                                     AN ACT

     1  Amending the act of June 18, 1974 (P.L.359, No.120), entitled
     2     "An act creating the Municipal Police Officers' Education and
     3     Training Commission; providing for the commission's
     4     membership, selection, compensation, and removal; providing
     5     for the powers and duties of the commission; providing for
     6     the appointment and duties of the chairman; providing for the
     7     act's applicability to the civil service laws; requiring
     8     training by certain political subdivisions and police
     9     departments; providing penalties for violation thereof; and
    10     making an appropriation," further providing for reimbursement
    11     of police officers' salaries.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 10(a) of the act of June 18, 1974
    15  (P.L.359, No.120), referred to as the Municipal Police Education
    16  and Training Law, amended December 21, 1988 (P.L.1865, No.180),
    17  is amended to read:
    18     Section 10.  Reimbursement of Expenses.--(a)  The commission
    19  shall provide for reimbursement to each political subdivision of
    20  one hundred per cent of the allowable tuition and the ordinary
    21  and necessary living and travel expenses incurred by their
    22  police officers while attending certified municipal police basic

     1  training schools, providing said political subdivision adheres
     2  to the training standards established by the commission. The
     3  regular salary of police officers while attending approved
     4  schools, within the meaning of this act, shall be paid by the
     5  employing political subdivision. Fifty per cent of the regular
     6  salaries of police officers while attending approved schools
     7  within the meaning of the act shall be reimbursed by the
     8  commission to the employing political subdivision. For the
     9  fiscal year beginning July 1, 1989, to June 30, 1990, [and for
    10  each year thereafter] through the fiscal year July 1, 1995, to
    11  June 30, 1996, sixty per cent of the regular salaries of police
    12  officers while attending approved schools within the meaning of
    13  this act shall be reimbursed by the commission to the employing
    14  political subdivision. For the fiscal year beginning July 1,
    15  1996, to June 30, 1997, and for each year thereafter, eighty per
    16  cent of the regular salaries of police officers while attending
    17  approved schools within the meaning of this act shall be
    18  reimbursed by the commission to the employing subdivision. The
    19  commission shall require written documentation of all expenses
    20  incurred by political subdivisions relating to the training of
    21  municipal police officers for the purposes of reimbursement by
    22  the commission. All municipalities shall annually audit these
    23  funds as part of their annual audit and submit a copy of such
    24  audit to the commission. Failure to perform the audit and submit
    25  a copy of it to the commission shall render the municipality in
    26  violation of this act.
