A SUPPLEMENT
1 To the act of (P.L. , No. ), JULY 6, 1995 <--
2 (P.L.269, NO.38), entitled "An act providing for the capital
3 budget for the fiscal year 1995-1996," itemizing a public
4 improvement project to be constructed or acquired by the
5 Department of General Services, together with estimated
6 financial costs; authorizing the incurring of debt without
7 the approval of the electors for the purpose of financing the
8 project to be constructed or acquired by the Department of
9 General Services; stating the estimated useful life of the
10 project; and making an appropriation.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. Short title.
14 This act shall be known and may be cited as the 1995 Special
15 Session Somerset Hospital Conversion Security Project
16 Itemization Act.
17 Section 2. Total authorization.
18 The total authorization for the additional capital project in
19 the category of public improvement projects itemized in section
20 3 and to be constructed or acquired by the Department of General
21 Services, its successors or assigns, and to be financed by the
1 incurring of debt, shall be $1,900,000. 2 Section 3. Itemization of public improvement projects. 3 The additional capital project in the category of public 4 improvement projects to be constructed or acquired by the 5 Department of General Services, its successors or assigns, and 6 to be financed by the incurring of debt, is hereby itemized, 7 together with their respective ITS estimated financial costs, as <-- 8 follows: 9 Total 10 Project 11 Project Allocation 12 (1) Department of Corrections $1,900,000 13 (i) Somerset State Hospital - Somerset County 14 (A) Conversion of hospital to a State 15 Correctional Institution through the 16 purchase and installation of two 17 perimeter fences and the installation 18 of an electronic detection system along 19 the entire perimeter 1,900,000 20 (Base Project Allocation - $1,584,000) 21 (Design and Contingencies - $316,000) 22 Section 4. Debt authorization. 23 The Governor, the Auditor General and the State Treasurer are 24 hereby authorized and directed to borrow, from time to time, in 25 addition to any authorization heretofore or hereafter enacted, 26 on the credit of the Commonwealth, subject to the limitations 27 provided in the current capital budget, money not exceeding in 28 the aggregate the sum of $1,900,000 as may be found necessary to 29 carry out the construction or acquisition of the public 30 improvement project specifically itemized in a capital budget <-- 19951S0109B0156 - 2 -
1 HEREIN. <-- 2 Section 5. Issue of bonds. 3 The indebtedness authorized in this act shall be incurred, 4 from time to time, and shall be evidenced by one or more series 5 of general obligation bonds of the Commonwealth in such 6 aggregate principal amount for each series as the Governor, 7 Auditor General and State Treasurer shall determine, but the 8 latest stated maturity date shall not exceed the estimated 9 useful life of the project being financed as stated in section 10 6. 11 Section 6. Estimated useful life and term of debt. 12 (a) Estimated useful life.--The General Assembly states that 13 the estimated useful life of the projects PROJECT itemized in <-- 14 this act is 30 years. 15 (b) Term of debt.--The maximum term of the debt authorized 16 to be incurred under this act is 30 years. 17 Section 7. Appropriation. 18 The net proceeds of the sale of the obligations authorized in 19 this act are hereby appropriated from the Capital Facilities 20 Fund to the Department of General Services in the maximum amount 21 of $1,900,000 to be used by it exclusively to defray the 22 financial cost of the public improvement project specifically 23 itemized in a capital budget HEREIN. After reserving or paying <-- 24 the expenses of the sale of the obligation, the State Treasurer 25 shall pay to the Department of General Services the moneys as 26 required and certified by it to be legally due and payable. 27 Section 8. Federal funds. 28 In addition to those funds appropriated in section 7, all 29 moneys received from the Federal Government for the project 30 specifically itemized in this act are also appropriated for this 19951S0109B0156 - 3 -
1 project. 2 Section 9. Editorial changes. <-- 3 In editing and preparing this act for printing following the 4 final enactment, the Legislative Reference Bureau shall insert 5 or revise letters or numbers for projects where the letters or 6 numbers are missing or require revision. The Bureau shall also 7 revise the total monetary amounts for the total authorization, 8 debt authorization, appropriations and departmental totals as 9 necessary to agree with the total monetary amounts of the 10 projects. 11 Section 10 9.
