                                     AN ACT

     1  Authorizing the State Armory Board of the Department of Military
     2     and Veterans Affairs and the Department of General Services,
     3     with the approval of the Governor, to sell and convey a tract
     4     of land, together with the building and structures thereto,
     5     in the Borough of Mount Pleasant, Westmoreland County,
     6     Pennsylvania.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The State Armory Board of the Department of
    10  Military Affairs having determined in accordance with 51 Pa.C.S.
    11  § 1507 (relating to sale of unusable armories and land; sale or
    12  lease of timber and mineral rights), that the Mount Pleasant
    13  Armory and the real estate to which it is appurtenant is no
    14  longer suitable for military services due to changes in the
    15  needs of the military service, it and the Department of General
    16  Services, acting on behalf of the Commonwealth, with the
    17  approval of the Governor, are hereby authorized to sell and
    18  convey, through sealed bids, by general warranty deed, for a
    19  consideration of the fair market value of the real estate and


     1  structures hereinafter described, to the highest responsible
     2  bidder, its successors and assigns, the right, title and
     3  interest of the Commonwealth in the tract of land, and armory
     4  building known as Mount Pleasant Armory, appurtenant thereto, in
     5  the Borough of Mount Pleasant, Westmoreland County, containing
     6  approximately 17,250 square feet with an armory building hereon
     7  erected, more particularly described as follows:
     8     All that certain lot, piece or parcel or ground, lying and
     9  situate in the First Ward of the Borough of Mount Pleasant,
    10  County of Westmoreland, and State of Pennsylvania bounded and
    11  described as follows:
    12     Beginning at a point at the intersection of the east building
    13  line of Eagle Street and the south building line of Spring
    14  Street, produced; thence along said east building line of Eagle
    15  Street, south 34 degrees 5 minutes west 42.5 feet; thence by the
    16  same south 7 degrees 5 minutes west 47 feet to the corner of lot
    17  193 feet to a lot formerly owned by W.S. Overholt, now a part of
    18  "Frick Park," thence along said lot north 34 degrees 35 minutes
    19  east 80.3 feet; thence through the lot formerly owned by Dr.
    20  James McConaughey, now a part of "Frick Park," north 55 degrees
    21  55 minutes west 215 feet to the place of beginning.
    22     Containing 396 thousandths of an acre.
    23     The above described tract being the whole, or part of, the
    24  Mount Pleasant Armory.
    25     Section 2.  The conveyance shall also be made under and
    26  subject to any reservations set forth in the prior deeds to the
    27  Commonwealth.
    28     Section 3.  The State Armory Board shall retain the right to
    29  reject any and all bids for the armory described in section 1.
    30     Section 4.  The conveyance shall be made under and subject,

     1  nevertheless, to all easements, servitudes and rights of others,
     2  including, but not confined to, streets, roadways and rights of
     3  any telephone, telegraph, water, electric, gas or pipeline
     4  companies, as well as under and subject, nevertheless, to any
     5  estate or tenancies vested in third persons, whether or not
     6  appearing on record, for any portion of the said land or
     7  improvements erected thereon.
     8     Section 5.  The deed of conveyance shall be approved as
     9  provided by law and shall be executed by the Adjutant General
    10  for the State Armory Board of the Department of Military and
    11  Veterans Affairs and the Secretary of General Services with the
    12  approval of the Governor in the name of the Commonwealth.
    13     Section 6.  All moneys received from the sale of the lands
    14  and armory herein authorized to be conveyed shall be deposited
    15  in the State Treasury Armory Fund.
    16     Section 7.  This act shall take effect immediately.
