AN ACT
1 Requiring employers to make payment to the Commonwealth of an
2 amount equal to any unemployment benefits paid by the
3 Commonwealth which are the result of an illegal discharge,
4 layoff or other displacement of employees by an employer.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Legislative findings.
8 The General Assembly finds that illegal acts by employers
9 harm affected employees, disrupt employment relations and result
10 in costs to the Commonwealth and the Unemployment Compensation
11 Fund.
12 Section 2. Obligations of employers.
13 If any employer discharges, lays off or otherwise displaces
14 any employee in a manner subsequently determined by Federal or
15 State authorities to be illegal, the employer shall be liable
16 for any benefits provided from the Unemployment Compensation
17 Fund related to the discharge, layoff or displacement, as well
18 as any administrative or other costs related thereto, and shall
1 pay the total amount to the Commonwealth.
2 Section 3. Effective date.
3 This act shall take effect in 90 days.
