AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," further providing for eligible lists
6 of persons qualified to teach.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2110 of the act of March 10, 1949
10 (P.L.30, No.14), known as the Public School Code of 1949, is
11 amended to read:
12 Section 2110. Eligible Lists of Persons Qualified to Teach;
13 Appointments.--(a) Eligible lists, properly classified
14 containing the names of persons who have received certificates
15 of qualifications to teach, and arranged as nearly as possible
16 in the order of rank or standing, shall be kept in the office of
17 the superintendent of schools, and shall be open to inspection
18 by members of the board of public education, associate and
19 district superintendents, and principals.
1 (b) Except as superintendent of schools, associate
2 superintendent, assistant district superintendent, director of a
3 special branch, or as a principal of a high school, junior high
4 school, state teachers' college, or vocational school, no person
5 shall be appointed, promoted, or transferred to any educational
6 position in the public school system, in school districts of the
7 first class, whose name does not appear among the three highest
8 names upon the proper eligible list[.], and in school districts
9 of the first class A, whose name does not appear among the top
10 five names upon the proper eligible list, or within the top ten
11 per centum (10%) of the names upon the list, whichever is
12 greater. No person holding a position at the time of the passage
13 of this act shall be displaced by the above provisions.
14 Section 2. This act shall take effect immediately.
