                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, requiring fish bait dealer licensees to retail fish
     3     bait in biodegradable containers.

     4     The Commonwealth of Pennsylvania has an inherent right as a
     5  sovereign State and a constitutional duty to prevent the
     6  degradation of its lakes and waterways by pollution and litter.
     7  Discarded fish bait containers are a major part of the offensive
     8  and potentially polluting litter found along the lakes and
     9  waterways of this Commonwealth. The use of biodegradable fish
    10  bait containers would have a major impact on the amount of
    11  potentially polluting litter found in this Commonwealth.
    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 3309 of Title 30 of the Pennsylvania
    15  Consolidated Statutes is amended by adding a subsection to read:
    16  § 3309.  Live bait fish, live fish bait and live fish dealers
    17                 licenses.

     2     (f)  Biodegradable containers.--On and after January 1, 1998,
     3  all fish bait dealer licensees shall only retail fish bait in
     4  biodegradable containers of a type approved by the commission.
     5  Each sale by a licensee in violation of this subsection shall
     6  constitute a separate offense. A violation of this subsection is
     7  a summary offense of the first degree.
     8     Section 2.  This act shall take effect in 60 days.
