                                     AN ACT

     1  Amending the act of December 19, 1990 (P.L.1391, No.215),
     2     entitled "An act providing for motivational boot camps for
     3     certain youthful offenders; and providing for selection of
     4     participants," further providing for definitions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3 of the act of December 19, 1990
     8  (P.L.1391, No.215), known as the Motivational Boot Camp Act, is
     9  amended to read:
    10  Section 3.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Commission."  The Pennsylvania Commission on Sentencing.
    15     "Department."  The Department of Corrections of the
    16  Commonwealth.
    17     "Eligible inmate."  A person sentenced to a term of
    18  confinement under the jurisdiction of the Department of

     1  Corrections who is serving a term of confinement, the minimum of
     2  which is not more than two years and the maximum of which is
     3  five years or less[, and who]; has not reached 35 years of age
     4  at the time he is approved for participation in the motivational
     5  boot camp program[.]; and was sentenced under Level 2 or 3 of
     6  the Standard Range Chart of the Sentencing Guidelines, 204 Pa.
     7  Code §§ 303.1 et seq (relating to sentencing guidelines). The
     8  term shall include parole violators. The term shall not include
     9  any inmate serving a sentence for any violation of one or more
    10  of the following provisions:
    11         18 Pa.C.S. § 2501 (relating to criminal homicide).
    12         18 Pa.C.S. § 2901 (relating to kidnapping).
    13         18 Pa.C.S. § 3121 (relating to rape).
    14         18 Pa.C.S. § 3123 (relating to involuntary deviate sexual
    15     intercourse).
    16         18 Pa.C.S. § 3701(a)(1)(i), (ii) or (iii) (relating to
    17     robbery).
    18     "Motivational boot camp."  A program in which eligible
    19  inmates participate [for a period of six months] for not more
    20  than the last two years of their sentence in a humane program
    21  for motivational boot camp programs which shall provide for
    22  rigorous physical activity, intensive regimentation and
    23  discipline, work on public projects, substance abuse treatment
    24  services licensed by the Department of Health, ventilation
    25  therapy, continuing education, vocational training and
    26  prerelease counseling.
    27     "Secretary."  The Secretary of Corrections of the
    28  Commonwealth.
    29     Section 2.  This act shall take effect in 60 days.
