                                     AN ACT

     1  Transferring the Rail Safety Division of the Pennsylvania Public
     2     Utility Commission to the Department of Transportation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Transfer.
     6     The Rail Safety Division of the Bureau of Transportation and
     7  Safety of the Pennsylvania Public Utility Commission is hereby
     8  transferred to the Department of Transportation.
     9  Section 2.  Personnel, records, etc.
    10     All personnel, allocations, equipment, files, records,
    11  contracts, agreements, obligations and other materials which are
    12  used, employed or expended in connection with the powers, duties
    13  or functions transferred by this act from the Pennsylvania
    14  Public Utility Commission to the Department of Transportation
    15  are hereby transferred to the Department of Transportation with
    16  the same force and effect as if the appropriations had been made


     1  to and said items had been the property of the Department of
     2  Transportation in the first instance and as if said contracts,
     3  agreements and obligations had been incurred or entered into by
     4  said Department of Transportation.
     5  Section 3.  Civil service.
     6     The transfer made by this act shall not affect the civil
     7  service status of any employee.
     8  Section 4.  Rules and regulations.
     9     Any regulations of the Pennsylvania Public Utility Commission
    10  relating to railroad safety or the operation of the Rail Safety
    11  Division shall be deemed to be regulations of the Department of
    12  Transportation.
    13  Section 5.  Effective date.
    14     This act shall take effect in six months.
