        INTRODUCED BY COLAFELLA, ITKIN, TRELLO, THOMAS, BELARDI,
           FICHTER, WALKO, ROBERTS, CORRIGAN, STABACK, BATTISTO,
           SCHRODER, M. N. WRIGHT, E. Z. TAYLOR, SHANER, TANGRETTI,
           BOSCOLA, CAPPABIANCA, HESS, MERRY, RAMOS, YOUNGBLOOD AND
           CONTI, OCTOBER 10, 1996

        REFERRED TO COMMITTEE ON RULES, OCTOBER 10, 1996

                                  A RESOLUTION

     1  Urging the Insurance Commissioner to actively monitor compliance
     2     with the Motor Vehicle Physical Damage Appraiser Act.

     3     WHEREAS, The Motor Vehicle Physical Damage Appraiser Act was
     4  enacted in 1972 to insure that the actual cost of automobile
     5  restoration is adequately and fairly covered in the appraisal;
     6  and
     7     WHEREAS, The act emphatically prohibits direct referral,
     8  unrequested recommendations and solicitations of a request from
     9  a claimant for recommendations; and
    10     WHEREAS, The act requires appraisers to discuss the appraisal
    11  with a selected repair facility owner as well as with the owner
    12  of the vehicle; and
    13     WHEREAS, The act provides that all appraisals are to be based
    14  upon personal inspection of the damages and reflect the cost of
    15  restoring the automobile to precollision condition; and
    16     WHEREAS, The Insurance Committee of the House of


     1  Representatives heard testimony from the owners of automobile
     2  repair facilities indicating that the Insurance Department
     3  inadequately monitors compliance with the act; therefore be it
     4     RESOLVED, That the House of Representatives urge the
     5  Insurance Commissioner to actively monitor compliance with the
     6  act and mediate complaints filed by the owners of automobile
     7  repair facilities.
