AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1996, to June 30, 1997, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1996; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund and 13 the Banking Department Fund to the Executive Department; to 14 provide appropriations from the Judicial Computer System 15 Augmentation Account to the Judicial Department; to provide 16 appropriations from the Motor License Fund for the fiscal 17 year July 1, 1996, to June 30, 1997, for the proper operation 18 of the several departments of the Commonwealth and the 19 Pennsylvania State Police authorized to spend Motor License 20 Fund moneys; to provide for the appropriation of Federal 21 funds to the Executive and Judicial Departments of the 22 Commonwealth and for the establishment of restricted receipt 23 accounts for the fiscal year July 1, 1996, to June 30, 1997, 24 and for the payment of bills remaining unpaid at the close of 25 the fiscal year ending June 30, 1996; to provide for the 26 additional appropriation of State and Federal funds for the 27 Executive and Judicial Departments of the Commonwealth for 28 the fiscal year July 1, 1995, to June 30, 1996, and for the 29 payment of bills incurred and remaining unpaid at the close 30 of the fiscal year ending June 30, 1995. 31 TABLE OF CONTENTS 32 PART I. Effective date. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 PART I 7 GENERAL PROVISIONS 8 Section 101. Short title.--This act shall be known and may 9 be cited as the General Appropriation Act of 1996. 10 Section 102. Definitions.--The following words and phrases 11 when used in this act shall have the meanings given to them in 12 this section unless the context clearly indicates otherwise: 13 "Employees." Includes all directors, superintendents, bureau 14 or division chiefs, assistant directors, assistant 15 superintendents, assistant chiefs, experts, scientists, 16 engineers, surveyors, draftsmen, accountants, secretaries, 17 auditors, inspectors, examiners, analysts, statisticians, 18 marshals, clerks, stenographers, bookkeepers, messengers and 19 other assistants in any department, board or commission. 20 "Expenses" and "maintenance." Includes all printing, binding 21 and stationery, food and forage, materials and supplies, 22 traveling expenses, training, motor vehicle supplies and 23 repairs, freight, express and cartage, postage, telephones and 24 telegraph rentals and toll charges, newspaper advertising and 25 notices, public advertising by or through any medium, fuel, 26 light, heat, power and water, minor construction and renovation, 27 repairs or reconstruction of equipment, buildings and 28 facilities, rent of real estate and equipment, premiums on 29 workers' compensation, insurance premiums on policies of 30 liability insurance, insurance premiums on medical payment 19960S1583B2212 - 10 -
1 insurance and surety bonds for volunteer workers, premiums on 2 employee group life insurance and employee and retired employee 3 group hospital and medical insurance, payment of Commonwealth 4 share of Social Security taxes and unemployment compensation 5 costs for State employees, the purchase of replacement or 6 additional equipment and machinery and all other incidental 7 costs and expenses, including payment to the Department of 8 General Services of mileage and other charges for the use of 9 automobiles and rental payments for permanently assigned 10 automobiles and of expenses or costs of services incurred 11 through the Purchasing Fund. The term "expenses" also shall 12 include the medical costs for the treatment of inmates of State 13 institutions when the inmate must be transferred to an outside 14 hospital: Provided, That in no case shall the State institution 15 pay more for patient care than that provided under the State 16 medical assistance program. 17 Section 103. Abbreviations.--The following abbreviations 18 when used in this act shall have the meanings given to them in 19 this section unless the context clearly indicates otherwise: 20 "ADA." 1 following sums set forth in this act, or as much thereof as may 2 be necessary, are hereby specifically appropriated from the 3 General Fund to the several hereinafter named agencies of the 4 Executive, Legislative and Judicial Departments of the 5 Commonwealth for the payment of salaries, wages or other 6 compensation and travel expenses of the duly elected or 7 appointed officers and employees of the Commonwealth, for the 8 payment of fees for contractual services rendered, for the 9 purchase or rental of goods and services, printing, public 10 advertising by or through any medium, equipment, land and 11 buildings and for payment of any other expenses, as provided by 12 law or by this act, necessary for the proper conduct of the 13 duties, functions and activities and for the purposes 14 hereinafter set forth for the fiscal year beginning July 1, 15 1996, and for the payment of bills incurred and remaining unpaid 16 at the close of the fiscal year ending June 30, 1996. 17 (b) State Lottery Fund.--The following sums set forth in 18 this act, or as much thereof as may be necessary, are hereby 19 specifically appropriated from the State Lottery Fund to the 20 several hereinafter named agencies of the Executive Department 21 of the Commonwealth for the payment of salaries, wages or other 22 compensation and travel expenses of the duly appointed officers 23 and employees of the Commonwealth, for the payment of fees for 24 contractual services rendered, for the purchase or rental of 25 goods and services and for payment of any other expenses, as 26 provided by law or by this act, necessary for the proper conduct 27 of the duties, functions and activities and for the purposes 28 hereinafter set forth for the fiscal year beginning July 1, 29 1996, and for the payment of bills incurred and remaining unpaid 30 at the close of the fiscal year ending June 30, 1996. 19960S1583B2212 - 13 -
1 (c) Energy Conservation and Assistance Fund.--The following 2 sums set forth in this act, or as much thereof as may be 3 necessary, are hereby specifically appropriated from the Energy 4 Conservation and Assistance Fund to the several hereinafter 5 named agencies of the Executive Department of the Commonwealth 6 for the payment of fees for contractual services rendered, for 7 the purchase or rental of goods and services and for the payment 8 of any other expenses, as provided by law or by this act, 9 necessary for the proper conduct of the duties, functions and 10 activities and for the purposes hereinafter set forth for the 11 fiscal year beginning July 1, 1996, and for the payment of bills 12 incurred and remaining unpaid at the close of the fiscal year 13 ending June 30, 1996. 14 (d) Judicial Computer System Augmentation Account.--The 15 following sums set forth in this act, or as much thereof as may 16 be necessary, are hereby specifically appropriated from the 17 restricted receipt account established within the General Fund, 18 known as the Judicial Computer System Augmentation Account, to 19 the Judicial Department of the Commonwealth for the payment of 20 fees for contractual services rendered, for the purchase or 21 rental of goods and services and for the payment of any other 22 expenses, as provided by law or by this act, necessary for the 23 proper conduct of the duties, functions and activities and for 24 the purposes hereinafter set forth for the fiscal year beginning 25 July 1, 1996, and for the payment of bills incurred and 26 remaining unpaid at the close of the fiscal year ending June 30, 27 1996. 28 (e) Emergency Medical Services Operating Fund.--The 29 following sums set forth in this act, or as much thereof as may 30 be necessary, are hereby specifically appropriated from the 19960S1583B2212 - 14 -
1 Emergency Medical Services Operating Fund to the several 2 hereinafter named agencies of the Executive Department of the 3 Commonwealth for the payment of fees for contractual services 4 rendered, for the purchase or rental of goods and services and 5 for the payment of any other expenses, as provided by law or by 6 this act, necessary for the proper conduct of the duties, 7 functions and activities and for the purposes hereinafter set 8 forth for the fiscal year beginning July 1, 1996, and for the 9 payment of bills incurred and remaining unpaid at the close of 10 the fiscal year ending June 30, 1996. 11 (f) The State Stores Fund.--The following sums set forth in 12 this act, or as much thereof as may be necessary, are hereby 13 specifically appropriated from The State Stores Fund to the 14 hereinafter named agency of the Executive Department of the 15 Commonwealth for the payment of salaries, wages or other 16 compensation and travel expenses of the duly appointed officers 17 and employees of the Commonwealth, for the payment of fees for 18 contractual services rendered, for the purchase or rental of 19 goods and services and for the payment of any other expenses, as 20 provided by law or by this act, necessary for the proper conduct 21 of the duties, functions and activities and for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 1996, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 1996. 25 (g) Motor License Fund.--The following sums, or as much 26 thereof as may be necessary, are hereby appropriated from the 27 Motor License Fund to the hereinafter named agencies of the 28 Commonwealth for the payment of salaries, wages and other 29 compensation and travel expenses of the duly elected or 30 appointed officers and employees of the Commonwealth, for 19960S1583B2212 - 15 -
1 contractual services and other expenses necessary for the proper 2 conduct of the duties, functions and activities for the purposes 3 hereinafter set forth for the fiscal year beginning July 1, 4 1996, and for the payment of bills incurred and remaining unpaid 5 at the close of the fiscal year ending June 30, 1996. 6 (h) Aviation Restricted Revenue Account.--The following 7 sums, or as much thereof as may be necessary, are hereby 8 appropriated from the Aviation Restricted Revenue Account in the 9 Motor License Fund to the hereinafter named agencies of the 10 Commonwealth for the purposes set forth herein for the fiscal 11 year beginning July 1, 1996, and for the payment of bills 12 incurred and remaining unpaid at the close of the fiscal year 13 ending June 30, 1996. 14 (i) Hazardous Material Response Fund.--The following sums 15 set forth in this act, or as much thereof as may be necessary, 16 are hereby specifically appropriated from the Hazardous Material 17 Response Fund to the several hereinafter named agencies of the 18 Executive Department of the Commonwealth for the payment of fees 19 for contractual services rendered, for the purchase or rental of 20 goods and services and for the payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 1996, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 1996. 26 (j) Milk Marketing Fund.--The following sums set forth in 27 this act, or as much thereof as may be necessary, are hereby 28 specifically appropriated from the Milk Marketing Fund to the 29 several hereinafter named agencies of the Executive Department 30 of the Commonwealth for the payment of salaries, wages or other 19960S1583B2212 - 16 -

In 16 addition, new focus may be placed on the unemployed, both old 17 and new. Local agencies may lower their eligibility requirements 18 for recipients to three months to allow greater flexibility to 19 assure proper consideration of each recipient. 20 (d) Preventive Health and Health Services Block Grant.--The 21 Preventive Health and Health Services Block Grant (PHHSBG) is 22 for the provision of preventive health and other health services 23 related to emergency medical systems, health initiative grants, 24 comprehensive public health, hypertension, fluoridation, health 25 education, risk reduction, home health, rape crisis, domestic 26 violence services and rodent control. 27 (e) Maternal and Child Health Services Block Grant.--The 28 Maternal and Child Health Services Block Grant (MCHSBG) is to 29 enable states to maintain and strengthen their leadership in 30 planning, promoting, coordinating and evaluating health care for 19960S1583B2212 - 20 -

1 payable to each county shall be 2 determined by the proportion of the 3 individual county's population in 4 relation to the population of the 5 entire judicial district. No county 6 shall be reimbursed for costs above 7 the actual direct costs, excluding 8 capital outlays, incurred by them for 9 the operation of the courts of common 10 pleas. Appropriation of funds from miscellaneous 15 sources.--(a) In addition to the amounts appropriated by this 16 part, moneys received in payment for food and household supplies 17 furnished to employees and other persons, except to inmates, by 18 an institution, and moneys received from the proceeds from the 19 sale of any products of the soil, meats, livestock, timber or 20 other materials sold by the department shall be paid into the 21 General Fund and are hereby appropriated out of the General Fund 22 to the several respective institutions for the operation and 23 maintenance of the institution. 24 (b) In addition to the amounts appropriated by this part, 25 all moneys received from any other source, except the Federal 26 Government, as contributions for the programs provided herein or 27 as payment for services or materials furnished by one 28 institution to another, except those collections designated as 29 revenues, shall be paid into the General Fund and are hereby 30 appropriated out of the General Fund for the purposes of the 19960S1583B2212 - 199 -
1 respective appropriations. 2 (c) In addition to any funds specifically appropriated by 3 this part, all moneys received by a department or agency of the 4 Commonwealth from any other source, except the Federal 5 Government, as contributions or supplements to the department or 6 agency for a program or administration of an act included in 7 this part shall be paid into the General Fund and credited to 8 the appropriation for that program or administration of the act. 9 Section 1656. Lapsing of unused funds.--Except as otherwise 10 provided by law, that part of all appropriations in Subparts B, 11 C and D of this part unexpended, uncommitted or unencumbered as 12 of June 30, 1996, shall automatically lapse as of that date. 13 Section 1657. Transfer of funds by the Supreme Court.--The 14 Supreme Court may transfer any excess funds appropriated to the 15 Judicial Department in Part II of the act of June 30, 1995 16 (P.L.749, No.5A), known as the General Appropriation Act of 17 1995, and Subpart C to the Judicial Computer Augmentation 18 Account during the month of June 1996. No transfer may create or 19 increase a deficiency in the appropriation from which the 20 transfer is made. 21 Section 1658. Construction with prior appropriation acts.-- 22 Any appropriation in Subparts B, C and D of this part which is 23 the same or similar to any appropriation in the act of June 30, 24 1995 (P.L.749, No.5A), known as the General Appropriation Act of 25 1995, and in section 18 of the act of May 16, 1996 (P.L.175, 26 No.35), shall replace that appropriation. 27 Section 1659. Deduction of expended appropriations under 28 prior law.--Any money that has been appropriated and expended 29 under the act of June 30, 1995 (P.L.749, No.5A), known as the 30 General Appropriation Act of 1995, shall be deducted from the 19960S1583B2212 - 200 -
1 corresponding appropriation in this part. 2 Section 1660. Repeal of certain appropriations.--The 3 following appropriations in section 206 of the act of June 30, 4 1995 (P.L.749, No.5A), known as the General Appropriation Act of 5 1995, are repealed: 6 (1) Council of State Governments. 7 (2) National Conference of State Legislatures. 8 (3) Council of State Governments for the State and Local 9 Legal Center. 10 (4) Governmental Accounting Standards Board. 11 (5) Advisory Commission of Intergovernmental Relations. 12 (6) National Governors' Association. 13 (7) Coalition of Northeastern Governors. 14 (8) Northeast-Midwest Institute. 15 PART XVII 16 SPECIAL PROVISIONS FOR FEDERAL FUNDS 17 FOR 1996-1997 18 Section 1701. General Fund repository for Federal funds.-- 19 All moneys received from the Federal Government as contributions 20 or supplements to the departments or agencies of the 21 Commonwealth or the programs herein provided shall be paid into 22 the General Fund. 23 Section 1702. Limitation on encumbering or spending Federal 24 funds.--Federal funds shall be encumbered or spent only to the 25 extent that such funds are estimated as being available during 26 the fiscal year of the Commonwealth. 27 Section 1703. Appropriation of prior unspent Federal 28 funds.--Any Federal money which has been previously appropriated 29 by the General Assembly and authorized or allocated by the 30 Federal Government but remains unspent from prior fiscal years 19960S1583B2212 - 201 -
1 and will not be renewed for fiscal year 1996-1997 is hereby 2 appropriated. 3 Section 1704. Subgrants between Federal fund 4 appropriations.--With the exception of Federal money received 5 under JTPA and SSBG, subgrants may be made between 6 appropriations without further approval of the General Assembly. 7 The Secretary of the Budget shall submit a list of subgrants to 8 the Chairmen of the House and Senate Appropriations Committees 9 quarterly. No subgrant to a State agency, however, may be made 10 from a restricted receipt account without a specific 11 appropriation by the General Assembly. 12 Section 1705. Utilization of emergency Federal funds.--(a) 13 Federal funds available for costs and damages resulting from 14 natural disasters or civil disobedience may be added to an 15 appropriation contained in this act or to funds appropriated or 16 may be used for the purposes prescribed by the Federal 17 Government. 18 (b) In addition to the moneys appropriated by this act, all 19 moneys received from the Federal Government for the purpose of 20 disaster assistance or relief shall be paid into the General 21 Fund and are hereby appropriated out of the General Fund to the 22 departments, boards, commissions or agencies designated by the 23 Governor. 24 (c) In the event of any emergency situation in which the 25 General Assembly cannot act in sufficient time, the Governor is 26 authorized through executive authorization to provide up to 27 $5,000,000 in Federal funds to alleviate the emergency 28 situation. 1 otherwise provided by law or by this section, that part of all 2 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 3 XI, XII, XIII and XIV unexpended, uncommitted or unencumbered as 4 of June 30, 1997, shall automatically lapse as of that date. 5 (b) The appropriations in Part II to the Legislative 6 Department shall be continuing appropriations. 7 Section 1807. Transfer of funds from Pennsylvania Economic 8 Revitalization Fund.--All loan repayments and other revenues, 9 lapses and unencumbered funds in the Pennsylvania Economic 10 Revitalization Fund are transferred to the General Fund. All 11 interest earned on moneys in the fund shall be transferred to 12 the Pennsylvania Economic Revitalization Sinking Fund. 13 Section 1808. Appellate courts appropriation contingency.-- 14 The funds appropriated in Part II to the Supreme, Superior and 15 Commonwealth Courts for justice expenses are contingent upon a 16 vouchered expense account plan being continued by the Supreme 17 Court. 18 Section 1809. Transfer of excess funds.--The Governor may 19 transfer any excess money in those funds receiving proceeds of 20 Commonwealth of Pennsylvania general obligation bonds in excess 21 of the amount necessary for the purposes for which the bonds 22 were issued to the appropriate sinking fund for payment of debt 23 service due on outstanding bonds. If such excess funds, together 24 with any available balance, exceed the amount of debt service 25 remaining to be paid, the funds shall be transferred to the 26 General Fund or to the appropriate special fund responsible for 27 such debt service. 28 Section 1810. 1 loans.--All moneys received from the sale, pledge or other 2 alienation of Sunny Day Fund receivables shall be deposited into 3 the general obligation debt service appropriation in the General 4 Fund. 5 Section 1812. Transfer of funds by the Supreme Court.--The 6 Supreme Court may transfer any excess funds appropriated to the 7 Judicial Department in Part II to the Judicial Computer 8 Augmentation Account during the month of June 1997. No transfer 9 may create or increase a deficiency in the appropriation from 10 which the transfer is made. 11 PART XIX 12 EFFECTIVE DATE 13 Section 1901. Effective date.--This act shall take effect as 14 follows: 15 (1) Part XVI shall take effect immediately. 16 (2) This section shall take effect immediately. 17 (3) The remainder of this act shall take effect July 1, 18 1996, or immediately, whichever is later.
