                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," providing for
     6     flammable materials near interstate or primary highways.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of June 1, 1945 (P.L.1242, No.428), known
    10  as the State Highway Law, is amended by adding a section to
    11  read:
    12     Section 426.  Discharge of Flammable Materials on Certain
    13  Highways Prohibited.--It is unlawful for any person to discharge
    14  flammable materials within five hundred (500) feet of the right
    15  of way of any Federal interstate or Federal primary highway.
    16     Any person violating any of the provisions of this section
    17  commits a misdemeanor of the third degree and shall, upon
    18  conviction thereof, be sentenced to pay a fine of not more than


     1  two thousand five hundred dollars ($2,500.00) and the costs of
     2  prosecution or, in default of payment of the fine and costs, to
     3  be imprisoned in the county jail for a period of not more than
     4  one (1) year. All fines collected under the provisions of this
     5  act shall be paid to the treasurer of the municipality in which
     6  the offense occurred.
     7     Section 2.  This act shall take effect in 60 days.
