                                     AN ACT

     1  Amending the act of October 21, 1988 (P.L.1036, No.116),
     2     entitled "An act establishing the Hardwoods Development
     3     Council; conferring powers and duties upon the council; and
     4     making an appropriation," further providing for membership.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4 of the act of October 21, 1988
     8  (P.L.1036, No.116), known as the Hardwoods Development Council
     9  Act, is amended to read:
    10  Section 4.  Council.
    11     (a)  Composition.--The Hardwoods Development Council is
    12  established within the department. The council shall include,
    13  but not be limited to, the following [21] 23 members:
    14         (1)  [Four] Five members:
    15             (i)  The Secretary of Agriculture.
    16             (ii)  The Secretary of Commerce.
    17             (iii)  The Secretary of [Environmental] Conservation
    18         and Natural Resources.
    19             (iv)  The State Forester.

     1             (v)  The Secretary of Transportation.
     2         (2)  Four legislative members:
     3             (i)  Two senators, one appointed by the President pro
     4         tempore of the Senate and one appointed by the Minority
     5         Leader of the Senate.
     6             (ii)  Two representatives, one appointed by the
     7         Speaker of the House of Representatives and one appointed
     8         by the Minority Leader of the House of Representatives.
     9         (3)  [Thirteen] Fourteen public members appointed by the
    10     Governor:
    11             (i)  One representative of an agricultural college
    12         from a State-related university.
    13             (ii)  One representative of the Forest Service of the
    14         Federal Department of Agriculture.
    15             (iii)  One representative of furniture manufacturers.
    16             (iv)  One representative of veneer manufacturers.
    17             (v)  Two representatives of secondary processors.
    18             (vi)  Two representatives of nonprofit corporations
    19         which have the purpose to promote and enhance the
    20         hardwood industry in this Commonwealth.
    21             (vii)  One representative of the Pennsylvania Chamber
    22         of Business and Industry.
    23             (viii)  One representative of the Pennsylvania
    24         Forestry Association.
    25             (ix)  One representative of the Pennsylvania Hardwood
    26         Lumber Manufacturing Association.
    27             (x)  One representative of pulp and paper
    28         manufacturers.
    29             (xi)  One representative of the saw mill operators.
    30             (xii)  One representative of a local governing

     1         organization.
     2     (b)  Term of office.--
     3         (1)  Members under subsection (a)(1) shall serve as long
     4     as they are in office.
     5         (2)  Legislative members under subsection (a)(2) shall
     6     serve terms of two years.
     7         (3)  Public members under subsection (a)(3) shall serve
     8     the following terms:
     9             (i)  Public members under subsection (a)(3)(vi)
    10         through (ix) shall serve terms of two years.
    11             (ii)  Public members under subsection (a)(3)(iii)
    12         through (v), (x) [and], (xi) and (xii) shall serve terms
    13         of three years.
    14             (iii)  Public members under subsection (a)(3)(i) and
    15         (ii) shall serve terms of four years.
    16     (c)  Designees.--Members under subsection (a)(1) and
    17  legislative members under subsection (a)(2) may appoint
    18  designees to serve on the council.
    19     (d)  Vacancies.--Vacancies in office shall be filled by the
    20  appointing authority who made the original appointment.
    21     (e)  Officers.--The Secretary of Commerce or his designee
    22  shall serve as the chairperson, and the council shall elect
    23  other officers as it deems necessary.
    24     (f)  Meetings.--The council shall meet quarterly and shall
    25  hold special meetings at the call of the chairperson. A simple
    26  majority shall constitute a quorum.
    27     (g)  Compensation.--Members of the council shall serve
    28  without compensation.
    29     Section 2.  This act shall take effect immediately.
