                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for loitering and
     3     prowling.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5506 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5506.  Loitering and prowling [at night time].
     9     [Whoever at night time] (a)  Offense defined.--A person
    10  commits an offense if that person maliciously loiters or
    11  maliciously prowls around a dwelling house or any other place
    12  used wholly or in part for living or dwelling purposes,
    13  belonging to or occupied by another[, is guilty of a misdemeanor
    14  of the third degree].


     1     (b)  Grading.--Loitering and prowling shall be a misdemeanor
     2  of the third degree if the offense occurs during the daytime.
     3  Loitering and prowling shall be a misdemeanor of the second
     4  degree if the offense occurs at any other time of day.
     5     Section 2.  This act shall take effect in 60 days.
