AS AMENDED ON THIRD CONSIDERATION, FEBRUARY 28, 1995
AN ACT 1 Providing grants for conducting assessments of abandoned 2 industrial sites; establishing a fund; providing for funding; 3 and imposing duties upon the Department of Commerce. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Abandoned 8 Industrial Sites Environmental Assessment Act. 9 Section 2. Grants for conducting environmental assessments of 10 abandoned industrial sites. 11 The Department of Commerce shall make grants to 12 municipalities, municipal or other local authorities, nonprofit 13 economic development agencies and similar agencies to conduct 14 environmental assessments of abandoned industrial sites located 15 in municipalities which have been designated by the Department 16 of Commerce as distressed communities under the act of July 2,
1 1984 (P.L.520, No.105), known as the Business Infrastructure
2 Development Act. Grants shall be made from the Abandoned
3 Industrial Sites Environmental Assessment Fund.
4 Section 3. Abandoned Industrial Sites Environmental Assessment
5 Fund.
6 There is hereby established within the State Treasury a
7 special nonlapsing fund which shall be known as the Abandoned
8 Industrial Sites Environmental Assessment Fund. The fund shall
9 be administered by the Department of Commerce to carry out the
10 purposes of this act. MONEYS IN THE FUND ARE APPROPRIATED, UPON <--
11 THE APPROVAL OF THE GOVERNOR, FOR THE PURPOSES OF THIS ACT.
12 Section 4. Continuing appropriation.
13 The sum of UPON APPROVAL OF THE GOVERNOR, UP TO $1,000,000 <--
14 shall be transferred annually by the State Treasurer from the
15 Hazardous Sites Cleanup Fund to the Abandoned Industrial Sites
16 Environmental Assessment Fund.
17 Section 5. Regulations.
18 The Department of Commerce shall promulgate regulations to
19 implement and administer the provisions of this act.
20 Section 6. Effective date.
21 This act shall take effect in 60 days.
