committee of Conference on the part of the House of Representatives and Senate for the purpose of considering House Bill No. 847, entitled: "An act to provide from the General Fund for the expenses of the Executive, Legislative and Judicial Departments of the Commonwealth, the public debt and for the public schools for the fiscal year July 1, 1997, to June 30, 1998, * * * and for the payment of bills remaining unpaid at the close of the fiscal year ending June 30, 1997. AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1997, to June 30, 1998, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1997; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Ownership Fund to the 14 Executive Department; to provide appropriations from the 15 Judicial Computer System Augmentation Account to the Judicial 16 Department; to provide appropriations from the Motor License 17 Fund for the fiscal year July 1, 1997, to June 30, 1998, for 18 the proper operation of the several departments of the 19 Commonwealth and the Pennsylvania State Police authorized to 20 spend Motor License Fund moneys; to provide for the 21 appropriation of Federal funds to the Executive and Judicial 22 Departments of the Commonwealth and for the establishment of 23 restricted receipt accounts for the fiscal year July 1, 1997, 24 to June 30, 1998, and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 1997; 26 and to provide for the additional appropriation of State and 27 Federal funds for the Executive and Judicial Departments of 28 the Commonwealth for the fiscal year July 1, 1996, to June 29 30, 1997, and for the payment of bills incurred and remaining 30 unpaid at the close of the fiscal year ending June 30, 1996. 31 TABLE OF CONTENTS 32 PART I. Effective date. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 PART I 14 GENERAL PROVISIONS 15 Section 101. Short title.--This act shall be known and may 16 be cited as the General Appropriation Act of 1997. 17 Section 102. Definitions.--The following words and phrases 18 when used in this act shall have the meanings given to them in 19 this section unless the context clearly indicates otherwise: 20 "Employees." Includes all directors, superintendents, bureau 21 or division chiefs, assistant directors, assistant 22 superintendents, assistant chiefs, experts, scientists, 23 engineers, surveyors, draftsmen, accountants, secretaries, 24 auditors, inspectors, examiners, analysts, statisticians, 25 marshals, clerks, stenographers, bookkeepers, messengers and 26 other assistants in any department, board or commission. 27 "Expenses" and "maintenance." Includes all printing, binding 28 and stationery, food and forage, materials and supplies, 29 traveling expenses, training, motor vehicle supplies and 30 repairs, freight, express and cartage, postage, telephones and 19970H0847B1725 - 10 -
1 telegraph rentals and toll charges, newspaper advertising and 2 notices, public advertising by or through any medium, fuel, 3 light, heat, power and water, minor construction and renovation, 4 repairs or reconstruction of equipment, buildings and 5 facilities, rent of real estate and equipment, premiums on 6 workers' compensation, insurance premiums on policies of 7 liability insurance, insurance premiums on medical payment 8 insurance and surety bonds for volunteer workers, premiums on 9 employee group life insurance and employee and retired employee 10 group hospital and medical insurance, payment of Commonwealth 11 share of Social Security taxes and unemployment compensation 12 costs for State employees, the purchase of replacement or 13 additional equipment and machinery and all other incidental 14 costs and expenses, including payment to the Department of 15 General Services of mileage and other charges for the use of 16 automobiles and rental payments for permanently assigned 17 automobiles and of expenses or costs of services incurred 18 through the Purchasing Fund. The term "expenses" also shall 19 include the medical costs for the treatment of inmates of State 20 institutions when the inmate must be transferred to an outside 21 hospital: Provided, That in no case shall the State institution 22 pay more for patient care than that provided under the State 23 medical assistance program. 24 Section 103. Abbreviations.--The following abbreviations 25 when used in this act shall have the meanings given to them in 26 this section unless the context clearly indicates otherwise: 27 "ADA." State appropriations.--(a) General Fund.--The 10 following sums set forth in this act, or as much thereof as may 11 be necessary, are hereby specifically appropriated from the 12 General Fund to the several hereinafter named agencies of the 13 Executive, Legislative and Judicial Departments of the 14 Commonwealth for the payment of salaries, wages or other 15 compensation and travel expenses of the duly elected or 16 appointed officers and employees of the Commonwealth, for the 17 payment of fees for contractual services rendered, for the 18 purchase or rental of goods and services, printing, public 19 advertising by or through any medium, equipment, land and 20 buildings and for payment of any other expenses, as provided by 21 law or by this act, necessary for the proper conduct of the 22 duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 1997, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 1997. 26 (b) State Lottery Fund.--The following sums set forth in 27 this act, or as much thereof as may be necessary, are hereby 28 specifically appropriated from the State Lottery Fund to the 29 several hereinafter named agencies of the Executive Department 30 of the Commonwealth for the payment of salaries, wages or other 19970H0847B1725 - 13 -
1 compensation and travel expenses of the duly appointed officers 2 and employees of the Commonwealth, for the payment of fees for 3 contractual services rendered, for the purchase or rental of 4 goods and services and for payment of any other expenses, as 5 provided by law or by this act, necessary for the proper conduct 6 of the duties, functions and activities and for the purposes 7 hereinafter set forth for the fiscal year beginning July 1, 8 1997, and for the payment of bills incurred and remaining unpaid 9 at the close of the fiscal year ending June 30, 1997. 10 (c) Energy Conservation and Assistance Fund.--The following 11 sums set forth in this act, or as much thereof as may be 12 necessary, are hereby specifically appropriated from the Energy 13 Conservation and Assistance Fund to the several hereinafter 14 named agencies of the Executive Department of the Commonwealth 15 for the payment of fees for contractual services rendered, for 16 the purchase or rental of goods and services and for the payment 17 of any other expenses, as provided by law or by this act, 18 necessary for the proper conduct of the duties, functions and 19 activities and for the purposes hereinafter set forth for the 20 fiscal year beginning July 1, 1997, and for the payment of bills 21 incurred and remaining unpaid at the close of the fiscal year 22 ending June 30, 1997. 23 (d) Judicial Computer System Augmentation Account.--The 24 following sums set forth in this act, or as much thereof as may 25 be necessary, are hereby specifically appropriated from the 26 restricted receipt account established within the General Fund, 27 known as the Judicial Computer System Augmentation Account, to 28 the Judicial Department of the Commonwealth for the payment of 29 salaries, wages or other compensation and travel expenses, for 30 the payment of fees for contractual services rendered, for the 19970H0847B1725 - 14 -
1 purchase or rental of goods and services and for the payment of 2 any other expenses, as provided by law or by this act, necessary 3 for the proper conduct of the duties, functions and activities 4 and for the purposes hereinafter set forth for the fiscal year 5 beginning July 1, 1997, and for the payment of bills incurred 6 and remaining unpaid at the close of the fiscal year ending June 7 30, 1997. 8 (e) Emergency Medical Services Operating Fund.--The 9 following sums set forth in this act, or as much thereof as may 10 be necessary, are hereby specifically appropriated from the 11 Emergency Medical Services Operating Fund to the several 12 hereinafter named agencies of the Executive Department of the 13 Commonwealth for the payment of fees for contractual services 14 rendered, for the purchase or rental of goods and services and 15 for the payment of any other expenses, as provided by law or by 16 this act, necessary for the proper conduct of the duties, 17 functions and activities and for the purposes hereinafter set 18 forth for the fiscal year beginning July 1, 1997, and for the 19 payment of bills incurred and remaining unpaid at the close of 20 the fiscal year ending June 30, 1997. 21 (f) The State Stores Fund.--The following sums set forth in 22 this act, or as much thereof as may be necessary, are hereby 23 specifically appropriated from The State Stores Fund to the 24 hereinafter named agency of the Executive Department of the 25 Commonwealth for the payment of salaries, wages or other 26 compensation and travel expenses of the duly appointed officers 27 and employees of the Commonwealth, for the payment of fees for 28 contractual services rendered, for the purchase or rental of 29 goods and services and for the payment of any other expenses, as 30 provided by law or by this act, necessary for the proper conduct 19970H0847B1725 - 15 -
1 of the duties, functions and activities and for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 1997, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 1997. 5 (g) Motor License Fund.--The following sums, or as much 6 thereof as may be necessary, are hereby appropriated from the 7 Motor License Fund to the hereinafter named agencies of the 8 Executive Department for the payment of salaries, wages and 9 other compensation and travel expenses of the duly elected or 10 appointed officers and employees of the Commonwealth, for 11 contractual services and other expenses necessary for the proper 12 conduct of the duties, functions and activities for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 1997, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 1997. 16 (h) Aviation Restricted Revenue Account.--The following 17 sums, or as much thereof as may be necessary, are hereby 18 appropriated from the Aviation Restricted Revenue Account in the 19 Motor License Fund to the hereinafter named agencies of the 20 Executive Department for the purposes set forth herein for the 21 fiscal year beginning July 1, 1997, and for the payment of bills 22 incurred and remaining unpaid at the close of the fiscal year 23 ending June 30, 1997. 24 (i) Hazardous Material Response Fund.--The following sums 25 set forth in this act, or as much thereof as may be necessary, 26 are hereby specifically appropriated from the Hazardous Material 27 Response Fund to the several hereinafter named agencies of the 28 Executive Department of the Commonwealth for the payment of fees 29 for contractual services rendered, for the purchase or rental of 30 goods and services and for the payment of any other expenses, as 19970H0847B1725 - 16 -

1 provided for the fiscal year beginning July 1, 1997. 2 (b) Small Communities Development Block Grant.--The Small 3 Communities Development Block Grant (SCDBG) is to assist small 4 cities and communities that have a high concentration of 5 impoverished citizens and substandard housing to expand their 6 low-income and moderate-income housing opportunities and to meet 7 community development needs. 8 (c) Community Services Block Grant.--The Community Services 9 Block Grant (CSBG) is to provide a range of services and 10 activities having a measurable and potentially major impact on 11 the causes of poverty in the community or those areas of the 12 community where poverty is a particularly acute problem. In 13 addition, new focus may be placed on the unemployed, both old 14 and new. Local agencies may lower their eligibility requirements 15 for recipients to three months to allow greater flexibility to 16 assure proper consideration of each recipient. 17 (d) Preventive Health and Health Services Block Grant.--The 18 Preventive Health and Health Services Block Grant (PHHSBG) is 19 for the provision of preventive health and other health services 20 related to emergency medical systems, health initiative grants, 21 comprehensive public health, hypertension, fluoridation, health 22 education, risk reduction, home health, rape crisis, domestic 23 violence services and rodent control. 24 (e) Maternal and Child Health Services Block Grant.--The 25 Maternal and Child Health Services Block Grant (MCHSBG) is to 26 enable states to maintain and strengthen their leadership in 27 planning, promoting, coordinating and evaluating health care for 28 pregnant women, mothers, infants and children, and children with 29 special health care needs, and in providing health services for 30 mothers and children who do not have access to adequate health 19970H0847B1725 - 21 -
1 care. 2 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 3 Income Home Energy Assistance Block Grant (LIHEABG) is to help 4 lessen the impact of the high cost of energy on low-income 5 families and individuals, including energy efficiency grants for 6 low-income dwellings. No less than 15% of the LIHEABG funds 7 received shall be used for weatherization. LIHEABG funds 8 received pursuant to a Presidential release of weather-related 9 contingency funds shall be exempt from the 15% requirement if 10 the weather emergency has an impact in Pennsylvania. Unexpended 11 weatherization funds which would result in LIHEABG funds being 12 returned to the Federal Department of Health and Human Services 13 may be spent for assistance grants at the discretion of the 14 Secretary of the Budget. The Secretary of the Budget shall 15 notify the Majority Chairman and the Minority Chairman of the 16 Appropriations Committee of the Senate and the Majority Chairman 17 and the Minority Chairman of the Appropriations Committee of the 18 House of Representatives of the intent to reallocate any such 19 funds ten days prior to any reallocation. 20 (g) Social Services Block Grant.--The Social Services Block 21 Grant (SSBG) is for the provision of social services to eligible 22 persons. 23 (h) Child Care and Development Block Grant.--The Child Care 24 and Development Block Grant (CCDBG) is for the provision of 25 direct child care or to increase the availability of child care 26 for low-income families. 27 (i) Mental Health Services Block Grant.--The Mental Health 28 Services Block Grant (MHSBG) provides funds for the provision of 29 services to adults with serious mental illness or children with 30 serious emotional disturbance. 19970H0847B1725 - 22 -

The $3,000,000 may 15 be drawn from both the highway and 16 safety improvement and maintenance 17 appropriations. 18 State appropriation........ 546,942,000 19 SUBPART E 20 MISCELLANEOUS PROVISIONS 21 Section 1791. Prior laws unaffected.--This part is not 22 intended to be inconsistent with or to repeal any provision of 23 any act enacted at this or any prior session of the General 24 Assembly regulating the purchase of supplies, the ordering of 25 printing and binding, the purchase, maintenance and use of 26 automobiles, the method of making payments from the State 27 Treasury for any purpose or the functioning of any 28 administrative department, board or commission. 29 Section 1792. Compliance with other law before funds 30 available.--No appropriation made by this part to any 19970H0847B1725 - 209 -
1 department, board, commission or agency of the Executive 2 Department shall be available unless and until the department, 3 board, commission or agency has complied with sections 615 and 4 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 5 Administrative Code of 1929. 6 Section 1793. Contracts prerequisite to encumbering or 7 committing funds.--Funds for the purchase of supplies, materials 8 and equipment shall not be deemed to be committed or encumbered 9 until contracts covering the purchase have been entered into 10 with the vendors. 11 Section 1794. Minority business set-asides.--(a) Each 12 department or other instrumentality of the Commonwealth listed 13 in Subparts B and D, authorized to contract for buildings, 14 highways, commodities, equipment, supplies or services, shall 15 report to the General Assembly all information pertinent to 16 anticipated procurement needs at the beginning of each fiscal 17 year and each fiscal quarter thereafter. 18 (b) As used in this section, the term "minority business" 19 means a minority business enterprise as defined in the act of 20 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 21 Minority Business Development Authority Act. 22 Section 1795. Appropriation of funds from miscellaneous 23 sources.--(a) In addition to the amounts appropriated by this 24 part, moneys received in payment for food and household supplies 25 furnished to employees and other persons, except to inmates, by 26 an institution, and moneys received from the proceeds from the 27 sale of any products of the soil, meats, livestock, timber or 28 other materials sold by the department shall be paid into the 29 General Fund and are hereby appropriated out of the General Fund 30 to the several respective institutions for the operation and 19970H0847B1725 - 210 -
1 maintenance of the institution. 2 (b) In addition to the amounts appropriated by this part, 3 all moneys received from any other source, except the Federal 4 Government, as contributions for the programs provided herein or 5 as payment for services or materials furnished by one 6 institution to another, except those collections designated as 7 revenues, shall be paid into the General Fund and are hereby 8 appropriated out of the General Fund for the purposes of the 9 respective appropriations. 10 (c) In addition to any funds specifically appropriated by 11 this part, all moneys received by a department or agency of the 12 Commonwealth from any other source, except the Federal 13 Government, as contributions or supplements to the department or 14 agency for a program or administration of an act included in 15 this part shall be paid into the General Fund and credited to 16 the appropriation for that program or administration of the act. 17 Section 1796. Lapsing of unused funds.--Except as otherwise 18 provided by law, that part of all appropriations in Subparts B, 19 C and D of this part unexpended, uncommitted or unencumbered as 20 of June 30, 1997, shall automatically lapse as of that date. 21 Section 1797. Construction with prior appropriation acts.-- 22 Any appropriation in Subparts B, C and D of this part which is 23 the same or similar to any appropriation in the act of June 29, 24 1996 (P.L. , No.1A), known as the General Appropriation Act of 25 1996, shall replace that appropriation. 26 Section 1798. Deduction of expended appropriations under 27 prior law.--Any money that has been appropriated and expended 28 under the act of June 29, 1996 (P.L. , No.1A), known as the 29 General Appropriation Act of 1996, shall be deducted from the 30 corresponding appropriation in this part. 19970H0847B1725 - 211 -
1 PART XVIII 2 SPECIAL PROVISIONS FOR FEDERAL FUNDS 3 FOR 1997-1998 4 Section 1801. General Fund repository for Federal funds.-- 5 All moneys received from the Federal Government as contributions 6 or supplements to the departments or agencies of the 7 Commonwealth or the programs herein provided shall be paid into 8 the General Fund. 9 Section 1802. Limitation on encumbering or spending Federal 10 funds.--Federal funds shall be encumbered or spent only to the 11 extent that such funds are estimated as being available during 12 the fiscal year of the Commonwealth. 13 Section 1803. Appropriation of prior unspent Federal 14 funds.--Any Federal money which has been previously appropriated 15 by the General Assembly and authorized or allocated by the 16 Federal Government but remains unspent from prior fiscal years 17 and will not be renewed for fiscal year 1997-1998 is hereby 18 appropriated. 19 Section 1804. Subgrants between Federal fund 20 appropriations.--With the exception of Federal money received 21 under JTPA and SSBG, subgrants may be made between 22 appropriations without further approval of the General Assembly. 23 The Secretary of the Budget shall submit a list of subgrants to 24 the Chairmen and minority chairmen of the House and Senate 25 Appropriations Committees quarterly. No subgrant to a State 26 agency, however, may be made from a restricted receipt account 27 without a specific appropriation by the General Assembly. 28 Section 1805. Utilization of emergency Federal funds.--(a) 29 Federal funds available for costs and damages resulting from 30 natural disasters or civil disobedience may be added to an 19970H0847B1725 - 212 -
1 appropriation contained in this act or to funds appropriated or 2 may be used for the purposes prescribed by the Federal 3 Government. 4 (b) In addition to the moneys appropriated by this act, all 5 moneys received from the Federal Government for the purpose of 6 disaster assistance or relief shall be paid into the General 7 Fund and are hereby appropriated out of the General Fund to the 8 departments, boards, commissions or agencies designated by the 9 Governor. 10 (c) In the event of any emergency situation in which the 11 General Assembly cannot act in sufficient time, the Governor is 12 authorized through executive authorization to provide up to 13 $10,000,000 in Federal funds to alleviate the emergency 14 situation. For the purposes of this section, "emergency" is 15 defined as any situation in which there is a chance of or which 16 may result in substantial human suffering. 17 Section 1806. Transfer of funds from TANFBG to CCDFBG.--In 18 accordance with Federal law which permits the transfer of up to 19 30% of the TANFBG to the CCDFBG and the transfer of up to one- 20 third of such transferred funds to the SSBG, the Department of 21 Public Welfare, upon approval of the Secretary of the Budget, 22 may make such transfers of funds provided that any such transfer 23 will not result in a deficit in any appropriation from which 24 funds are transferred. The Secretary of the Budget shall provide 25 notification of any such transfers to the majority chairman and 26 the minority chairman of the Appropriations Committee of the 27 Senate and the majority chairman and minority chairman of the 28 Appropriations Committee of the House of Representatives ten 29 days prior to any transfer which shall also include 30 certification that such transfer will not result in a deficit in 19970H0847B1725 - 213 -

1 Section 1906. Lapsing of unused funds.--(a) Except as 2 otherwise provided by law or by this section, that part of all 3 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 4 XI, XII, XIII, XIV and XV unexpended, uncommitted or 5 unencumbered as of June 30, 1998, shall automatically lapse as 6 of that date. 7 (b) The appropriations in Part II in section 214 to the 8 Department of General Services for the Capitol Annex 9 renovations, to the Legislative Department and the appropriation 10 in Part VIII in section 806 to the Department of Environmental 11 Protection shall be continuing appropriations. 12 Section 1907. Appellate courts appropriation contingency.-- 13 The funds appropriated in Part II to the Supreme, Superior and 14 Commonwealth Courts for justice and judge expenses are 15 contingent upon a vouchered expense account plan being continued 16 by the Supreme Court. 17 Section 1908. Transfer of excess funds.--The Governor may 18 transfer any excess money in those funds receiving proceeds of 19 Commonwealth of Pennsylvania general obligation bonds in excess 20 of the amount necessary for the purposes for which the bonds 21 were issued to the appropriate sinking fund for payment of debt 22 service due on outstanding bonds. If such excess funds, together 23 with any available balance, exceed the amount of debt service 24 remaining to be paid, the funds shall be transferred to the 25 General Fund or to the appropriate special fund responsible for 26 such debt service. 27 Section 1909. Transfer of funds by the Supreme Court.--(a) 28 The Supreme Court may transfer any excess funds appropriated in 29 sections 281, 285, 286, 287, 288, 289, 290, 291 and 292 to the 30 Judicial Department in Part II to the Judicial Computer 19970H0847B1725 - 216 -
1 Augmentation Account during the month of June 1998. No transfer 2 may create or increase a deficiency in the appropriation from 3 which the transfer is made. Whenever the Supreme Court makes a 4 transfer under this subsection, the Supreme Court shall give 5 written notification to the chairman and minority chairman of 6 the Senate Committee on Appropriations and the chairman and the 7 minority chairman of the House of Representatives Committee on 8 Appropriations ten days prior to any transfer which shall also 9 include certification that such transfer will not result in a 10 deficit in any appropriation. 11 (b) The Supreme Court may transfer funds appropriated in 12 section 281 between the line items in that section provided that 13 no transfer may create or increase a deficiency in the 14 appropriation from which the transfer is made. Whenever the 15 Supreme Court makes a transfer under this subsection, the 16 Supreme Court shall give written notification to the chairman 17 and minority chairman of the Senate Committee on Appropriations 18 and the chairman and the minority chairman of the House of 19 Representatives Committee on Appropriations ten days prior to 20 any transfer which shall also include certification that such 21 transfer will not result in a deficit in any appropriation. 22 Section 1910. Transfer from Hazardous Sites Cleanup Fund.-- 23 The sum of $12,000,000 is transferred from the Hazardous Sites 24 Cleanup Fund to the Industrial Sites Cleanup Fund. 25 Section 1911. Transfer to Tax Stabilization Reserve Fund.-- 26 If sufficient funds are available, the sum of $100,000,000 shall 27 be transferred to the Tax Stabilization Reserve Fund from the 28 ending balance at the close of the fiscal year ending June 30, 29 1997. 30 PART XX 19970H0847B1725 - 217 -
