A SUPPLEMENT
1 To the act of July 6, 1995 (P.L. , No.38), entitled "An act
2 providing for the capital budget for the fiscal year 1995-
3 1996," itemizing public highway projects to be constructed by
4 the Department of Transportation from current revenue in the
5 Motor License Fund and stating the estimated useful life of
6 the projects.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Short title.
10 This act shall be known and may be cited as the Special
11 Session Capital Budget Act of 1996 for Flood Damaged Highways.
12 Section 2. Authorization.
13 The total authorization for the capital projects in the
14 category of highway projects itemized in sections 4 through 70
15 and to be constructed by the Department of Transportation, its
1 successors or assigns, and to be financed from the current
2 revenue of the Motor License Fund, shall be $14,770,000.
3 Section 3. Itemization of highway projects.
4 Additional capital projects in the category of public highway
5 projects to be constructed by the Department of Transportation,
6 its successors or assigns, and to be financed from current
7 revenue of the Motor License Fund, are hereby itemized, together
8 with their respective estimated financial costs, in the
9 following sections.

19 The General Assembly states the estimated useful life of the
20 projects heretofore itemized is 30 years.
21 Section 72. Federal funds.
22 All moneys received from the Federal Government for the
23 construction of the public highway projects specifically
24 itemized herein are also hereby appropriated for those projects.
25 Section 73. Construction.
26 Amounts contained in this act for any project shall not
27 supplant or replace any Federal funds authorized by any Federal
28 law or regulation. Funding from this act for any project is
29 available only to the extent that Federal funds are not
30 available for such project.

1 Section 74. Allocation of funds.
2 Whenever as determined by the Department of Transportation
3 that the full estimated financial costs of the projects itemized
4 in sections 4 through 70 are not necessary for the proper
5 design, acquisition or construction of such projects, the excess
6 funds no longer required may be allocated by the Department of
7 Transportation to increase the estimated costs of any one or
8 more of the projects specifically itemized in a capital budget.
9 Section 75. Effective date.
10 This act shall take effect immediately.
