AN ACT
1 Amending the act of June 30, 1981 (P.L.128, No.43), entitled "An
2 act authorizing the creation of agricultural areas," further
3 providing for agricultural security areas.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5(a) of the act of June 30, 1981
7 (P.L.128, No.43), known as the Agricultural Area Security Law,
8 amended November 23, 1994 (P.L.648, No.100), is amended to read:
9 Section 5. Agricultural security areas.
10 (a) Proposals for creation.--Any owner or owners of land
11 used for agricultural production may submit a proposal to the
12 governing body for the creation of an agricultural security area
13 within such local government unit, provided that such owner or
14 owners own at least 250 acres of viable agricultural land
15 proposed to be included in the area. The proposed area may also
16 consist of [two or more] any number of noncontiguous tax parcels
17 or accounts: Provided, That each tax parcel or account is at
18 least ten acres or has an anticipated yearly gross income of at
1 least $2,000 from the agricultural production of crops,
2 livestock and livestock products on such parcel or account.
