AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for pedalcycle use on freeways. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 3511 of Title 75 of the Pennsylvania 6 Consolidated Statutes is amended to read: 7 § 3511. Pedalcycles prohibited on freeways. 8 (a) General rule.--No person shall ride a pedalcycle on a 9 freeway. 10 (b) Exceptions.-- 11 (1) The department and local authorities, on highways 12 under their respective jurisdictions, may issue permits for a 13 procession or event prohibited under subsection (a) upon a 14 determination that: 15 (i) The pedalcycle procession or event is of 16 national, State or regional interest; and 17 (ii) the results of an engineering and traffic study
1 indicate that the procession or event can be conducted 2 with safety. 3 (2) On State-designated freeways, pedalcycles may be 4 authorized under the following limitations: 5 (i) The pedalcycler is 16 years of age or older or 6 is accompanied by a pedalcycler 18 years of age or older. 7 (ii) A written request for review of the freeway 8 route based on the potential unavailability of a 9 reasonable alternate route is made to the department. 10 (iii) The department determines that no reasonable 11 alternate route exists. 12 (iv) The department publishes a notice in the 13 Pennsylvania Bulletin authorizing pedalcycle access to 14 the freeway. The notice shall constitute approval for the 15 persons authorized under subparagraph (i) to ride a 16 pedalcycle on the State-designated freeway. 17 (c) Action by local authorities.--Action taken by local 18 authorities regarding permission to use pedalcycles on freeways 19 under their jurisdiction shall be: 20 (1) by ordinance of the local governing body; or 21 (2) by a commission or public official authorized to act 22 on specified matters. 23 (d) Action by department.--Whenever an action by the 24 department effectively redefines any highway as a freeway, thus 25 closing that highway to existing pedalcycle traffic, the 26 department shall initiate the review described in subsection 27 (b)(2)(ii). 28 Section 2.
