AN ACT 1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as 2 reenacted and amended, "An act concerning townships of the 3 second class; and amending, revising, consolidating and 4 changing the law relating thereto," providing for 5 appropriations for training fire company personnel. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 1803 of the act of May 1, 1933 (P.L.103, 9 No.69), known as The Second Class Township Code, reenacted and 10 amended November 9, 1995 (P.L.350, No.60), is amended to read: 11 Section 1803. Fire Companies [and], Facilities and 12 Training.--(a) The board of supervisors may appropriate moneys 13 for the use of the township or to fire companies located in the 14 township for the operation and maintenance of fire companies, 15 for the purchase and maintenance of fire apparatus [and], for 16 the construction, repair and maintenance of fire company houses,
1 training of fire company personnel, or, as set forth in this 2 section, for fire training schools or centers in order to secure 3 fire protection for the inhabitants of the township. The fire 4 companies shall submit to the board of supervisors an annual 5 report of the use of the appropriated moneys for each completed 6 year of the township before any further payments may be made to 7 the fire companies for the current year. 8 (b) The board of supervisors may by ordinance make rules and 9 regulations for the government of fire companies which are 10 located within the township and their officers. 11 (c) The board of supervisors may contract with or make 12 grants to near or adjacent municipal corporations or volunteer 13 fire companies therein for fire protection in the township. 14 (d) No volunteer fire company not in existence in the 15 township before the effective date of this act may organize or 16 operate unless the establishment or organization is approved by 17 resolution of the board of supervisors. 18 (e) The board of supervisors may annually appropriate funds 19 to fire companies located within the township for the training 20 of its personnel, or to a countywide council of governments, 21 consortium or other entity established pursuant to the act of 22 July 12, 1972 (P.L.762, No.180), referred to as the 23 Intergovernmental Cooperation Law, lawfully organized or 24 incorporated county or regional firemen's associations to 25 establish, equip, maintain and operate fire training schools or 26 centers for the purpose of giving instruction and practical 27 training in the prevention, control and fighting of fire and 28 related fire department emergencies to the members of fire 29 departments and volunteer fire companies in any city, borough, 30 town or township within the county or region, including 19960H2983B4185 - 2 -
1 township. Whenever a firemen's association is comprised of 2 members from two or more municipalities or contemplates 3 operation of a county or regional school to serve two or more 4 municipalities or two or more counties, the board of supervisors 5 of each township may appropriate funds to the association. Joint 6 activity shall be implemented under the Intergovernmental 7 Cooperation Law. 8 Section 2. This act shall take effect in 60 days. I27L73JS/19960H2983B4185 - 3 -
