AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1997, to June 30, 1998, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1997; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Ownership Fund to the 14 Executive Department; to provide appropriations from the 15 Judicial Computer System Augmentation Account to the Judicial 16 Department; to provide appropriations from the Motor License 17 Fund for the fiscal year July 1, 1997, to June 30, 1998, for 18 the proper operation of the several departments of the 19 Commonwealth and the Pennsylvania State Police authorized to 20 spend Motor License Fund moneys; to provide for the 21 appropriation of Federal funds to the Executive and Judicial 22 Departments of the Commonwealth and for the establishment of 23 restricted receipt accounts for the fiscal year July 1, 1997, 24 to June 30, 1998, and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 1997. 26 TABLE OF CONTENTS 27 PART I. 1 The General Assembly of the Commonwealth of Pennsylvania 2 hereby enacts as follows: 3 PART I 4 GENERAL PROVISIONS 5 Section 101. Short title.--This act shall be known and may 6 be cited as the General Appropriation Act of 1997. 7 Section 102. Definitions.--The following words and phrases 8 when used in this act shall have the meanings given to them in 9 this section unless the context clearly indicates otherwise: 10 "Employees." Includes all directors, superintendents, bureau 11 or division chiefs, assistant directors, assistant 12 superintendents, assistant chiefs, experts, scientists, 13 engineers, surveyors, draftsmen, accountants, secretaries, 14 auditors, inspectors, examiners, analysts, statisticians, 15 marshals, clerks, stenographers, bookkeepers, messengers and 16 other assistants in any department, board or commission. 17 "Expenses" and "maintenance." Includes all printing, binding 18 and stationery, food and forage, materials and supplies, 19 traveling expenses, training, motor vehicle supplies and 20 repairs, freight, express and cartage, postage, telephones and 21 telegraph rentals and toll charges, newspaper advertising and 22 notices, public advertising by or through any medium, fuel, 23 light, heat, power and water, minor construction and renovation, 24 repairs or reconstruction of equipment, buildings and 25 facilities, rent of real estate and equipment, premiums on 26 workers' compensation, insurance premiums on policies of 27 liability insurance, insurance premiums on medical payment 28 insurance and surety bonds for volunteer workers, premiums on 29 employee group life insurance and employee and retired employee 30 group hospital and medical insurance, payment of Commonwealth 19970H0847B0949 - 7 -
1 share of Social Security taxes and unemployment compensation 2 costs for State employees, the purchase of replacement or 3 additional equipment and machinery and all other incidental 4 costs and expenses, including payment to the Department of 5 General Services of mileage and other charges for the use of 6 automobiles and rental payments for permanently assigned 7 automobiles and of expenses or costs of services incurred 8 through the Purchasing Fund. The term "expenses" also shall 9 include the medical costs for the treatment of inmates of State 10 institutions when the inmate must be transferred to an outside 11 hospital: Provided, That in no case shall the State institution 12 pay more for patient care than that provided under the State 13 medical assistance program. 14 Section 103. Abbreviations.--The following abbreviations 15 when used in this act shall have the meanings given to them in 16 this section unless the context clearly indicates otherwise: 17 "ADA." 1 be necessary, are hereby specifically appropriated from the 2 General Fund to the several hereinafter named agencies of the 3 Executive, Legislative and Judicial Departments of the 4 Commonwealth for the payment of salaries, wages or other 5 compensation and travel expenses of the duly elected or 6 appointed officers and employees of the Commonwealth, for the 7 payment of fees for contractual services rendered, for the 8 purchase or rental of goods and services, printing, public 9 advertising by or through any medium, equipment, land and 10 buildings and for payment of any other expenses, as provided by 11 law or by this act, necessary for the proper conduct of the 12 duties, functions and activities and for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 1997, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 1997. 16 (b) State Lottery Fund.--The following sums set forth in 17 this act, or as much thereof as may be necessary, are hereby 18 specifically appropriated from the State Lottery Fund to the 19 several hereinafter named agencies of the Executive Department 20 of the Commonwealth for the payment of salaries, wages or other 21 compensation and travel expenses of the duly appointed officers 22 and employees of the Commonwealth, for the payment of fees for 23 contractual services rendered, for the purchase or rental of 24 goods and services and for payment of any other expenses, as 25 provided by law or by this act, necessary for the proper conduct 26 of the duties, functions and activities and for the purposes 27 hereinafter set forth for the fiscal year beginning July 1, 28 1997, and for the payment of bills incurred and remaining unpaid 29 at the close of the fiscal year ending June 30, 1997. 30 (c) Energy Conservation and Assistance Fund.--The following 19970H0847B0949 - 10 -
1 sums set forth in this act, or as much thereof as may be 2 necessary, are hereby specifically appropriated from the Energy 3 Conservation and Assistance Fund to the several hereinafter 4 named agencies of the Executive Department of the Commonwealth 5 for the payment of fees for contractual services rendered, for 6 the purchase or rental of goods and services and for the payment 7 of any other expenses, as provided by law or by this act, 8 necessary for the proper conduct of the duties, functions and 9 activities and for the purposes hereinafter set forth for the 10 fiscal year beginning July 1, 1997, and for the payment of bills 11 incurred and remaining unpaid at the close of the fiscal year 12 ending June 30, 1997. 13 (d) Judicial Computer System Augmentation Account.--The 14 following sums set forth in this act, or as much thereof as may 15 be necessary, are hereby specifically appropriated from the 16 restricted receipt account established within the General Fund, 17 known as the Judicial Computer System Augmentation Account, to 18 the Judicial Department of the Commonwealth for the payment of 19 fees for contractual services rendered, for the purchase or 20 rental of goods and services and for the payment of any other 21 expenses, as provided by law or by this act, necessary for the 22 proper conduct of the duties, functions and activities and for 23 the purposes hereinafter set forth for the fiscal year beginning 24 July 1, 1997, and for the payment of bills incurred and 25 remaining unpaid at the close of the fiscal year ending June 30, 26 1997. 27 (e) Emergency Medical Services Operating Fund.--The 28 following sums set forth in this act, or as much thereof as may 29 be necessary, are hereby specifically appropriated from the 30 Emergency Medical Services Operating Fund to the several 19970H0847B0949 - 11 -
1 hereinafter named agencies of the Executive Department of the 2 Commonwealth for the payment of fees for contractual services 3 rendered, for the purchase or rental of goods and services and 4 for the payment of any other expenses, as provided by law or by 5 this act, necessary for the proper conduct of the duties, 6 functions and activities and for the purposes hereinafter set 7 forth for the fiscal year beginning July 1, 1997, and for the 8 payment of bills incurred and remaining unpaid at the close of 9 the fiscal year ending June 30, 1997. 10 (f) The State Stores Fund.--The following sums set forth in 11 this act, or as much thereof as may be necessary, are hereby 12 specifically appropriated from The State Stores Fund to the 13 hereinafter named agency of the Executive Department of the 14 Commonwealth for the payment of salaries, wages or other 15 compensation and travel expenses of the duly appointed officers 16 and employees of the Commonwealth, for the payment of fees for 17 contractual services rendered, for the purchase or rental of 18 goods and services and for the payment of any other expenses, as 19 provided by law or by this act, necessary for the proper conduct 20 of the duties, functions and activities and for the purposes 21 hereinafter set forth for the fiscal year beginning July 1, 22 1997, and for the payment of bills incurred and remaining unpaid 23 at the close of the fiscal year ending June 30, 1997. 24 (g) Motor License Fund.--The following sums, or as much 25 thereof as may be necessary, are hereby appropriated from the 26 Motor License Fund to the hereinafter named agencies of the 27 Commonwealth for the payment of salaries, wages and other 28 compensation and travel expenses of the duly elected or 29 appointed officers and employees of the Commonwealth, for 30 contractual services and other expenses necessary for the proper 19970H0847B0949 - 12 -
1 conduct of the duties, functions and activities for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 1997, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 1997. 5 (h) Aviation Restricted Revenue Account.--The following 6 sums, or as much thereof as may be necessary, are hereby 7 appropriated from the Aviation Restricted Revenue Account in the 8 Motor License Fund to the hereinafter named agencies of the 9 Commonwealth for the purposes set forth herein for the fiscal 10 year beginning July 1, 1997, and for the payment of bills 11 incurred and remaining unpaid at the close of the fiscal year 12 ending June 30, 1997. 13 (i) Hazardous Material Response Fund.--The following sums 14 set forth in this act, or as much thereof as may be necessary, 15 are hereby specifically appropriated from the Hazardous Material 16 Response Fund to the several hereinafter named agencies of the 17 Executive Department of the Commonwealth for the payment of fees 18 for contractual services rendered, for the purchase or rental of 19 goods and services and for the payment of any other expenses, as 20 provided by law or by this act, necessary for the proper conduct 21 of the duties, functions and activities and for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 1997, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 1997. 25 (j) Milk Marketing Fund.--The following sums set forth in 26 this act, or as much thereof as may be necessary, are hereby 27 specifically appropriated from the Milk Marketing Fund to the 28 several hereinafter named agencies of the Executive Department 29 of the Commonwealth for the payment of salaries, wages or other 30 compensation and travel expenses of the duly appointed officers 19970H0847B0949 - 13 -
1 and employees of the Commonwealth, for the payment of fees for 2 contractual services rendered, for the purchase or rental of 3 goods and services and for the payment of any other expenses, as 4 provided by law or by this act, necessary for the proper conduct 5 of the duties, functions and activities and for the purposes 6 hereinafter set forth for the fiscal year beginning July 1, 7 1997, and for the payment of bills incurred and remaining unpaid 8 at the close of the fiscal year ending June 30, 1997. 9 (k) Home Investment Trust Fund.--The following sums set 10 forth in this act, or as much thereof as may be necessary, are 11 hereby specifically appropriated from the Home Investment Trust 12 Fund to the hereinafter named agencies of the Executive 13 Department of the Commonwealth for the payment of salaries, 14 wages or other compensation and travel expenses of the duly 15 appointed officers and employees of the Commonwealth, for the 16 payment of fees for contractual services rendered, for the 17 purchase or rental of goods and services and for the payment of 18 any other expenses, as provided by law or by this act, necessary 19 for the proper conduct of the duties, functions and activities 20 and for the purposes hereinafter set forth for the fiscal year 21 beginning July 1, 1997, and for the payment of bills incurred 22 and remaining unpaid at the close of the fiscal year ending June 23 30, 1997. 24 (l) Ben Franklin/IRC Partnership Fund.--The following sums 25 set forth in this act, or as much thereof as may be necessary, 26 are hereby appropriated from the Ben Franklin/IRC Partnership 27 Fund to the hereinafter named agencies of the Executive 28 Department of the Commonwealth for the payment of salaries, 29 wages or other compensation and travel expenses of the duly 30 appointed officers and employees of the Commonwealth, for the 19970H0847B0949 - 14 -
1 payment of fees for contractual services rendered, for the 2 purchase or rental of goods and services and for the payment of 3 any other expenses, as provided by law or by this act, necessary 4 for the proper conduct of the duties, functions and activities 5 and for the purposes hereinafter set forth for the fiscal year 6 beginning July 1, 1997, and for the payment of bills incurred 7 and remaining unpaid at the close of the fiscal year ending June 8 30, 1997. 9 (m) Tuition Payment Fund.--The following sums set forth in 10 this act, or as much thereof as may be necessary, are hereby 11 appropriated from the Tuition Payment Fund to the hereinafter 12 named agencies of the Executive Department of the Commonwealth 13 for the payment of salaries, wages or other compensation and 14 travel expenses of the duly appointed officers and employees of 15 the Commonwealth, for the payment of fees for contractual 16 services rendered, for the purchase or rental of goods and 17 services and for the payment of any other expenses, as provided 18 by law or by this act, necessary for the proper conduct of the 19 duties, functions and activities and for the purposes 20 hereinafter set forth for the fiscal year beginning July 1, 21 1997, and for the payment of bills incurred and remaining unpaid 22 at the close of the fiscal year ending June 30, 1997. 23 (n) Banking Department Fund.--The following sums set forth 24 in this act, or as much thereof as may be necessary, are hereby 25 specifically appropriated from the Banking Department Fund to 26 the hereinafter named agencies of the Executive Department of 27 the Commonwealth for the payment of salaries, wages or other 28 compensation and travel expenses of the duly appointed officers 29 and employees of the Commonwealth, for the payment of fees for 30 contractual services rendered, for the purchase or rental of 19970H0847B0949 - 15 -
1 goods and services and for the payment of any other expenses, as 2 provided by law or by this act, necessary for the proper conduct 3 of the duties, functions and activities and for the purposes 4 hereinafter set forth for the fiscal year beginning July 1, 5 1997, and for the payment of bills incurred and remaining unpaid 6 at the close of the fiscal year ending June 30, 1997. 7 (o) Firearm Ownership Fund.--The following sums set forth in 8 this act, or as much thereof as may be necessary, are hereby 9 specifically appropriated from the Firearm Ownership Fund to the 10 hereinafter named agencies of the Executive Department of the 11 Commonwealth for the payment of salaries, wages or other 12 compensation and travel expenses of the duly appointed officers 13 and employees of the Commonwealth, for the payment of fees for 14 contractual services rendered, for the purchase or rental of 15 goods and services and for the payment of any other expenses, as 16 provided by law or by this act, necessary for the proper conduct 17 of the duties, functions and activities and for the purposes 18 hereinafter set forth for the fiscal year beginning July 1, 19 1997, and for the payment of bills incurred and remaining unpaid 20 at the close of the fiscal year ending June 30, 1997. 21 Section 105. Job Training Partnership Act appropriations.-- 4 The following sums set forth in this act, or as much thereof as 5 may be necessary, are hereby appropriated from the Job Training 6 Partnership Act (JTPA) funds to the several hereinafter named 7 agencies of the Executive Department of the Commonwealth for the 8 payment of the expenses of implementing and carrying out the 9 program stated herein for the fiscal year beginning July 1, 10 1997. 11 Section 107. Block grants.--(a) Appropriation.--The 12 following sums set forth in this act, or as much thereof as may 13 be necessary, are hereby specifically appropriated from the 14 block grant (BG) funds to the several hereinafter named agencies 15 of the Executive Department of the Commonwealth for the 16 purposes, and under the restrictions, for which the funds are 17 provided for the fiscal year beginning July 1, 1997. 18 (b) Small Communities Development Block Grant.--The Small 19 Communities Development Block Grant (SCDBG) is to assist small 20 cities and communities that have a high concentration of 21 impoverished citizens and substandard housing to expand their 22 low-income and moderate-income housing opportunities and to meet 23 community development needs. 24 (c) Community Services Block Grant.--The Community Services 25 Block Grant (CSBG) is to provide a range of services and 26 activities having a measurable and potentially major impact on 27 the causes of poverty in the community or those areas of the 28 community where poverty is a particularly acute problem. In 29 addition, new focus may be placed on the unemployed, both old 30 and new. Local agencies may lower their eligibility requirements 19970H0847B0949 - 17 -
1 for recipients to three months to allow greater flexibility to 2 assure proper consideration of each recipient. 3 (d) Preventive Health and Health Services Block Grant.--The 4 Preventive Health and Health Services Block Grant (PHHSBG) is 5 for the provision of preventive health and other health services 6 related to emergency medical systems, health initiative grants, 7 comprehensive public health, hypertension, fluoridation, health 8 education, risk reduction, home health, rape crisis, domestic 9 violence services and rodent control. 10 (e) Maternal and Child Health Services Block Grant.--The 11 Maternal and Child Health Services Block Grant (MCHSBG) is to 12 enable states to maintain and strengthen their leadership in 13 planning, promoting, coordinating and evaluating health care for 14 pregnant women, mothers, infants and children, and children with 15 special health care needs, and in providing health services for 16 mothers and children who do not have access to adequate health 17 care. 18 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 19 Income Home Energy Assistance Block Grant (LIHEABG) is to help 20 lessen the impact of the high cost of energy on low-income 21 families and individuals, including energy efficiency grants for 22 low-income dwellings. 23 (g) Social Services Block Grant.--The Social Services Block 24 Grant (SSBG) is for the provision of social services to eligible 25 persons. 26 (h) Child Care and Development Block Grant.--The Child Care 27 and Development Block Grant (CCDBG) is for the provision of 28 direct child care or to increase the availability of child care 29 for low-income families. 30 (i) Mental Health Services Block Grant.--The Mental Health 19970H0847B0949 - 18 -

1 Commonwealth or the programs herein provided shall be paid into 2 the General Fund. 3 Section 1702. Limitation on encumbering or spending Federal 4 funds.--Federal funds shall be encumbered or spent only to the 5 extent that such funds are estimated as being available during 6 the fiscal year of the Commonwealth. 7 Section 1703. Appropriation of prior unspent Federal 8 funds.--Any Federal money which has been previously appropriated 9 by the General Assembly and authorized or allocated by the 10 Federal Government but remains unspent from prior fiscal years 11 and will not be renewed for fiscal year 1997-1998 is hereby 12 appropriated. 13 Section 1704. Subgrants between Federal fund 14 appropriations.--With the exception of Federal money received 15 under JTPA and SSBG, subgrants may be made between 16 appropriations without further approval of the General Assembly. 17 The Secretary of the Budget shall submit a list of subgrants to 18 the Chairmen of the House and Senate Appropriations Committees 19 quarterly. No subgrant to a State agency, however, may be made 20 from a restricted receipt account without a specific 21 appropriation by the General Assembly. 22 Section 1705. Utilization of emergency Federal funds.--(a) 23 Federal funds available for costs and damages resulting from 24 natural disasters or civil disobedience may be added to an 25 appropriation contained in this act or to funds appropriated or 26 may be used for the purposes prescribed by the Federal 27 Government. 28 (b) In addition to the moneys appropriated by this act, all 29 moneys received from the Federal Government for the purpose of 30 disaster assistance or relief shall be paid into the General 19970H0847B0949 - 179 -
1 Fund and are hereby appropriated out of the General Fund to the 2 departments, boards, commissions or agencies designated by the 3 Governor. 4 (c) In the event of any emergency situation in which the 5 General Assembly cannot act in sufficient time, the Governor is 6 authorized through executive authorization to provide up to 7 $10,000,000 in Federal funds to alleviate the emergency 8 situation. For the purposes of this section, "emergency" is 9 defined as any situation in which there is a chance of or which 10 may result in substantial human suffering. 11 Section 1706. Transfer of funds from TANFBG to CCDFBG.--In 12 accordance with Federal law which permits the transfer of up to 13 30% of the TANFBG to the CCDFBG and the transfer of up to one- 14 third of such transferred funds to the SSBG, the Department of 15 Public Welfare, upon approval of the Secretary of the Budget, 16 may make such transfers of funds provided that any such transfer 17 will not result in a deficit in any appropriation from which 18 funds are transferred. The Secretary of the Budget shall provide 19 notification of any such transfers to the majority chairman and 20 the minority chairman of the Appropriations Committee of the 21 Senate and the majority chairman and minority chairman of the 22 Appropriations Committee of the House of Representatives ten 23 days prior to any transfer which shall also include 24 certification that such transfer will not result in a deficit in 25 any appropriation. 26 PART XVIII 27 MISCELLANEOUS PROVISIONS FOR 1997-1998 28 Section 1801. Prior laws unaffected.--Except as provided in 29 section 253, this act is not intended to be inconsistent with or 30 to repeal any provision of any act enacted at this or any prior 19970H0847B0949 - 180 -
1 session of the General Assembly regulating the purchase of 2 supplies, the ordering of printing and binding, the purchase, 3 maintenance and use of automobiles, the method of making 4 payments from the State Treasury for any purpose or the 5 functioning of any administrative department, board or 6 commission. 7 Section 1802. Compliance with other law before funds 8 available.--No appropriation made by this act to any department, 9 board, commission or agency of the Executive Department shall be 10 available unless and until the department, board, commission or 11 agency has complied with sections 615 and 616 of the act of 12 April 9, 1929 (P.L.177, No.175), known as The Administrative 13 Code of 1929. 14 Section 1803. Contracts prerequisite to encumbering or 15 committing funds.--Funds for the purchase of supplies, materials 16 and equipment shall not be deemed to be committed or encumbered 17 until contracts covering the purchase have been entered into 18 with the vendors. 19 Section 1804. Minority business set-asides.--(a) Each 20 department or other instrumentality of the Commonwealth listed 21 in Subpart A of Part II authorized to contract for buildings, 22 highways, commodities, equipment, supplies or services shall 23 report to the General Assembly all information pertinent to 24 anticipated procurement needs at the beginning of each fiscal 25 year and each fiscal quarter thereafter. 26 (b) As used in this section, the term "minority business" 27 means a minority business enterprise as defined in the act of 28 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 29 Minority Business Development Authority Act. 30 Section 1805. Appropriation of funds from miscellaneous 19970H0847B0949 - 181 -
1 sources.--(a) In addition to the amounts appropriated by this 2 act, moneys received in payment for food and household supplies 3 furnished to employees and other persons, except inmates, by an 4 institution, and moneys received from the proceeds from the sale 5 of any products of the soil, meats, livestock, timber or other 6 materials sold by the department shall be paid into the General 7 Fund and are hereby appropriated out of the General Fund to the 8 several respective institutions for the operation and 9 maintenance of the institutions. 10 (b) In addition to the amounts appropriated by this act, all 11 moneys received from any other source, except the Federal 12 Government, as contributions for the programs provided herein or 13 as payment for services or materials furnished by one 14 institution to another, except those collections designated as 15 revenues, shall be paid into the General Fund and are hereby 16 appropriated out of the General Fund for the purposes of the 17 respective appropriations. 18 (c) In addition to any funds specifically appropriated by 19 this act, all moneys received by a department or agency of the 20 Commonwealth from any other sources, except the Federal 21 Government, as contributions or supplements to the department or 22 agency for a program or administration of an act included in 23 this act shall be paid into the General Fund and credited to the 24 appropriation for that program or administration of the act. 25 Section 1806. Lapsing of unused funds.--(a) Except as 26 otherwise provided by law or by this section, that part of all 27 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 28 XI, XII, XIII, XIV and XV unexpended, uncommitted or 29 unencumbered as of June 30, 1998, shall automatically lapse as 30 of that date. 19970H0847B0949 - 182 -
1 (b) The appropriations in Part II to the Legislative 2 Department shall be continuing appropriations. 3 Section 1807. Appellate courts appropriation contingency.-- 4 The funds appropriated in Part II to the Supreme, Superior and 5 Commonwealth Courts for justice expenses are contingent upon a 6 vouchered expense account plan being continued by the Supreme 7 Court. 8 Section 1808. Transfer of excess funds.--The Governor may 9 transfer any excess money in those funds receiving proceeds of 10 Commonwealth of Pennsylvania general obligation bonds in excess 11 of the amount necessary for the purposes for which the bonds 12 were issued to the appropriate sinking fund for payment of debt 13 service due on outstanding bonds. If such excess funds, together 14 with any available balance, exceed the amount of debt service 15 remaining to be paid, the funds shall be transferred to the 16 General Fund or to the appropriate special fund responsible for 17 such debt service. 18 Section 1809. Transfer of funds by the Supreme Court.--The 19 Supreme Court may transfer any excess funds appropriated to the 20 Judicial Department in Part II to the Judicial Computer 21 Augmentation Account during the month of June 1998. No transfer 22 may create or increase a deficiency in the appropriation from 23 which the transfer is made. 24 Section 1810. Transfer from Hazardous Sites Cleanup Fund.-- 25 The sum of $12,000,000 is transferred from the Hazardous Sites 26 Cleanup Fund to the Industrial Sites Cleanup Fund. 27 PART XIX 28 EFFECTIVE DATE 29 Section 1901.
