                                     AN ACT

     1  Amending the act of December 19, 1990 (P.L.1391, No.215),
     2     entitled "An act providing for motivational boot camps for
     3     certain youthful offenders; and providing for selection of
     4     participants," further providing for definitions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3 of the act of December 19, 1990
     8  (P.L.1391, No.215), known as the Motivational Boot Camp Act, is
     9  amended to read:
    10  Section 3.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Commission."  The Pennsylvania Commission on Sentencing.
    15     "Department."  The Department of Corrections of the
    16  Commonwealth.
    17     "Eligible inmate."  A person sentenced to a term of


     1  confinement under the jurisdiction of the Department of
     2  Corrections who is serving a term of confinement, the minimum of
     3  which is not more than two years and the maximum of which is
     4  five years or less[ OR AN INMATE WHO IS SERVING A TERM OF         <--
     5  CONFINEMENT THE MINIMUM OF WHICH IS NOT MORE THAN FIVE YEARS
     6  WHERE THAT INMATE IS WITHIN TWO YEARS OF COMPLETING HIS MINIMUM
     7  TERM, and who]; has not reached 35 years of age at the time he    <--
     8  is approved for participation in the motivational boot camp       <--
     9  program[.]; and was sentenced under Level 2 or 3 of the Standard
    10  Range Chart of the Sentencing Guidelines, 204 Pa. Code §§ 303.1
    11  et seq (relating to sentencing guidelines). The term shall
    12  include parole violators. BOOT CAMP PROGRAM. The term shall not   <--
    13  include any inmate serving a sentence for any violation of one
    14  or more of the following provisions:
    15         18 Pa.C.S. § 2501 (relating to criminal homicide).
    16         18 Pa.C.S. § 2901 (relating to kidnapping).
    17         18 Pa.C.S. § 3121 (relating to rape).
    18         18 Pa.C.S. § 3123 (relating to involuntary deviate sexual
    19     intercourse).
    20         18 Pa.C.S. § 3701(a)(1)(i), (ii) or (iii) (relating to
    21     robbery).
    22     "Motivational boot camp."  A program in which eligible
    23  inmates participate [for a period of six months] for not more     <--
    24  than the last two years of their sentence in a humane program
    25  for motivational boot camp programs which shall provide for
    26  rigorous physical activity, intensive regimentation and
    27  discipline, work on public projects, substance abuse treatment
    28  services licensed by the Department of Health, ventilation
    29  therapy, continuing education, vocational training and
    30  prerelease counseling.

     1     "Secretary."  The Secretary of Corrections of the
     2  Commonwealth.
     3     Section 2.  This act shall take effect in 60 days.
