Effective date. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 PART I 16 GENERAL PROVISIONS 17 Section 101. Short title.--This act shall be known and may 18 be cited as the General Appropriation Act of 1996. 19 Section 102. Definitions.--The following words and phrases 20 when used in this act shall have the meanings given to them in 21 this section unless the context clearly indicates otherwise: 22 "Employees." Includes all directors, superintendents, bureau 23 or division chiefs, assistant directors, assistant 24 superintendents, assistant chiefs, experts, scientists, 25 engineers, surveyors, draftsmen, accountants, secretaries, 26 auditors, inspectors, examiners, analysts, statisticians, 27 marshals, clerks, stenographers, bookkeepers, messengers and 28 other assistants in any department, board or commission. 29 "Expenses" and "maintenance." Includes all printing, binding 30 and stationery, food and forage, materials and supplies, 19960S1583B2074 - 5 -
1 traveling expenses, training, motor vehicle supplies and 2 repairs, freight, express and cartage, postage, telephones and 3 telegraph rentals and toll charges, newspaper advertising and 4 notices, public advertising by or through any medium, fuel, 5 light, heat, power and water, minor construction and renovation, 6 repairs or reconstruction of equipment, buildings and 7 facilities, rent of real estate and equipment, premiums on 8 workers' compensation, insurance premiums on policies of 9 liability insurance, insurance premiums on medical payment 10 insurance and surety bonds for volunteer workers, premiums on 11 employee group life insurance and employee and retired employee 12 group hospital and medical insurance, payment of Commonwealth 13 share of Social Security taxes and unemployment compensation 14 costs for State employees, the purchase of replacement or 15 additional equipment and machinery and all other incidental 16 costs and expenses, including payment to the Department of 17 General Services of mileage and other charges for the use of 18 automobiles and rental payments for permanently assigned 19 automobiles and of expenses or costs of services incurred 20 through the Purchasing Fund. The term "expenses" also shall 21 include the medical costs for the treatment of inmates of State 22 institutions when the inmate must be transferred to an outside 23 hospital: Provided, That in no case shall the State institution 24 pay more for patient care than that provided under the State 25 medical assistance program. 26 Section 103. Abbreviations.--The following abbreviations 27 when used in this act shall have the meanings given to them in 28 this section unless the context clearly indicates otherwise: 29 "ADA." State appropriations.--The following sums set 13 forth in this act, or as much thereof as may be necessary, are 14 hereby specifically appropriated from the General Fund to the 15 several hereinafter named agencies of the Executive, Legislative 16 and Judicial Departments of the Commonwealth for the payment of 17 salaries, wages or other compensation and travel expenses of the 18 duly elected or appointed officers and employees of the 19 Commonwealth, for the payment of fees for contractual services 20 rendered, for the purchase or rental of goods and services, 21 printing, public advertising by or through any medium, 22 equipment, land and buildings and for payment of any other 23 expenses, as provided by law or by this act, necessary for the 24 proper conduct of the duties, functions and activities and for 25 the purposes hereinafter set forth for the fiscal year beginning 26 July 1, 1996, and for the payment of bills incurred and 27 remaining unpaid at the close of the fiscal year ending June 30, 28 1996. 29 Section 105. Federal augmentation appropriations.--The 30 following Federal augmentation appropriations set forth in this 19960S1583B2074 - 8 -
1 act, or as much thereof as may be necessary, are hereby 2 specifically appropriated from the Federal augmentation funds to 3 the several hereinafter named agencies of the Executive and 4 Judicial Departments of the Commonwealth for the payment of the 5 expenses of implementing and carrying out the programs stated 6 herein for the fiscal year beginning July 1, 1996, and for the 7 payment of bills incurred and remaining unpaid at the close of 8 the fiscal year ending June 30, 1996. Unless otherwise stated, 9 the appropriations include any carryovers from the prior fiscal 10 year. 11 Section 106. Job Training Partnership Act appropriations.-- 12 The following sums set forth in this act, or as much thereof as 13 may be necessary, are hereby appropriated from the Job Training 14 Partnership Act (JTPA) funds to the several hereinafter named 15 agencies of the Executive Department of the Commonwealth for the 16 payment of the expenses of implementing and carrying out the 17 program stated herein for the fiscal year beginning July 1, 18 1996. 19 Section 107. Block grants.--(a) Appropriation.--The 20 following sums set forth in this act, or as much thereof as may 21 be necessary, are hereby specifically appropriated from the 22 block grant (BG) funds to the several hereinafter named agencies 23 of the Executive Department of the Commonwealth for the 24 purposes, and under the restrictions, for which the funds are 25 provided for the fiscal year beginning July 1, 1996. 26 (b) Small Communities Development Block Grant.--The Small 27 Communities Development Block Grant (SCDBG) is to assist small 28 cities and communities that have a high concentration of 29 impoverished citizens and substandard housing to expand their 30 low-income and moderate-income housing opportunities and to meet 19960S1583B2074 - 9 -
1 community development needs. 2 (c) Community Services Block Grant.--The Community Services 3 Block Grant (CSBG) is to provide a range of services and 4 activities having a measurable and potentially major impact on 5 the causes of poverty in the community or those areas of the 6 community where poverty is a particularly acute problem. In 7 addition, new focus may be placed on the unemployed, both old 8 and new. Local agencies may lower their eligibility requirements 9 for recipients to three months to allow greater flexibility to 10 assure proper consideration of each recipient. 11 (d) Education Consolidation and Improvement Block Grant.-- 12 The Education Consolidation and Improvement Block Grant (ECIBG) 13 will be used for the administration and provision of education 14 programs in accordance with the requirements of the Improving 15 America's Schools Act of 1994. 16 (e) Preventive Health and Health Services Block Grant.--The 17 Preventive Health and Health Services Block Grant (PHHSBG) is 18 for the provision of preventive health and other health services 19 related to emergency medical systems, health initiative grants, 20 comprehensive public health, hypertension, fluoridation, health 21 education, risk reduction, home health, rape crisis, domestic 22 violence services and rodent control. 23 (f) Maternal and Child Health Services Block Grant.--The 24 Maternal and Child Health Services Block Grant (MCHSBG) is to 25 enable states to maintain and strengthen their leadership in 26 planning, promoting, coordinating and evaluating health care for 27 pregnant women, mothers, infants and children, and children with 28 special health care needs, and in providing health services for 29 mothers and children who do not have access to adequate health 30 care. 19960S1583B2074 - 10 -
1 (g) Low-Income Home Energy Assistance Block Grant.--The Low- 2 Income Home Energy Assistance Block Grant (LIHEABG) is to help 3 lessen the impact of the high cost of energy on low-income 4 families and individuals, including energy efficiency grants for 5 low-income dwellings. 6 (h) Social Services Block Grant.--The Social Services Block 7 Grant (SSBG) is for the provision of social services to eligible 8 persons. 9 (i) Child Care and Development Block Grant.--The Child Care 10 and Development Block Grant (CCDBG) is for the provision of 11 direct child care or to increase the availability of child care 12 for low-income families. 13 (j) Mental Health Services Block Grant.--The Mental Health 14 Services Block Grant (MHSBG) provides funds for the provision of 15 services to adults with serious mental illness or children with 16 serious emotional disturbance. 17 (k) Substance Abuse Block Grant.--The Substance Abuse Block 18 Grant (SABG) provides funds to establish and maintain programs 19 to combat alcohol and drug abuse. 20 PART II 21 GENERAL FUND AND FEDERAL APPROPRIATIONS 22 FOR 1996-1997 23 SUBPART A 24 EXECUTIVE DEPARTMENT 25 Section 201. 1 whether filled or vacant within a 2 judicial district, $70,000 per 3 authorized position shall be provided. 4 Judicial districts comprising more 5 than one county shall be entitled to 6 receive $70,000 per authorized common 7 pleas court judge position; the amount 8 payable to each county shall be 9 determined by the proportion of the 10 individual county's population in 11 relation to the population of the 12 entire judicial district. No county 13 shall be reimbursed for costs above 14 the actual direct costs, excluding 15 capital outlays, incurred by them for 16 the operation of the courts of common 17 pleas. For the purposes of 18 reimbursement for common pleas court 19 judge authorized positions, no county 20 shall receive less than 75% of the 21 actual reimbursement for court costs 22 provided to them from funds 23 appropriated for the fiscal year July 24 1, 1980, to June 30, 1981. 25 For the purpose of determining the 26 actual direct costs incurred by the 27 counties in the administration and 28 operation of the courts of common 29 pleas, the costs as reported to the 30 Center for Local Government Services 19960S1583B2074 - 145 -
1 in the county's annual audit and 2 financial report forms under the 3 heading "(a) Judicial," but confined 4 to the subheading "(4184) courts, 5 excluding capital outlay," shall be 6 used. If a city coterminous with a 7 county does not report on the Center 8 for Local Government Services' form, 9 its figures from the same subheading, 10 set forth in the center forms, shall 11 be used. 12 All payments for reimbursement 13 shall be made to the county treasurer 14 and, in cities of the first class 15 coterminous with counties of the first 16 class, to the city treasurer. 17 In making allocations and payments 18 hereunder, the Court Administrator of 19 Pennsylvania shall exclude all costs 20 which are not properly reportable 21 under the heading herein above 22 specified. 23 State appropriation........ 29,071,000 24 PART III 25 RESTRICTED RECEIPT ACCOUNTS 26 Section 301. 1 Section 401. General Fund repository for Federal funds.--All 2 moneys received from the Federal Government as contributions or 3 supplements to the departments or agencies of the Commonwealth 4 or the programs herein provided shall be paid into the General 5 Fund. 6 Section 402. Limitation on encumbering or spending Federal 7 funds.--Federal funds shall be encumbered or spent only to the 8 extent that such funds are estimated as being available during 9 the fiscal year of the Commonwealth. 10 Section 403. Appropriation of prior unspent Federal funds.-- 11 Any Federal money which has been previously appropriated by the 12 General Assembly and authorized or allocated by the Federal 13 Government but remains unspent from prior fiscal years and will 14 not be renewed for fiscal year 1996-1997 is hereby appropriated. 15 Section 404. Subgrants between Federal fund 16 appropriations.--With the exception of Federal money received 17 under JTPA and SSBG, subgrants may be made between 18 appropriations without further approval of the General Assembly. 19 The Secretary of the Budget shall submit a list of subgrants to 20 the Chairmen of the House and Senate Appropriations Committees 21 quarterly. No subgrant to a State agency, however, may be made 22 from a restricted receipt account without a specific 23 appropriation by the General Assembly. 24 Section 405. Utilization of emergency Federal funds.--(a) 25 Federal funds available for costs and damages resulting from 26 natural disasters or civil disobedience may be added to an 27 appropriation contained in this act or to funds appropriated or 28 may be used for the purposes prescribed by the Federal 29 Government. 30 (b) In addition to the moneys appropriated by this act, all 19960S1583B2074 - 149 -
1 moneys received from the Federal Government for the purpose of 2 disaster assistance or relief shall be paid into the General 3 Fund and are hereby appropriated out of the General Fund to the 4 departments, boards, commissions or agencies designated by the 5 Governor. 6 (c) In the event of any emergency situation in which the 7 General Assembly cannot act in sufficient time, the Governor is 8 authorized through executive authorization to provide up to 9 $5,000,000 in Federal funds to alleviate the emergency 10 situation. For the purposes of this section, "emergency" is 11 defined as any situation in which there is a chance of or which 12 may result in substantial human suffering. 13 PART V 14 MISCELLANEOUS PROVISIONS FOR 1996-1997 15 Section 501. Prior laws unaffected.--Except as provided in 16 section 253, this act is not intended to be inconsistent with or 17 to repeal any provision of any act enacted at this or any prior 18 session of the General Assembly regulating the purchase of 19 supplies, the ordering of printing and binding, the purchase, 20 maintenance and use of automobiles, the method of making 21 payments from the State Treasury for any purpose or the 22 functioning of any administrative department, board or 23 commission. 24 Section 502. Compliance with other law before funds 25 available.--No appropriation made by this act to any department, 26 board, commission or agency of the Executive Department shall be 27 available unless and until the department, board, commission or 28 agency has complied with sections 615 and 616 of the act of 29 April 9, 1929 (P.L.177, No.175), known as The Administrative 30 Code of 1929. 19960S1583B2074 - 150 -
1 Section 503. Contracts prerequisite to encumbering or 2 committing funds.--Funds for the purchase of supplies, materials 3 and equipment shall not be deemed to be committed or encumbered 4 until contracts covering the purchase have been entered into 5 with the vendors. 6 Section 504. Minority business set-asides.--(a) Each 7 department or other instrumentality of the Commonwealth listed 8 in Subpart A of Part II authorized to contract for buildings, 9 highways, commodities, equipment, supplies or services shall 10 report to the General Assembly all information pertinent to 11 anticipated procurement needs at the beginning of each fiscal 12 year and each fiscal quarter thereafter. 13 (b) As used in this section, the term "minority business" 14 means a minority business enterprise as defined in the act of 15 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 16 Minority Business Development Authority Act. 17 Section 505. Appropriation of funds from miscellaneous 18 sources.--(a) In addition to the amounts appropriated by this 19 act, moneys received in payment for food and household supplies 20 furnished to employees and other persons, except inmates, by an 21 institution, and moneys received from the proceeds from the sale 22 of any products of the soil, meats, livestock, timber or other 23 materials sold by the department shall be paid into the General 24 Fund and are hereby appropriated out of the General Fund to the 25 several respective institutions for the operation and 26 maintenance of the institutions. 27 (b) In addition to the amounts appropriated by this act, all 28 moneys received from any other source, except the Federal 29 Government, as contributions for the programs provided herein or 30 as payment for services or materials furnished by one 19960S1583B2074 - 151 -
1 institution to another, except those collections designated as 2 revenues, shall be paid into the General Fund and are hereby 3 appropriated out of the General Fund for the purposes of the 4 respective appropriations. 5 (c) In addition to any funds specifically appropriated by 6 this act, all moneys received by a department or agency of the 7 Commonwealth from any other sources, except the Federal 8 Government, as contributions or supplements to the department or 9 agency for a program or administration of an act included in 10 this act shall be paid into the General Fund and credited to the 11 appropriation for that program or administration of the act. 12 Section 506. Lapsing of unused funds.--(a) Except as 13 otherwise provided by law or by this section, that part of all 14 appropriations in Parts II and III unexpended, uncommitted or 15 unencumbered as of June 30, 1997, shall automatically lapse as 16 of that date. 17 (b) The appropriations in Part II to the Legislative 18 Department shall be continuing appropriations. 19 Section 507. Transfer of funds from Pennsylvania Economic 20 Revitalization Fund.--All loan repayments and other revenues, 21 lapses and unencumbered funds in the Pennsylvania Economic 22 Revitalization Fund are transferred to the General Fund. All 23 interest earned on moneys in the fund shall be transferred to 24 the Pennsylvania Economic Revitalization Sinking Fund. 25 Section 508. Appellate courts appropriation contingency.-- 26 The funds appropriated in Part II to the Supreme, Superior and 27 Commonwealth Courts for justice expenses are contingent upon a 28 vouchered expense account plan being continued by the Supreme 29 Court. 30 Section 509. Transfer of excess funds.--The Governor may 19960S1583B2074 - 152 -
1 transfer any excess money in those funds receiving proceeds of 2 Commonwealth of Pennsylvania general obligation bonds in excess 3 of the amount necessary for the purposes for which the bonds 4 were issued to the appropriate sinking fund for payment of debt 5 service due on outstanding bonds. If such excess funds, together 6 with any available balance, exceed the amount of debt service 7 remaining to be paid, the funds shall be transferred to the 8 General Fund or to the appropriate special fund responsible for 9 such debt service. 10 Section 510. Proceeds of sale of Sunny Day Fund loans.-- 11 Moneys received from the sale, pledge or other alienation of 12 Sunny Day Fund receivables shall be deposited as follows: 13 Proceeds up to $60,000,000 shall be divided equally among the 14 customized job training program, the Industrial Development 15 Authority Fund, the Opportunity Fund and the infrastructure 16 development program. Any proceeds in excess of $60,000,000 shall 17 be deposited into the General Fund. 18 PART VI 19 EFFECTIVE DATE 20 Section 601.
