        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, APRIL 8, 1997

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for vehicle registration periods
     3     of less than one year; and making appropriations.              <--

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1307(a.1) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1307.  Period of registration.
     9     * * *
    10     (a.1)  Seasonal registration.--Upon application on a form
    11  prescribed by the department, the owner or lessee of a passenger
    12  car, RECREATIONAL MOTOR VEHICLE, motorcycle, truck or farm        <--
    13  vehicle which does not have a gross vehicle weight rating of
    14  more than 9,000 pounds or the owner or lessee of a motor home as  <--
    15  defined in section 102 (relating to definitions) may register
    16  the vehicle with the department for a period of successive


     1  months of less than one year. The applicant shall specify the
     2  period of months during which the vehicle shall be registered.
     3  Except when the department initially converts a currently valid
     4  annual registration to a seasonal registration, the annual fee
     5  prescribed for the vehicle by Chapter 19 (relating to fees)
     6  shall be paid in full by the applicant regardless of the number
     7  of months chosen for registration by the applicant. Upon receipt
     8  of the appropriate fee and the properly completed form,
     9  including all information required by this chapter, the
    10  department shall issue a seasonal registration that shall expire
    11  on the last day of the expiration month chosen by the
    12  registrant. No insurer of a vehicle belonging to any owner or
    13  lessee who obtains a seasonal registration and who applies for
    14  or receives a reduced automobile insurance premium on account
    15  thereof shall be required to provide any contractual coverage,
    16  whether in the form of the provision of a defense or the payment
    17  of first-party or third-party benefits or otherwise, to the
    18  owner or lessee in connection with any event occurring during
    19  that part of the year in which the vehicle is not registered;
    20  and such owner or lessee shall be treated for all purposes,
    21  including, without limitation, ascertaining rights to stack
    22  coverages and to uninsured and underinsured motorist coverage,
    23  as a person who does not own that vehicle and has no duty to
    24  carry financial responsibility on it for that part of the year.

    26     Section 2.  (a)  In addition to any other appropriations or    <--
    27  executive authorizations for State highway maintenance for the
    28  1996-1997 fiscal year, the sum of $50,000,000 is hereby
    29  appropriated from the Motor License Fund to the Department of
    30  Transportation for State highway maintenance surface

     1  improvement. Twenty-five million dollars of this appropriation
     2  shall be allocated to each county based on its percentage of
     3  lane miles to the total lane miles of all State highways. The
     4  remaining $25,000,000 shall be allocated to each county based on
     5  its percentage of vehicle miles traveled to the total vehicle
     6  miles traveled on all State highways. These funds shall be
     7  targeted to those highways having poorest road quality in each
     8  county as determined by the department. This shall be a two-year
     9  continuing appropriation.
    10     (b)  In addition to any other revenues received by the Public
    11  Transportation Assistance Fund, the sum of $25,000,000 is hereby
    12  appropriated to that fund from the General Fund for the 1996-
    13  1997 fiscal year to be distributed in a manner consistent with
    14  74 Pa.C.S. Ch. 13. This appropriation may be used for capital
    15  projects or asset maintenance at the discretion of the transit
    16  entities.
    17     Section 3 2.  This act shall take effect immediately.          <--
