                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for antique and classic motor
     3     vehicles; providing for vintage motor vehicles and for
     4     production motor vehicles; and providing for an annual fee
     5     for personal registration plates.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The definitions of "antique motor vehicle" and
     9  "classic motor vehicle" in section 102 of Title 75 of the
    10  Pennsylvania Consolidated Statutes are amended and the section
    11  is amended by adding definitions to read:
    12  § 102.  Definitions.
    13     Subject to additional definitions contained in subsequent
    14  provisions of this title which are applicable to specific
    15  provisions of this title, the following words and phrases when
    16  used in this title shall have, unless the context clearly
    17  indicates otherwise, the meanings given to them in this section:

    19     "Antique motor vehicle."  A motor vehicle, but not a

     1  reproduction thereof, manufactured in 1936 or thereafter and
     2  more than 25 years prior to the current year which has been
     3  maintained in or restored to a condition which is substantially
     4  in conformance with manufacturer specifications and appearance.
     5     * * *
     6     "Classic motor vehicle."  A motor vehicle, but not a
     7  reproduction thereof, [manufactured at least ten years prior to
     8  the effective date of the amendment to this definition and,
     9  because of limited availability, determined by the department to
    10  be a model or make of significant value to collectors or
    11  exhibitors and] which is included on the list of milestone or
    12  classic cars published by the Milestone Car Society or the
    13  Classic Car Club of America and which has been maintained in or
    14  restored to a condition which is substantially in conformity
    15  with manufacturer specifications and appearance[, provided that,
    16  five years from the effective date of the amendment to this
    17  definition and thereafter, only a vehicle which was manufactured
    18  at least 15 years prior thereto and, because of limited
    19  availability, determined by the department to be a model or make
    20  of significant value to collectors or exhibitors and which has
    21  been maintained in or restored to condition which is
    22  substantially in conformity with manufacturer specifications and
    23  appearance shall be considered a classic motor vehicle under
    24  this title. Any classic motor vehicle registered under section
    25  1340 (relating to antique and classic plates) on the effective
    26  date of the amendment to this definition which fails to qualify
    27  as a classic motor vehicle pursuant to these provisions may
    28  retain such classic registration unless another type of
    29  registration is applied for and issued for the vehicle].

     1     "Pioneer motor vehicle."  A motor vehicle, but not a
     2  reproduction thereof, manufactured before 1916 which has been
     3  maintained in or restored to a condition which is substantially
     4  in conformity with manufacturer specifications and appearance.
     5     * * *
     6     "Production motor vehicle."  A motor vehicle, but not a
     7  reproduction thereof, manufactured more than ten years prior to
     8  the current year, which has been maintained in or restored to a
     9  condition which is substantially in conformity with manufacturer
    10  specifications and appearance.

    12     "Vintage motor vehicle."  A motor vehicle, but not a
    13  reproduction thereof, manufactured after 1915 and before 1936
    14  which has been maintained in or restored to a condition which is
    15  substantially in conformance with manufacturer specifications
    16  and appearance.

    18     Section 2.  Section 1307(e) of Title 75 is repealed.
    19     Section 3.  Sections 1340, 1923, 1931, 4303(e) and
    20  4703(b)(10) of Title 75 are amended to read:
    21  § 1340.  Antique [and classic], classic, pioneer, production and
    22             vintage plates.
    23     (a)  General rule.--Upon submission by a vehicle owner of
    24  information satisfactory to the department that a motorcycle or
    25  motor vehicle is an antique classic, pioneer, production or
    26  vintage motorcycle or motor vehicle or classic motorcycle or
    27  motor vehicle, accompanied by the appropriate initial
    28  registration fee, the department may issue a special [plates]
    29  plate for the motorcycle or vehicle. No annual registration fee
    30  may be charged for antique [or classic], classic, pioneer or

     1  vintage motorcycles or motor vehicles.
     2     (b)  Use of plates.--It is unlawful for any person to operate
     3  a motorcycle or vehicle with antique [or classic], classic,
     4  pioneer or vintage registration plates for general daily
     5  transportation. Permitted use shall be limited to participation
     6  in club activities, exhibits, tours, parades, occasional
     7  transportation and similar uses. Occasional transportation shall
     8  mean no more than one day per week.
     9     (c)  Pioneer plate.--A pioneer plate shall be made of blue
    10  and white porcelain and resemble the 1910 registration plate.
    11     (d)  Vintage plate.--The color of the vintage plate shall be
    12  two-tone green.
    13     (e)  Classic motor vehicle registration.--A motor vehicle
    14  registered as a classic motor vehicle on the effective date of
    15  this subsection may continue to be registered as a classic motor
    16  vehicle, regardless of whether it is included on the list of
    17  milestone or classic cars published by the Milestone Car Society
    18  or the Classic Car Club of America, unless another type of
    19  registration is applied for and issued for the vehicle.
    20  § 1923.  Antique [and classic], classic, pioneer, production and
    21             vintage vehicles.
    22     (a)  Antique, classic and vintage motor vehicles.--The fee
    23  for initial annual registration of an antique [or classic],
    24  classic or vintage motor vehicle shall be $50.
    25     (b)  Pioneer motor vehicles.--The fee for initial annual
    26  registration of a pioneer motor vehicle shall be $75.
    27     (c)  Production motor vehicles.--The fee for issuance of a
    28  production motor vehicle plate shall be $20 which shall be in
    29  addition to the annual registration fee appropriate for the
    30  vehicle type. The issuance fee shall be charged for each

     1  production vehicle registration plate issued or replaced.
     2  § 1931.  Personal registration plates.
     3     The fee for issuance of a personal registration plate shall
     4  be $20 which shall be in addition to the annual registration
     5  fee. [Only one payment of the issuance fee shall be charged for
     6  each personal registration issued or replaced.] The annual fee
     7  to retain use of the personal registration plate shall be $10
     8  which shall be in addition to the annual registration fee
     9  permitted under this title.
    10  § 4303.  General lighting requirements.

    12     (e)  Equipment exempted by regulation.--Antique, classic,
    13  pioneer and vintage motor vehicles, animal-drawn vehicles,
    14  implements of husbandry, commercial implements of husbandry and
    15  special mobile equipment, if operated exclusively between the
    16  hours of sunrise and sunset and not during periods of reduced
    17  visibility or insufficient illumination, may be exempted from
    18  certain lighting equipment requirements of this part by
    19  regulations of the department.
    20  § 4703.  Operation of vehicle without official certificate of
    21             inspection.

    23     (b)  Exceptions.--Subsection (a) does not apply to:

    25         (10)  Antique, classic, pioneer and vintage motor
    26     vehicles.

    28     Section 4.  This act shall take effect in 60 days.
